Bids must be sealed and the envelope endorsed with the bid number SLM/SCM/09/2026/2027 and the description 'RENEWAL AND UPGRADE OF ESET PROTECT COMPLETE LICENSES'. No faxed, couriered, or emailed tenders will be accepted. Late bids will be rejected. Bids will be opened in public immediately after the closing time.

Scope: Supply, deliver, and install ESET PROTECT COMPLETE renewal and upgrade for a period of 24 months (two years). The antivirus software must prevent, detect, and remove malicious software from municipal devices, actively scan files, monitor device behaviour, and block threats such as trojans, ransomware, and spyware.

General requirements:

• All licenses must be genuine, compliant, and sourced through authorized antivirus channels.
• Licenses must be valid for a 24-month subscription period.
• The service provider must provide proof of ESET Gold Partner certificate.

Bidders must furnish details of similar projects/services satisfactorily completed in the past, including a description, contract value, name of employer with contactable references, duration and completion date.

All licenses must be genuine, compliant, and sourced through authorized antivirus channels.

Licenses must be valid for a 24-month subscription period.

The service provider must provide proof of ESET Gold Partner certificate.

Goods supplied must conform to the standards mentioned in the bidding documents and specifications.

The purchaser may inspect, test, or analyze contract supplies on or after delivery and reject any that do not comply with contract requirements. Rejected supplies are held at the supplier's cost and risk, and the supplier must remove and substitute them at their own cost.

Pre-bidding testing, if any, is for the account of the bidder.

Pricing schedule: Item 1 – Supply, deliver and install ESET PROTECT COMPLETE renewal and upgrade for 24 months, 100 users, Public ID 3AF-X5H-CUT, quantity 01. Item 2 – Professional services including travelling, quantity 01. Subtotal, 15% VAT, and total to be provided.

Bidders must include VAT in their bid rates.

Rates are fixed for the contract period; no contract adjustment will be allowed.

Penalties: If the service provider fails to deliver as specified, the employer may withhold 10% of the invoice amount.

Performance security: Within 30 days of notification of contract award, the successful bidder must furnish performance security in the amount specified in the Special Conditions of Contract (SCC), in the form of a bank guarantee, irrevocable letter of credit, or cashier's/certified cheque.

CSD registration: Bidders must be registered on the Central Supplier Database (CSD) and submit a CSD Full Summary Report not older than 3 months.

Tax compliance: Bidders must submit their SARS Tax Compliance Status (TCS) PIN or a printed TCS certificate. Where no TCS is available, a CSD number must be provided. For consortia/joint ventures/sub-contractors, each party must submit a separate TCS certificate/PIN/CSD number.

B-BBEE: A B-BBEE status level verification certificate or sworn affidavit (for EMEs and QSEs) must be submitted to qualify for preference points.

Municipal rates and taxes: All municipal rates and taxes must be paid where the business has its head or regional office. A rates clearance certificate not older than 3 months must be submitted; if the property is leased, a lease agreement must be submitted.

ESET Gold Partner: Proof of ESET Gold Partner certificate is required.

No bids will be considered from persons in the service of the state or from bidders listed on the Register of Tender Defaulters.

Contract period: 24 months.

Payment: The method and conditions of payment will be specified in the SCC; payment will be made promptly, but no later than 30 days after submission of an invoice or claim.

Warranty: The supplier warrants that goods are new, unused, and free from defects; warranty valid for 12 months after delivery or 18 months after shipment, whichever concludes earlier, unless specified in SCC.

Performance security: Within 30 days of contract award, the successful bidder must furnish performance security in the amount specified in SCC, in the form of a bank guarantee, irrevocable letter of credit, or cashier's/certified cheque.

Termination for default: The purchaser may terminate the contract in whole or in part if the supplier fails to deliver or perform, or engages in corrupt or fraudulent practices.

Force majeure: The supplier is not liable for delays caused by force majeure events, provided prompt written notice is given.

Disputes: Parties shall attempt amicable resolution; if unresolved after 30 days, mediation may be commenced; if mediation fails, the dispute may be settled in a South African court.

Assignment: The supplier shall not assign obligations without the purchaser's prior written consent.

Subcontracts: The supplier must notify the purchaser in writing of all subcontracts awarded.

Taxes and duties: A local supplier is responsible for all taxes, duties, and license fees until delivery; no contract will be concluded with a bidder whose tax matters are not in order.

The Sakhisizwe Local Municipality is under no obligation to accept any proposal/tender and reserves the right to accept the whole or any part of the proposal/tender.

No proposals/tenders will be considered from persons in the service of the state, or from bidders or directors/shareholders listed on the Register of Tender Defaulters in terms of the Prevention and Combating of Corrupt Activities Act of 2004.

Bidders must not have abused the Employer's Supply Chain Management System or failed to perform on any previous contract.

Upon award, the Sakhisizwe Local Municipality's supply chain policy will apply in all tender stages.
