Bids must be submitted on the official forms provided and must not be re-typed.

All returnable documents must be completed in full, in non-erasable black ink, and signed by a person duly authorised to do so.

No alterations or additions to the tender documents are permitted except to correct errors or comply with employer instructions; all such changes must be initialled.

No alternative tender offers are permitted.

Telephonic, telegraphic, telex, facsimile or e-mailed tender offers will not be accepted.

Returnable documents (all must be completed, signed and submitted):

• SBD 1 (Invitation to Bid): bidder and contact details, signed as the offer cover page.
• Fully completed Form of Offer: commits the bidder to the offered contract price.
• Priced Bills of Quantities / Pricing Schedule: the priced scope of work.
• SBD 6.1 (Preference Points Claim): claims preference points for specific goals.
• Proof of CIDB grading designation (1EB or higher).
• Recent CSD report with tax compliant status.
• SCM Consent Form: consents to processing of personal information under POPIA.
• Tax PIN certificate/document.
• B-BBEE certificate or sworn affidavit.
• Declaration of current projects: lists current projects being executed.
• SBD 4 (Declaration of Interest): discloses any connection to state employees or the procuring institution.
• Proof of valid COIDA (Letter of Good Standing from the Compensation Commissioner).
• Three (3) reference letters and/or completion certificates from clients within the last 5 years from the closing of the RFQ; letters must be signed and dated; sub-contracting references not accepted; only traceable clients accepted; one client counts as one reference; appointment letters and purchase orders not accepted.
• Joint venture documents (if applicable): signed JV agreement/MoU, authorised representative, company registration and statutory documents, consolidated B-BBEE/sworn affidavit.

Failure to submit or complete items 2.2, 2.3, 2.5, 2.10, 2.11, 2.12, 2.13, 2.14 (if applicable) will render the proposal non-responsive and it will not be considered.

The bidder must not appear on the National Treasury's list of blacklisted entities.

Evaluation stages (in order):

1. Stage 1: Compliance with mandatory or compulsory requirements (Part T2.1). Failure leads to automatic disqualification.
2. Stage 2: Reference letters with similar projects.
3. Stage 3: Price.
4. Stage 4: Specific goals (preference points).

Preference point system: 80/20 (estimated value inclusive of VAT is equal to or less than R50,000,000).

Price points: maximum 80 points, calculated using the formula Ps = 80(1 - (Pt - Pmin)/Pmin).

Specific goals points: maximum 20 points, allocated as follows:

• Black-owned: 100% black ownership = 8 points; 51% to 99% = 4 points; less than 51% = 0 points.
• Women-owned: 100% women ownership = 4 points; 30% to 99% = 2 points; less than 30% = 0 points.
• Youth ownership: 100% youth ownership = 4 points; 30% to 99% = 2 points; less than 30% = 0 points.
• Disability ownership: 20% or more owners with disability = 4 points; more than 10% but less than 20% = 2 points; less than 10% = 0 points.

Total evaluation points = price points + specific goals points.

Scope: Supply, deliver and install new UPS batteries, model NH12-420W E-GUARD 12V/110AH, at the NLC head office in Hatfield, Pretoria.

The work is classified as Electrical Engineering (EB) construction work.

Contract duration: once-off, effective on date of appointment and receipt of purchase order, or as directed by the NLC.

No alternative tender offers are permitted.

Pricing: Bidders must complete the priced Bills of Quantities / Pricing Schedule.

The offered total contract price must be stated inclusive of VAT in the Form of Offer.

No bid security or guarantee is specified.

Cost of tendering: the employer will not compensate bidders for any costs incurred in preparing or submitting the tender.

If the validity period lapses before evaluation, the employer reserves the right to review the price based on the Consumer Price Index (CPI).

CIDB grading: Bidders must be registered with the CIDB, or capable of being so prior to evaluation, with a contractor grading designation of 1EB or higher. Proof of CIDB grading (category, grading, CRS number) must be submitted.

Joint ventures: every member must be CIDB-registered; the lead partner must have a grading of 1EB or higher (or not lower than one level below, with required recognition status); the combined grading must meet the required designation.

CSD: Bidders must be registered on the Central Supplier Database and submit a recent CSD report with tax compliant status.

Tax: A valid tax clearance certificate or SARS tax PIN must be submitted. Each party in a JV/consortium must submit a separate TCS certificate/PIN/CSD number.

B-BBEE: A valid B-BBEE certificate or sworn affidavit must be submitted to claim preference points.

COIDA: Proof of valid COIDA (Letter of Good Standing from the Compensation Commissioner) is required.

SBD 4 (Declaration of Interest): discloses whether any director or shareholder is employed by the state or connected to anyone at the procuring institution; false declarations lead to disqualification.

SBD 9 (Certificate of Independent Bid Determination): certifies the price was set independently, with no collusion or price disclosure.

Bidders must not be persons in the service of the state, nor companies with directors who are, nor close corporations with members who are.

Bidders must not appear on the National Treasury's list of blacklisted entities.
