VAT: registered for VAT; include Eskom's VAT number on invoices.

Health and safety: The Contractor must take all reasonable precautions to maintain health and safety. May be appointed as Principal Contractor under the Construction Regulations 2014. Prices must include sufficient amount for compliance with health and safety laws and Eskom rules.

Asbestos: comply with Eskom's Asbestos Standard 32-303. OEL for asbestos is 0.2 fibres/ml (4-hour TWA) and 0.6 fibres/ml (10-minute TWA). If asbestos is identified, risk assessment and control measures are required. Personnel may stop work and leave contaminated area until declared safe. Removal/disposal by registered asbestos contractor at Employer's expense.

Safety failures attract Low Service Damages: failure to provide PPE - 5% per occurrence; failure to report incidents - 5% per occurrence; unsafe housekeeping - 2% per occurrence; non-compliance with Life Saving Rules - 5% per incident; failure to submit SHE file updates - 2% per occurrence. All capped at 10% of Task Order value.

Environmental compliance: The Contractor must comply with all applicable environmental laws and regulations, and ensure subcontractors and employees do the same.

Environmental failures attract Low Service Damages: oil or grease spill not cleaned immediately - 2% per occurrence; pollution caused through contractor negligence - 5% per occurrence. Both capped at 10% of Task Order value.

Annexure A: Low Service Damages (LSD) Service Level Table. Damages are deducted from amounts due, capped at 10% of Task Order value. Categories and rates:

1. Administrative/statutory non-compliance (e.g., B-BBEE certificate, tax compliance) - 2% per missing element.
2. Equipment reliability - repeat failure of same component due to poor workmanship within a month - 2% per occurrence.
3. Inspection - failure to identify critical defects leading to equipment failure - 2% per occurrence.
4. Defects & PM - failure to perform scheduled PM activities - 2% per missed activity; incomplete/incorrect/late PM documentation - 2% per incident.
5. Breakdown response - failure to attend emergency breakdown within contractual response time - 5% per occurrence.
6. Availability - crane/hoist unavailable due to contractor delays - 2% per day.
7. Emergency support - failure to provide standby support - 2% per occurrence.
8. Meeting attendance & reporting - failure to attend scheduled meetings without valid excuse - 2% per missed meeting.
9. Safety - failure to provide PPE - 5% per occurrence; failure to report incidents - 5% per occurrence; unsafe housekeeping - 2% per occurrence; non-compliance with Life Saving Rules - 5% per incident; failure to submit SHE file updates - 2% per occurrence.
10. Environment - oil/grease spill not cleaned - 2% per occurrence; pollution due to negligence - 5% per occurrence.
11. Quality - failure to complete quality inspection records - 2% per occurrence.
12. Documentation - failure to provide inspection checklists and job cards - 2% per occurrence.

Evaluation criteria are not detailed in this document. Bidders must meet compliance requirements including CSD registration, tax clearance, B-BBEE certificate, and criminal verification for personnel.

Returnable documents: the completed PAYE Questionnaire (Evaluation Pack A for companies/CCs/trusts, or Evaluation Pack B for individuals) with all required appendices and the signed summary sheet. The completed pack must be returned to Eskom, with Group Tax copied on [email protected].

The PAYE Questionnaire determines the contractor's tax classification (independent contractor, personal service provider, labour broker, or dependent contractor) for PAYE withholding purposes. Bidders must complete the relevant evaluation pack and sign the required affidavits and declarations as directed by their answers. Failure to sign required appendices may result in PAYE being withheld from payments.
