Refresh of the land bank panel of recruitment agencies (T09-08-26)

The agreement is a Service Procurement Agreement between Land Bank and a contractor for the provision of services. It covers appointment, duration, termination, and general terms.

Bidders must be a registered company in South Africa with the capability to render recruitment services. They must have full capacity and authority to enter the agreement, including all necessary registrations, certificates, permits, licences and authorisations. They must comply with B-BBEE laws and PFMA requirements. The agreement prohibits cession or assignment without Land Bank's prior written consent, and any change in effective control requires consent. Bidders must be willing to submit to Land Bank's accreditation process and comply with all Land Bank Policies.

The agreement covers the appointment, duration, termination, and general terms for the services to be rendered. The contractor must exercise utmost diligence, care, and skill, provide services in accordance with sound and generally accepted industry practices, and correct any deficiencies at its own cost. Service performance reviews will be conducted jointly to measure performance. The contractor warrants that it has full capacity and authority, has obtained all necessary approvals, and that services will be supplied by appropriately qualified, trained, and experienced personnel.

Consideration for services is detailed in the Cost Schedule (Annexure B). Payment terms include invoicing on a deliverable basis, payment within 30 days of invoice, and parameters for disbursements such as accommodation (max R1,300 per night), domestic air travel (economy), car hire (B class), and own car use (AA rate per km).

Bidders must comply with B-BBEE laws and PFMA requirements. They must have full capacity and authority, including all necessary registrations, certificates, permits, licences and authorisations. They must be willing to submit to Land Bank's accreditation process and comply with all Land Bank Policies.

The contractor must comply with all applicable South African health and safety legislation, including the Occupational Health and Safety Act, and ensure that any statutory, licensing, insurance, and other relevant regulations pertaining to equipment used by staff are fully complied with.

The agreement includes clauses on interpretation, recordal, appointment, commencement, duration and termination, general obligations of the contractor, rights and obligations of Land Bank, service performance review, Land Bank policies and accreditation, PFMA compliance, staff members, indemnity, confidentiality, intellectual property rights, inventions, cession and assignment, sub-contractors, force majeure, warranties and limitation of liability, dispute resolution, breach, post-termination provisions, exit management, notices and domicilia, and general provisions.

The quality, standard and performance requirements in relation to the Services are part of Land Bank Policies.

Bidders may be required to attend a briefing session if deemed necessary by the Land Bank. If indicated, the session is compulsory and failure to attend results in disqualification. Unless stated otherwise, sessions are held at Land Bank Head Office, Lakefield Office Park, Building A, First Floor, 272 Lenchen Avenue, Centurion.

For clarification before the closing date, bidders must direct queries to the contact person identified in the RFP.

Bids must be submitted by the closing date and time; late bids are not accepted. One original and one soft copy on a USB flash drive are required, with the tender number and subject on the cover. No entity may be involved in more than one bid. Any material change in control or composition of the bidder after submission requires prior written approval from the Land Bank. Bidders must study the RFP carefully; no modifications are allowed after closing. The bidder is responsible for omissions or errors, and corrections must not materially alter the bid.

Bidders must be registered on the National Treasury Central Supplier Database (CSD). Bidders must hold all necessary approvals, registrations, certificates, permits, licences and authorisations to perform the services. Bidders must not be on the National Treasury database of restricted suppliers or register of tender defaulters. Bidders must not have been found guilty of a serious breach of law in the preceding 5 years. Bidders must not have acted fraudulently or in bad faith towards the Land Bank or any public body. Bidders must submit a completed SBD 4 (Declaration of Interest), SBD 9 (Certificate of Independent Bid Determination), and any other required National Treasury standard forms as specified in the RFP.

The bidder must tender strictly in accordance with the scope of work supplied by the Land Bank, unless officially amended.

Prices quoted must be exclusive of VAT, which must be shown separately at the standard rate on the tax invoice. The successful bidder shall not increase its prices for the duration of the Service Provider Agreement.

By submitting a bid, the bidder warrants that it has all necessary approvals (registrations, certificates, permits, licenses, authorisations) to perform the services and is registered with National Treasury on the Government's Central Supplier Database.

A bid submitted in response to this RFP constitutes a binding offer that remains irrevocable for 120 business days from submission. Bids are valid for acceptance within the validity period after closing. Bidders may be asked to extend the validity period, but no changes to the bid are allowed unless directly caused by the extension.

The Land Bank may amend or modify the RFP before the closing date without prior notice; amendments will be sent in writing and may extend the closing date. The Land Bank reserves the right to carry out site inspections or request supporting documentation to confirm any information provided by the bidder.

The purpose is to refresh the panel of recruitment agencies for the Land Bank and Land Bank Insurance. Agencies will source and place candidates for vacant positions, excluding executive search, for permanent, fixed-term, and temporary roles. The engagement model includes a mandate agreement, a 3-year panel membership, ad hoc work allocation, and the possibility of a rate card at contracting stage. Specific preference goal requirements will be provided during engagement.

A minimum threshold of 70 points is required to proceed. Final stage: Preference and financial evaluation under PPPFA, using either the 80/20 or 90/10 preference point system. The Land Bank and Land Bank Insurance seek to appoint recruitment agencies to a panel for a period aligned with the existing contract (3 years). Agencies will provide recruitment and placement services for all vacant positions not requiring executive search, including permanent, fixed-term, and temporary placements. Duties include loading candidate information onto the Land Bank e-recruitment system, presenting candidates meeting job requirements and pay range, and conducting pre-employment checks: two reference checks from a direct line manager, criminal checks, identity confirmation, citizenship confirmation, credit checks where required, fit and proper checks, qualification checks, driver's licence checks if required, and confirmation of professional memberships. Work is allocated on an ad hoc basis. Land Bank may include a rate card at contracting stage.

The scoring methodology follows the Preferential Procurement Policy Framework Act (PPPFA) regulations of 2022. Either the 80/20 or 90/10 preference point system will be used. Bidders must complete Annexure I (SBD 6.1) in full to submit all B-BBEE and sub-contracting information at bid closing.

Bidders must demonstrate experience in recruitment and placement in Banking, Financial Services, and Insurance sectors. Technical evaluation criteria include: Company experience (30 points) – placements in all three industries within the last 1-3 years, with testimonials; Experience in E-Recruitment Systems (20 points) – number of systems worked on; People with Disabilities (20 points) – number of disability placements in FY 2024/25; Process and tools for pre-employment (15 points); and Response handling and talent mapping (15 points). Minimum threshold is 70 points.

The tenderer must grant Land Bank the right to inspect its records and must preserve records for at least 3 years after conclusion of each transaction.

Essential returnable documents: proof of good standing with SARS (verified via CSD or SARS e-filing PIN), proof of CSD registration, completed SBD 1 (Invitation to Bid), completed SBD 4 (Declaration of Interest) – any conflict of interest declared or identified will render the bid non-responsive. Also required: valid B-BBEE certificate or affidavit, tax compliance status (TCS) PIN and tax clearance certificate, completed vendor information sheet, FICA/KYC documents as per Annexure D, and a Covenant of Integrity declaration. Bidders must not be persons in the service of the state, nor have directors who are, and must not be listed on the Register of Tender Defaulters. False declarations lead to exclusion.

The successful bidder will enter into a Service Level Agreement (SLA) with Land Bank, which will form the contractual basis and include General Conditions of Contract. No work may commence without a signed SLA or other formal agreement; any work done without it is at the service provider's own risk. The panel membership is for 3 years. Land Bank may refresh or review the panel through an open bid process. Bidders must sign a confidentiality agreement. The Bank reserves the right to amend the terms of reference.
