Bids must be submitted electronically to [email protected] before the closing date and time. Late bids will not be accepted. Bids must be submitted on the official forms provided, and bidders are advised to initial all pages. The following returnable documents must be completed and signed:

• Annexure A (Invitation to Bid) with supplier information and declaration by bidder.
• Annexure C (SBD 4, Bidder's Disclosure): discloses any relationship with state employees or the procuring institution.
• Annexure F (SBD 6.1, Preference Points Claim Form) to claim preference points.
• Annexure G (SBD 3.3, Pricing Schedule for Services).
• Annexure I (POPIA Supplier Notice and Consent Form).
• Proof of tax compliance (TCS PIN or CSD number) and B-BBEE certificate or sworn affidavit.
• If subcontracting, proof of subcontracting arrangement.
• If a joint venture, consortium, trust or partnership, a signed teaming agreement.
• The successful bidder must sign a written contract form (SBD 7).

Disqualification risks: incomplete standard bidding documents, late submission, failure to provide tax compliance particulars, false declarations, or any attempt to influence the award.

The 80/20 preference point system applies: 80 points for price and 20 points for specific goals (B-BBEE status level). B-BBEE points are allocated as follows: Level 1 = 20, Level 2 = 18, Level 3 = 14, Level 4 = 12, Level 5 = 8, Level 6 = 6, Level 7 = 4, Level 8 = 2, Non-compliant = 0. Bidders must submit proof of B-BBEE status to claim these points. The SAWS may request shortlisted bidders to present their service offering to the evaluation committee and may conduct site visits to verify the firm's existence, capacity and premises. The SAWS may also request audited financial statements to ascertain financial stability.

The service provider must perform dynamic calibration of H2S, SO2, CO, NOx and O3 instruments. The service provider must have duly approved operational premises with the necessary infrastructure to provide the services and relevant accreditation by the relevant body. A due diligence site visit will be carried out at the premises of the service provider before award. The successful bidder must conclude a Service Level Agreement (SLA) with SAWS and provide a scorecard on how their service offering is measured.

Pricing Schedule for Services (Annexure G, SBD 3.3): Bidders must provide a ceiling price inclusive of VAT for the dynamic calibration of H2S, SO2, CO, NOx and O3 instruments, with a cost breakdown. Indicate any other costs not included, the period required for commencement after acceptance, and whether rates are firm for the full project period. If not firm, provide the basis for adjustments (e.g. CPI).

Pricing must be in South African rand and inclusive of VAT. Bidders must provide a ceiling price based on the total estimated time for completion of all phases, including all expenses. A cost breakdown of the ceiling price is required. Bidders must indicate any other costs not included, the period required for commencement after acceptance, and whether rates are firm for the full project period. If not firm, provide the basis for adjustments (e.g. CPI). Payments will be settled within 30 days from receipt of an invoice.

Tax compliance: bidders must submit a SARS Tax Compliance Status PIN or a printed TCS certificate; if no PIN, a CSD number must be provided. Each party in a consortium/joint venture/subcontracting must submit separate TCS/CSD. Bidders must not be persons in the service of the state, nor have directors/members who are. Foreign suppliers must complete the questionnaire in Annexure A; if recommended for award, SAWS will submit the completed form to SARS for a tax obligations confirmation. B-BBEE: a verification certificate or sworn affidavit (for EMEs and QSEs) must be submitted to qualify for preference points. Bidders must complete SBD 4 (Bidder's Disclosure) and SBD 6.1 (Preference Points Claim).

The contract is subject to the General Conditions of Contract (GCC) and any Special Conditions of Contract. The successful bidder must sign a written contract (SBD 7). The SAWS may cancel the bid if there is no longer a need, funds are unavailable, no acceptable tenders are received, or material irregularities occur. The SAWS may reject bids that are not market-related, or if the bidder has committed fraud. The bidder indemnifies SAWS against third-party claims of infringement of patent, trademark, or industrial design rights. The SAWS may request audited financial statements to verify financial stability. The successful bidder must conclude an SLA with SAWS.
