Evaluation proceeds in four phases:

Phase 1 (Pre-compliance): Bid documents checked for SCM returnable documents, tax matters, and CSD registration proof.

Phase 2 (Mandatory requirements): Bidders must demonstrate a pre-tender in-situ site investigation comprising not fewer than 17 soil samples, including at least 2 baseline samples from unaffected areas and at least 15 samples from within the fire-affected area. Evidence under Annexure B must include a site plan with sampling locations and unique identifiers, photographs per sample point, and a signed site access log. Key experts must hold the professional registrations detailed in Annexures D and E (e.g. EAPASA, SACNASP, SACPCMP). Failure to meet mandatory requirements disqualifies the bid.

Phase 3 (Functionality): Bidders must score a minimum of 75% to proceed to Phase 4.

Phase 4 (Price and preference points): 80 points for price, 20 points for specific goals under the 80/20 system. Specific goals: more than 50% ownership by Black people (20 points), by women (20 points), or by people with disabilities (20 points).

Turnkey, outcome-based contract to clean up, remediate and rehabilitate the Lichtenburg (Biesiesvlei) Waste Tyre Depot, Plot 15, Biesiesvlei, Ditsobotla Local Municipality, Northwest Province, following a fire on 20 July 2023 that affected an estimated 28,500 m² of the approx. 30,000 m² leased site.

The service provider is fully responsible for designing and implementing the remediation and rehabilitation solution; the department does not prescribe methodologies, disposal routes or treatment technologies.

The final site condition must comply with Soil Screening Values (SSV1) under the National Norms and Standards for the Remediation of Contaminated Land and Soil Quality (NEM: Waste Act). Site-specific screening and completion values must not be less stringent than SSV1.

Deliverables: a fully remediated and rehabilitated site, stable and free-draining, suitable for re-establishment of natural vegetation; use of existing stockpiled material where suitable and additional material as required.

Confirmatory sampling and laboratory analysis must be done by a SANAS-accredited laboratory.

All waste must be classified, handled, transported, treated and disposed of at appropriately licensed facilities.

A comprehensive close-out report is required, including laboratory results, waste manifests, disposal certificates, material records, and as-built photographic documentation.

A Community Liaison Officer (CLO) must be appointed for the duration of works; remuneration per BCCEI rates for a Task Grade 1 worker.

Security services, if required, must be provided by PSIRA-registered personnel or entities.

The service provider is appointed on a turnkey, outcome-based basis and is fully responsible for designing and implementing the remediation and rehabilitation solution. The department does not prescribe methodologies; the solution must be based on site investigations and sampling. The method statement for the remediation approach and feasibility must consist of 5 to 10 pages (excluding cover and index) and cover: remediation approach, pathway to SSV1 compliance, key assumptions and constraints. A detailed programme of works must be submitted for approval and serves as the baseline for monitoring, extension of time and penalties.

Pricing must be submitted on SBD 3.3 and Annexure A. The pricing schedule must not be a single lump sum; it must show clearly identifiable line items for remediation and rehabilitation activities, monthly health and safety compliance costs, close-out report preparation, and any other cost elements. A projected monthly cash flow must be submitted. Payment is monthly upon certification by the Project Manager. The offer must remain valid for 120 days.

A comprehensive offer inclusive of all costs, expenses and applicable taxes must be submitted. The financial offer must be in the same envelope as the technical proposal.

Bidders must submit a total contract price under Annexure A and complete SBD 3.3; in case of discrepancy, SBD 3.3 takes precedence.

Pricing must not be a single lump sum; it must be broken into clearly identifiable line items, at minimum for: remediation and rehabilitation activities, health and safety compliance costs on a monthly basis, close-out report preparation, and any additional cost elements.

A projected monthly cash flow, linked to the programme, must be submitted; it forms the basis for monthly payment claims.

Payment is monthly for work executed and certified by DFFE's Project Manager against the approved programme and pricing schedule, and demonstrated progress. The department may withhold, defer or adjust certification where progress is not adequately demonstrated.

No additional payment for items outside the approved pricing schedule unless formally authorised in writing.

Travelling costs between home and the DFFE office are not for the account of DFFE.

The offer must remain valid for 120 calendar days from the closing date. The department may extend the validity period; bidders that do not respond in writing to the extension will not be considered further.

DFFE reserves the right to negotiate price with the recommended service provider only.

CSD registration: proof of registration on the Central Supplier Database (CSD) must be submitted with the bid.

Tax compliance: bidders must submit a SARS Tax Compliance Status PIN or printed TCS certificate; where no TCS is available, a CSD number must be provided. For consortia/JVs/subcontractors, each party must submit a separate TCS certificate/PIN/CSD number.

B-BBEE: a valid B-BBEE Status Level Verification Certificate (SANAS-accredited or CIPC) or a sworn affidavit (for EMEs and QSEs) must be submitted to qualify for preference points.

The service provider must develop, submit for approval, and implement a Health and Safety Plan and Health and Safety File in accordance with applicable OHS legislation, including the Construction Regulations, prior to commencement and for the duration of works. Site access for pre-tender testing is subject to health and safety requirements, including induction, supervision, and PPE. Tenderers are responsible for their own OHS compliance during site access and must indemnify the department against any loss, damage, injury or claim arising from such access.

The service provider must ensure the final site condition complies with Soil Screening Values (SSV1) as prescribed in the National Norms and Standards for the Remediation of Contaminated Land and Soil Quality under the NEM: Waste Act, 2008. Rehabilitation must result in a stable, free-draining surface suitable for the re-establishment of natural vegetation and minimisation of erosion and long-term environmental risk. All waste generated must be classified, handled, transported, treated and disposed of at appropriately licensed facilities in accordance with applicable legislation.
