The work carries eskom's category 3 supplier quality regime under specification 240-105658000 and iso 9001, which obliges the successful bidder to accept pre-contract quality requirements and to submit to post-award quality performance monitoring and quality audits. The single most consequential item for bidders is the signed form a quality acknowledgement, which is the only returnable document identified for this enquiry.
Key Requirements
Returnable document: Form A (Tender & Contract Quality Requirements, Category 3) must be completed and signed by the bidder's quality representative; an unsigned or incomplete form leaves the bid without the required quality acknowledgement.
Quality category: only Category 3 of specification 240-105658000 applies — Categories 1, 2 and 4 are marked not applicable, and the main supplier and sub-supplier capability and capacity assessment does not apply.
ISO 9001 scope: clauses 4 to 10 (context of the organisation, leadership, planning, support, operation, performance evaluation and improvement) and quality management principles 1 to 7 all apply to the contract.
Post-award obligations: contract execution, supplier quality performance monitoring and supplier quality audit apply, together with Eskom's rights of access and to information, preservation, quality audit conditions, management of nonconformities and nonconforming outputs identified by Eskom, and special processes.
Closing: bids close on 5 November 2026 at 10:00 under enquiry E3683GXMPHEN.
Scope and site: once-off supply and delivery of plant equipment for operations at Hendrina Power Station, Mpumalanga.
Quality acknowledgement effect: signing Form A confirms acceptance of Eskom's supplier quality requirements under specification 240-105658000 and the ISO 9001 standard, so bidders must be able to meet those requirements before bidding.

Evaluation stages
Eligibility and basic compliance screening — bidders must meet the eligibility criteria, submit a complete tender with commercial, financial and technical information, and a full price list.
Functionality — Company Experience, weighted 100%.
Minimum qualifying score: 70%. Bidders below the threshold are disqualified.
Price and preference points — 80/20 preference point system.
Price: 80 points.
Specific goals (B-BBEE): 20 points.
Ranking: price and specific goal scores are added and bidders are ranked from highest to lowest.
Price evaluation basis
Prices are evaluated inclusive of VAT, corrected for arithmetical errors, excluding contingencies in any bill of quantities or activity schedule, and adjusted for acceptable variations or deviations.
Tenders are compared on net present value, taking account of the tendered programme, price adjustment factors, exchange rate fluctuations and other risk parameters.
Unconditional discounts count for evaluation; conditional discounts do not, but are applied when payment is made.
Failure to submit evidence of a specific goal claim does not disqualify the bid, but scores 0 for that goal.

Objective criteria apply and are a condition of award; if they are not met, the second-ranked bidder may be recommended for award.
Eskom may award to a bidder other than the highest scorer where objective criteria justify it.
Reverse e-auction: not applicable.
No public tender opening; tenders are downloaded electronically and prices are not read out.
Contractual requirements are not evaluation criteria; they are assessed after evaluation and ranking and must be met before award.

Evaluation Criteria
Source: Eskom - Standard Conditions of Tender - 30 January 2025-1.pdf (TENDER)
Sequence
Basic compliance check — a tender that fails is non-responsive.
Mandatory returnables — a tender missing stipulated documents or information at closing is disqualified.
Pre-qualification criteria, where stipulated; Eskom does not assess the same criterion twice.
Functionality, where it is a criterion — bidders must meet the minimum threshold in the Tender Data to proceed.
Financial analysis — Eskom assesses the financial risk of contracting with the bidder; if mitigating factors are absent, insufficient, or the risk too high, the bidder is not considered for award.
Price evaluation against the Tender Data, taking into account CPA, FOREX, commodity exposure, unconditional discounts, technical adjustment, present value and forecast invoicing rates.
B-BBEE and Specific Goals scoring.
Preference points
Ranking adds the price score and the Specific Goals score, highest to lowest, under the 90/10 or 80/20 system.
B-BBEE level is scored from the CSD report or the certificate/affidavit supplied.
Where B-BBEE is a pre-qualification criterion, proof must be submitted at closing or the tender is disqualified; a fraudulent or expired level also disqualifies.
Where no B-BBEE certificate/affidavit is submitted, or it is fraudulent or expired, the bidder is not disqualified but scores zero PPPFA points.
Failure to meet Specific Goals or to submit supporting proof by closing scores zero Specific Goals points but does not disqualify.
Arithmetical errors
Amount in words prevails over figures.
Eskom checks the highest-ranked tenders for misplaced decimal points, incomplete pricing schedules or bills of quantities, incorrect multiplication or addition, and exchange rates used with fewer than four decimal places or incorrectly.
The bidder is asked to confirm the tendered prices or accept Eskom's corrections; the corrected total is binding. Refusal to accept the correction results in rejection.
Other
Objective criteria may be applied only under section 2(1)(f) of the PPPFA and only if stipulated in the Invitation to Tender; functionality and B-BBEE scorecard elements may not be used as objective criteria.
A reverse e-auction may be used; where it applies, bidders submit a complete tender without prices, and any prices included are disregarded.
Technical Specifications
Source: Eskom - Standard Conditions of Tender - 30 January 2025-1.pdf (TENDER)
Scope
The goods, works or services, quantities and delivery points are set out in the Tender Data and Invitation to Tender documents; this document covers the tender process only.
Delivery and cataloguing
The successful bidder may be required to supply cataloguing information per item after contract award.
All materials delivered to Eskom must be labelled to Eskom's labelling specification.
Where cataloguing applies, the pricing schedule must carry a cataloguing line item, which bidders must quote for; Eskom pays for cataloguing.
Quality Management
Source: Eskom - Standard Conditions of Tender - 30 January 2025-1.pdf
Quality forms part of Eskom's SHEQ requirements. Bidders must satisfy Eskom that quality systems, policies and capabilities are in place at the closing date and time and/or by contract award, and must reflect all SHEQ costs and personnel in the tender. Compliance with Eskom's SHEQ requirements and applicable quality legislation is a condition of the tender.
Pricing Schedule
Source: Eskom - Standard Conditions of Tender - 30 January 2025-1.pdf
Pricing format
Rates, prices and the tendered total must include all duties, taxes (including VAT) and other levies payable by the successful bidder, applicable 14 days before the closing date and time.
Prices are fixed for the contract duration and not subject to adjustment except as provided in the Invitation to Tender.
Prices are stated in South African Rand unless the Invitation to Tender instructs otherwise; where part payment in another currency applies, use the stipulated exchange rate and base date.
Where cataloguing is required, the pricing schedule must include a cataloguing line item; Eskom pays for cataloguing.
Alterations to the tender documents are allowed only to comply with Eskom instructions or to correct the bidder's errors, must be initialled by all signatories, and may not use correction fluid or tape.
Alternative tenders are accepted only with a main tender and only if permitted.
During evaluation, mandatory returnables due at closing will not be requested afterwards; clarification may not change prices or the substance of the tender except to confirm correction of arithmetical errors, and the corrected total is binding.

Disqualification and sanction
Misrepresentation or falsification of any information, certificate, affidavit or document may disqualify the bid.

Where sub-contracting to designated groups is a pre-qualification criterion under the PPPFA Regulations, the sub-contractor's B-BBEE status and CSD number or certificate/affidavit must be submitted at closing.
For PPPFA point allocation, a missing, fraudulent or expired certificate/affidavit does not disqualify the bidder but scores zero points.

Contractual Terms

Tender validity
The tender must remain open for acceptance for the validity period after closing; Eskom may ask for an extension, and a bidder that agrees may not change its tender. Refusal to extend removes the bidder from further consideration. If validity expires before contracts are concluded, the process ends without award.
Eskom's rights
Eskom may accept or reject any variation, deviation or alternative tender, accept part of a tender, cancel the tender before contract conclusion (with written reasons on request), and negotiate with one or more selected bidders.
Eskom, its subsidiaries, shareholders, advisers, directors, employees and representatives are not liable for losses arising from participation in the tender or from its amendment, termination, suspension or exclusion.
Eskom gives no warranty on the accuracy or completeness of tender information.
Confidentiality and documents
All procurement matters are confidential; Eskom documents may be used and copied only to prepare and submit this tender.
Bidders must obtain the latest revisions of standardised specifications incorporated by reference.
Award and contract
Acceptance is notified before the validity period expires, after approval by the Eskom Adjudication Authority; for open tenders the notification is published on the Eskom Tender Bulletin and NT e-Tender Portal.
Eskom revises the contract documents to reflect addenda, returnables, negotiated changes and other agreed revisions.
Authorised signatories of both parties sign the original and one copy of the Form of Agreement.
Insurance: cover provided by Eskom may be less than the contract requires; bidders should take qualified advice.
Performance security: where required, the bidder names at least two financial institutions it would approach; Eskom may reject an unsuitable institution.
Special Conditions

Tender validity
The tender must remain valid for acceptance for the validity period after closing; Eskom may request an extension, and a bidder that agrees may not modify its tender. Refusal to extend excludes the bidder from further consideration.
Alterations
No alterations or additions to the tender documents except to comply with Eskom instructions or to correct the bidder's own errors; all alterations must be initialled by every signatory, and correction fluid or tape may not be used.
Alternative tenders
An alternative tender is accepted only if a main tender is also submitted and the Invitation to Tender permits alternatives; it may be based only on the criteria stated in the Tender Data.
Requirements
Source: Eskom - Standard Conditions of Tender - 30 January 2025-1.pdf (TENDER)
Eligibility
Bidders must meet the eligibility criteria in the Tender Data and must not be restricted from doing business with Eskom or state-owned companies.
Sub-contracting 100% of the scope of work is not permitted; such bids are ineligible and disqualified.
Legislation
Compliance is required with National Treasury Instruction Notes, CIDB Regulations, dtic designated local content requirements, PPPFA Regulations, the Amended B-BBEE Codes, COIDA, the OHS Act and Eskom's SHEQ requirements.
CIDB
Where a CIDB grading is a qualification criterion, the bidder must be registered with the CIDB at closing or be capable of registration within 21 working days of closing. Proof of registration is mandatory at closing; if only proof of application is available, submit it at closing and the actual CIDB registration printout by contract award.
Contract goals on award
Contract Skills Development Goals (CSDG) apply to contracts of 12 months or more and to service or professional service contracts of R5 million or more, or engineering, construction or design-and-build contracts at CIDB grade 7 or higher.
Contract Participation Goals (CPG) apply to General Building and Civil Engineering works contracts of at least 6 months where at least 25% of the main contract could be subcontracted in the CE, EB, GB or ME classes.
Sanction
Misrepresentation or falsification of any information, certificate, affidavit or document may disqualify the bid; B-BBEE fraud or fronting is reported to the B-BBEE Commission, with suspension from state-owned company business for up to 10 years and possible imprisonment.

Evaluation stages
Basic compliance is checked before detailed evaluation; failure makes the tender non-responsive, and failure to submit the original and copy in paper form (or to upload documents for e-tendering) results in disqualification.
Mandatory returnables missing at closing disqualify the tender.
Pre-qualification criteria apply where stipulated, with no criterion measured twice.
Functionality, where used, requires the minimum threshold in the Tender Data.
Financial analysis assesses the risk of contracting with the bidder; without adequate mitigating factors the bidder is not considered for award.
Price is evaluated on the Tender Data criteria, including CPA, FOREX, commodity exposure, unconditional discounts, technical adjustment, present value and forecast invoicing rates.
B-BBEE and Specific Goals are scored; a missing, fraudulent or expired B-BBEE certificate/affidavit, or unmet Specific Goals, scores zero points without disqualifying the bidder.
Price and Specific Goals scores are added and bidders ranked highest to lowest under the 90/10 or 80/20 system.
Objective criteria may be used only under PPPFA section 2(1)(f) and only if stipulated; functionality and B-BBEE scorecard elements may not serve as objective criteria.
A reverse e-auction may apply, in which case a complete tender without prices is required and any prices submitted are disregarded.
Price corrections
Mandatory returnables due at closing are not requested afterwards; clarification may not change prices or the substance of the tender except to confirm correction of arithmetical errors, and the corrected total is binding.

Sub-criteria 1.1 — Completed orders (40%): completed orders with signed delivery notes for the supply and delivery of industrial spares within the past 5 years. Each submission must show the client company, project description, contract period, contract value and contact person. Scoring: 0 orders = 0 points; 1 to 2 orders = 2 points; 3 to 4 orders = 3 points; 5 or more orders = 5 points. A delivery note that is missing or unsigned for any order scores zero for that order.
Sub-criteria 1.2 — Equipment specifications (30%): a comprehensive catalogue or brochure for the spares in the scope of work. Scoring: 0 specifications = 0 points; 1 specification = 2 points; 2 to 3 specifications = 3 points; 4 to 6 specifications = 5 points. Specifications that do not match the scope of work score zero.
Sub-criteria 1.3 — Lead time (30%): a signed letter on company letterhead confirming delivery to Hendrina Power Station within 60 days of order placement. The letter forms part of the NEC contract. A lead time longer than 60 days, or no letter, scores 0 points; 60 days or less scores 5 points.
