ESKOM requires a five-year nec3 term service contract (tsc3, option a priced contract with a price list) for the inspection, servicing, testing and supply of spares for the ankerlig 2 fire protection system at ankerlig 2 power station in the western cape. Work is instructed through task orders, with a first plan for acceptance due within two weeks of the contract date and a task order programme within five days of each order. Bids close on 5 november 2026 at 10:00, and the most consequential consideration for bidders is that evaluation runs through functionality, price and specific goals under the PPPFA 80/20 or 90/10 system, where a missing b-bbee certificate or affidavit means zero preference points.
Closing: 5 November 2026 at 10:00 — the complete original tender plus one complete hard copy must be received by Eskom before the closing time.
B-BBEE: a valid B-BBEE certificate or affidavit must be submitted; without one the bidder scores zero points under the PPPFA 80/20 or 90/10 price and preference point system.
Registration: a CSD registration number is required, and where the Tender Data stipulates a CIDB grading as a qualification criterion the bidder must be CIDB-registered at the closing date and time or capable of registration within 21 working days of closing.
Returnable documents: signed Form of Offer and Acceptance (C1.1) stating the tendered total exclusive and inclusive of VAT, Contract Data Part 2 (C1.2b) with key people and CVs plus direct and subcontracted fee percentages, the completed price list (C2), the PAYE questionnaire (Pack A for companies, close corporations and trusts; Pack B for individuals) with the applicable signed affidavits, CIPC proof of ownership or shareholding, authenticated proof of authority where an agent submits for a principal, and proof of SHEQ systems, policies and capabilities.
Disqualifying omissions: unsigned or omitted returnable documents and unsigned affidavits result in PAYE being withheld from payments, and coercive, collusive, corrupt, fraudulent or obstructive action during procurement or execution allows Eskom to terminate without any court finding, as does a business rescue order against the contractor.
Pricing and damages: the Option A price list is priced as lump sums, as stated quantities multiplied by a rate, or a mix of both, with VAT at 15% and prices fixed and firm for the first 12 months; low service damages run at 10% per day capped at 20% of Task Order value for an unapproved safety file or rework and 25% for incomplete documentation, late maintenance or progress reports and delayed mobilisation, and delay damages are 10% of each Task Order value.
Contract term, defects and liability: the service period is 5 years, patent defects run 12 months and latent defects 2 years from the in-service (commissioning) date, warranty is 3 years after component installation and 52 weeks after delivery for materials, liability for indirect or consequential loss is limited to R0.00, and the end of liability date is 36 months after the end of the service period.
