The municipality is not obliged to accept the lowest or any bid and reserves the right to accept the whole or part of the bid.

Scope: Appointment of a Professional Traffic Engineer to compile a Traffic Impact Assessment Report for proposed township establishments on Portion of Erf 1, Elliot and Portion of Erf 50, Cala.

Purpose: To assess traffic, road requirements, and traffic interventions for the proposed developments, ensuring no negative impact on existing infrastructure.

Sites:

• Erf 50, Cala: agricultural zone, extent 16,045 m².
• Erf 1, Elliot: agricultural zone, extent 16,465 m².

Project timeframe: 30 days from project initiation date.

The report must be prepared in accordance with the Sakhisizwe Local Municipality Spatial Planning and Land Use Management bylaw, 2026.

Bidders must provide details of similar projects completed in the past, including:

• Nature of work.
• Contract value.
• Name of employer with contactable references.
• Duration and completion date.

The bidder must be a Professional Traffic Engineer registered with ECSA.

The supplier must permit inspection of records and premises by the purchaser or its representatives.

Pre-bidding testing costs are for the bidder's account.

If inspections or tests show non-compliance, the supplier bears the costs and must replace or remedy at its own expense.

Rejected supplies must be removed at the supplier's cost and risk.

Pricing must be provided per site (Erf 50, Cala and Erf 1, Elliot), with sub-total, VAT at 15%, and grand total.

VAT must be included in bid rates.

Rates are fixed for the contract period.

Pricing: Bidders must include VAT (15%) in their bid rates.

Pricing schedule: Provide study price per site, sub-total, VAT, and grand total.

Contract period: One month.

Rates are fixed; no contract adjustment allowed during the contract period.

Penalties: 10% of the invoice amount may be withheld if the service provider fails to deliver as specified.

Performance security: Required within 30 days of contract award, in the form of a bank guarantee, irrevocable letter of credit, or cashier's/certified cheque (amount specified in Special Conditions of Contract).

Payment: Within 30 days of submission of a valid invoice.

Tender validity: 90 days after closing date.

CSD: Must be registered on the Central Supplier Database and submit a full CSD report not older than 3 months.

Tax: Must have a valid tax compliance status (SARS TCS PIN or CSD number). A printed TCS certificate may be submitted.

Rates clearance: All municipal rates and taxes must be paid where the business has its head or regional office. A rates clearance certificate not older than 3 months must be submitted, or a lease agreement if the property is leased.

Professional registration: The bidder must be a Professional Traffic Engineer (Pr. Eng) registered with ECSA, with proof of registration.

B-BBEE: A B-BBEE status level verification certificate or sworn affidavit (for EMEs and QSEs) must be submitted to qualify for preference points.

Disqualification: Bidders in the service of the state, listed on the Register of Tender Defaulters, or who have abused the SCM system are disqualified.

The traffic impact assessment must ensure the proposed developments do not cause negative impacts on existing infrastructure, in line with the municipality's responsibility under the Spatial Planning and Land Use Management bylaw.

The General Conditions of Contract (GCC) for government procurement apply, along with any Special Conditions of Contract.

Key provisions:

• Performance security must be furnished within 30 days of contract award.
• Payment within 30 days of invoice submission.
• Prices are fixed and cannot vary except as authorised.
• Contract amendments require written agreement by both parties.
• No assignment of obligations without prior written consent.
• Delays in performance are subject to penalties (calculated at the prime interest rate per day of delay).
• Termination for default, insolvency, or corrupt/fraudulent practices.
• Force majeure may relieve liability for delays.
• Disputes: amicable consultation, then mediation, then South African courts.
