Bids must be submitted in sealed envelopes, clearly marked with the tender number and title, and placed in the tender box at the Municipal Offices, 13 Kerk Street, Piketberg, no later than 12:00 on Monday, 14 September 2026. Bids will be opened in public at that time. Bids addressed to any municipal official in a personal capacity will be disqualified. The bidder is responsible for ensuring courier companies place bids in the tender box; the Municipality is not liable for courier failures. Faxed, emailed, mailed, telegraphic, or late bids will not be accepted. Bids must be submitted only on the Municipality's bid documentation, with all figures and signatures in original format. Bids must be valid and binding for 120 days after closing date.

Bids are evaluated under the Council's Supply Chain Management Policy using the 80/20 preference points system: 80 points for price, 10 points for specific participation goals, and 10 points for B-BBEE. The bid price must be VAT inclusive. Evaluation criteria include relevant specifications, value for money, capability to execute the contract, and the PPPFA and associated regulations. Specific participation goals include locality points: Bergrivier Jurisdiction (10 below R50m / 5 above R50m), West Coast jurisdiction (5/3), Western Cape Province (3/2), South Africa (2/1). Bidders must submit an originally certified B-BBEE Certificate or originally certified B-BBEE Sworn Affidavit; failure to submit will not render the bid non-responsive but the bidder will score 0 points for B-BBEE. No CIDB grading is required.

The tender is for the appointment of an Environmental Assessment Practitioner to conduct the required environmental approval process for housing development and associated infrastructure. The scope is set out in the specifications. Bidders must be suitably qualified and experienced service providers. The service must be delivered in accordance with the specifications and standards in the bidding documents.

Variation orders: where the estimated value of changes does not vary by more than 15% of the total contract value, the contractor may be instructed to deliver the goods or render the services. For measurable quantities, the contractor may be approached to reduce unit prices, with no escalation in price.

Goods supplied must conform to the standards in the bidding documents and specifications. The supplier must permit the purchaser to inspect records and have them audited. Pre-bidding testing is for the bidder's account. If inspections/tests/analyses are required, the supplier's premises must be open for inspection. Costs of inspections are borne by the purchaser if goods conform, and by the supplier if they do not. Non-conforming supplies or services may be rejected; rejected goods must be removed and replaced at the supplier's cost.

The Pricing Schedule must be completed and signed as a returnable document. The bid price must be VAT inclusive. Prices charged must not vary from the quoted bid price except for authorised adjustments. No contract will be concluded with a bidder whose tax matters are not in order or whose municipal rates and services charges are in arrears. Bidders indebted to the Municipality must declare all municipal account numbers and may be required to sign an agreement for deductions from payments.

The bid price must be VAT inclusive. Prices quoted must not vary from the bid price except for authorised price adjustments or bid validity extensions. Payments will be made in Rand, no later than 30 days after submission of a valid invoice. No contract will be concluded with a bidder whose tax matters are not in order (SARS must certify tax compliance prior to award) or whose municipal rates and services charges are in arrears. Bidders indebted to the Municipality for rental, levies, rates, or service charges must either settle the debt or sign an agreement for deductions from payments due under the tender. The tenderer must declare all municipal account numbers in the Bergrivier area for which the enterprise or its proprietors/directors are responsible. Variation orders: changes not exceeding 15% of the total contract value may be instructed; for measurable quantities, the contractor may be approached to reduce unit prices with no escalation.

Bidders must be registered on National Treasury's Central Supplier Database (CSD) and submit the CSD registration number with the bid. A valid Tax Compliance Status (TCS) Pin must be submitted; failure to submit the TCS Pin or CSD registration number may invalidate the bid. Registration on CSD is compulsory to conduct business with Bergrivier Municipality. Where the contract value exceeds R1,000,000, the bidder must be registered with SARS for VAT. An originally certified B-BBEE Certificate or originally certified B-BBEE Sworn Affidavit must be submitted (zero B-BBEE points if omitted). No CIDB grading is required. Bidders must submit a valid Letter of Good Standing from the Compensation Commissioner (COIDA).

Bidders must complete and sign the OHSA (Occupational Health and Safety) form and submit a valid Letter of Good Standing from the Compensation Commissioner. The form is a returnable document; failure to submit it with the bid may render the bid non-responsive.

The service involves the environmental approval process for housing development and associated infrastructure. The appointed Environmental Assessment Practitioner must conduct the required environmental approval process as set out in the specifications.

The contract is subject to the General Conditions of Contract (GCC) for government procurement. The supplier must not disclose contract documents or information without the purchaser's written consent. Intellectual, copyright, and patent rights of documentation/projects developed for the Municipality vest in the Municipality. The supplier must furnish performance security within 30 days of contract award, in the amount specified in the Special Conditions of Contract, in the form of a bank guarantee, irrevocable letter of credit, or cashier's/certified cheque. The supplier warrants goods/services are free from defects; warranty period is 12 months after delivery/acceptance or 18 months after shipment, whichever ends earlier. Payments are made within 30 days of invoice. The supplier may not assign obligations without prior written consent. All subcontracts must be notified in writing. Delays render the supplier liable to penalties calculated at the current prime interest rate per day of delay. The purchaser may terminate for default, including corrupt or fraudulent practices, and may restrict the supplier from doing business with the public sector for up to 10 years. Force majeure relieves liability for delay. The purchaser may terminate for insolvency. Disputes are resolved by mutual consultation, then mediation, then South African courts. The supplier's aggregate liability is limited to the total contract price, except for criminal negligence, wilful misconduct, or infringement. The contract is in English and governed by South African law.

Tenders must be valid and binding for 120 days after closing date. The award is subject to the signing of a Service Level Agreement (SLA) between the successful bidder and Bergrivier Municipality. Late, incomplete, faxed, or emailed quotations will not be accepted. Proof of dispatch is not proof of receipt. The Council is not obliged to accept the lowest or any quotation and reserves the right to accept any quotation or part thereof.
