Pre-bidding testing is at the bidder's account (GCC 8.1). If inspections are a bid condition, the supplier's premises must be open for inspection at all reasonable hours (GCC 8.2). If inspections are introduced during the contract, the purchaser arranges and pays for them (GCC 8.3). Costs of inspections are borne by the purchaser if supplies comply; by the supplier if they do not (GCC 8.4-8.5). Non-compliant supplies may be rejected (GCC 8.6). Post-delivery inspection and rejection rights apply; rejected goods must be removed and replaced at supplier's cost and risk (GCC 8.7-8.8). The purchaser may audit the supplier's records relating to contract performance (GCC 5.4). Warranty: goods must be new, unused, latest models, defect-free for 12 months after delivery/acceptance or 18 months after shipment, whichever ends first (GCC 15.1-15.2). Supplier must repair/replace defects within the period specified in the SCC (GCC 15.4). Failure to remedy allows purchaser to act at supplier's risk and expense (GCC 15.5).
Pricing Schedule
Source: SAA GENERAL CONDITIONS OF CONTRACT. ANNEXURE 4.pdf (TENDER)Prices charged for goods delivered and services performed under the contract shall not vary from the prices quoted in the bid, except for price adjustments authorised in the SCC or in the purchaser's request for bid validity extension (GCC 17.1).
Financial Requirements
Source: SAA GENERAL CONDITIONS OF CONTRACT. ANNEXURE 4.pdf (TENDER)Payment terms and conditions will be specified in the SCC (GCC 16.1). The supplier must submit an invoice with a copy of the delivery note and upon fulfilment of other contractual obligations (GCC 16.2). Payments will be made within 30 days of invoice submission (GCC 16.3). Payment currency is Rand unless the SCC stipulates otherwise (GCC 16.4). Prices are firm for the contract duration except for adjustments authorised in the SCC or bid validity extension (GCC 17.1). Performance security of an amount specified in the SCC must be furnished within 30 days of contract award notification, in the form of a bank guarantee, irrevocable letter of credit, or cashier's/certified cheque (GCC 7.1, 7.3). The security is returned within 30 days after completion of all performance and warranty obligations (GCC 7.4). Goods must be fully insured in a freely convertible currency as specified in the SCC (GCC 11.1).
Compliance Requirements
Source: SAA GENERAL CONDITIONS OF CONTRACT. ANNEXURE 4.pdf (TENDER)No contract will be awarded to a bidder whose tax matters are not in order; a valid original tax clearance certificate from SARS must be provided before award (GCC 32.3). Local suppliers are responsible for all taxes, duties, and licence fees incurred until delivery (GCC 32.2). Bidders must comply with the Competition Act prohibition on collusive bidding and restrictive practices (GCC 34.1-34.3). Specific compliance requirements (CSD registration, B-BBEE level, CIDB grading, professional registrations, local content percentages) will be stated in the bid invitation and SCC.
Contractual Terms
Source: SAA GENERAL CONDITIONS OF CONTRACT. ANNEXURE 4.pdf (TENDER)Collusive bidding and restrictive practices are prohibited under the Competition Act.
