Inspection, servicing, testing and supply of spares for the vanderkloof fire protection system

Compulsory site clarification meeting:

• Date: 20 August 2026, Time: 09H00, Venue: Vanderkloof Power Station. Attendance is mandatory; non-attendance results in disqualification.

Tender validity period: 12 weeks from closing date.

Tenderers must submit electronically via the Eskom E-tendering site (Eskom Tender Bulletin) by the closing date and time. Documents must be uploaded under folders for Technical, Commercial, Financial, and Other. Submission requirements and disqualification risks:

• All documents must be in PDF format; the price list must be submitted as a PDF and a copy in Excel format. Total submission is limited to 4 GB, with a per-document limit of 500 MB.
• No zip or compressed files; no hard copies accepted.
• If a tenderer resubmits, only the latest version is considered; previous versions become null and void.
• The submission status must be marked as complete.
• Late tenders will not be accepted, regardless of reason.
• Failure to upload tender documents renders the tender non-responsive.

Returnable forms (all required at closing, unless noted):

• If any required returnable is not completed, signed, or submitted by closing, the tenderer will be disqualified (some non-disqualifiable items may be requested in writing within 5 working days).

Returnables required at closing (disqualifiable): Authorisation (A), Acknowledgement (B), Tenderer's Particulars (C), Integrity Declaration (D), CPA for Local Goods (E), SBD 6.2 and local content declarations (G1-G4), SBD 1 (H), SBD 6.1 (I), SBD 4 (J), E-tendering Help Manual acknowledgement, and CSD registration.

Non-disqualifiable at closing but may be requested within 5 working days: Tax Clearance Certificate (if applicable), Tax Evaluation Questionnaire, Employment Equity compliance proof, and certain others.

Required for evaluation: Specific Goals proof (B-BBEE certificate/affidavit), CIDB grading proof (6SF or higher, at closing or within 21 working days), completed NEC Term Services Contract, Pricing schedule, and Technical Evaluation Criteria (Attachment 2).

Required prior to contract award: financial statements (due diligence), safety COIDA certificate, quality documents, and any other contractual requirements.

JV bidders: submit letter of intent, signed JV agreement, and confirmation of a single bank account.

Evaluation follows the 80/20 preference point system under the PPPFA.

• Price is scored out of 80 points.
• Prices are evaluated inclusive of VAT, corrected for arithmetical errors, excluding contingencies, adjusted for variations, and compared on a Net Present Value basis. Unconditional discounts count towards evaluation; conditional discounts are applied at payment but not for scoring.
• Specific Goals (B-BBEE and other goals) are scored out of 20 points. If a tenderer fails to submit proof for a Specific Goal, it is not disqualified but receives 0 points for that goal.
• Tenderers are ranked by adding price and specific goals scores, highest to lowest.
• Functionality requirements are applicable; a technical evaluation criteria document (Attachment 2) is a required returnable.
• Objective criteria and reverse e-auction are not applicable.
• Contractual requirements (e.g., CSD registration, SHEQ, financial viability, B-BBEE) are not evaluation criteria but are assessed post-ranking, and failure to meet them before award can render the tenderer non-responsive.

The scope is the Vanderkloof Fire Protection System at Vanderkloof Power Station (contractual details in the NEC Term Services Contract and Scope of Work attachment).

Key technical requirements as per returnables:

• Quality requirements: submit List of Tender Returnables Cat 3 Rev 7, Form A Cat 3 Rev 9, Supplier Quality Management Specification, Quality Control Plan or Inspection Test Plan (QCP/ITP) rev 2, and CQP Template 2021.
• Safety requirements include OHS Specification, OHS&Q Management Plan, OHS Risk Assessment Procedure, and related Eskom standards (e.g., Work at Height, Confined Spaces, PPE).
• Additional documents: ECSA/SACPCMP registrations, CVs, permits, licenses, or specific registrations if applicable to the scope.
• The successful tenderer may be required to provide cataloguing information for supplied items and ensure labelling per Eskom specifications; where cataloguing is required, the pricing schedule must include a cataloguing line item.

Bidders must provide proof of professional registrations (e.g., ECSA, SACPCMP), CVs of key personnel, permits, licenses, or specific registration documents relevant to the scope of work. These are required as part of the tender returnables.

Quality management requirements include: List of Tender Returnables Cat 3 Rev 7, Form A Cat 3 Rev 9, Supplier Quality Management Specification, Quality Control Plan or Inspection Test Plan (QCP or ITP) rev 2, and CQP Template 2021. These must be submitted as part of the tender returnables.

A completed pricing schedule (Attachment 3) must be submitted. In e-tendering, the price schedule must be in PDF and Excel format. The schedule must include a line item for cataloguing if applicable. Prices are evaluated under the 80/20 system: price scored out of 80, specific goals out of 20. The BOQ includes a line for CIDB Contract Skills Development Goals at 0.25% for the SF class of works.

No performance security is required (not applicable).

Eskom payment terms:

• Contracts below R50 million (incl. VAT): payment within 30 days of receipt of undisputed invoices.
• Contracts above R50 million (incl. VAT): payment within 60 days of receipt of undisputed invoices.

Eskom reserves the right to negotiate with preferred bidders if tendered prices are not market-related.

Due diligence: submit latest approved annual financial statements (no drafts or management accounts) of the tendering company (not parent/holding), including director's and auditor's/reviewer's reports, statement of financial position, comprehensive income, changes in equity, cash flows, and notes. Include public interest score and ITA34C for the current and previous years (for un-audited SA entities). Start-ups formed within the last 12 months are exempt but must submit statements once available if successful.

Pricing schedule must be submitted in PDF and Excel format as per submission guidelines.

Mandatory: Proof of CSD registration (CSD number/report) must be submitted with the tender.

Eligibility criteria (disqualifying):

• No restriction to do business with Eskom or State-Owned Companies; not on National Treasury restriction list or Tender Defaulters list; not restricted by Eskom.
• Not be a national of a sanctioned country (applies to subcontractors/suppliers too).
• No conflict of interest; no multiple submissions; JV must have joint and several liability; tenders must be signed by authorised persons; no 100% subcontracting.

CIDB: Contractor grading of 6SF or higher is required (for main contractor, or JV lead partner as specified). Proof of CIDB grading must be submitted at closing or within 21 working days from closing date.

Tax compliance: Tax clearance certificate or SARS e-filing PIN required for local tenderers not on CSD; foreign tenderers with SA footprint need certified tax clearance; foreign suppliers with no SA footprint must complete SBD 1 but no tax proof required.

B-BBEE: Valid B-BBEE certificate or sworn affidavit required for Specific Goals scoring (20 points); if not submitted, score zero.

Employment Equity: If a designated employer, submit proof of compliance with the Employment Equity Act, including report submitted to the Department of Labour (SA tenderers only).

Safety: COIDA certificate of good standing or proof of application (SA tenderers only).

Tax Evaluation Questionnaire to determine if a personal service provider for PAYE.

Additional contractual requirements that may be assessed pre-award: SHEQ, financial viability (financial statements), B-BBEE, and others as stipulated.

Specific Goals (B-BBEE) are scored out of 20 points under the 80/20 PPPFA system. Proof of B-BBEE status level must be a certificate from an authorised body, a sworn affidavit as prescribed by the B-BBEE Codes of Good Practice, or any other requirement under the B-BBEE Act. A valid certificate or sworn affidavit must be submitted to claim points; otherwise, 0 points are awarded for that goal.

Safety requirements include: Eskom Acknowledgement Form for OHS Legal and Other Requirements (Annexure B), Tender Evaluation Template for High Risk (Annexure C1), OHS Specification, OHS&Q Management Plan, OHS Risk Assessment Procedure (Rev 5), PPE Non-Compliance Memo, Work at Height Standard, Management of Substance Abuse in the Workplace, Occupational Health and Safety Incident Management Procedure, Life-Saving Rules Standard (Rev 7), Vehicle and Driver Safety Management Procedure, PPE Standard, Working in Confined Spaces, Employees' Right of Refusal to Work in Unsafe Situations Procedure, and Acknowledgement Form for Life-Saving Rules.

Safety and quality returnables must be submitted by tender closing to expedite evaluation.

The conditions of contract are the NEC3 Term Services Contract. The contract is for the whole of the scope; alternative tenders are not allowed. The tender validity period is 12 weeks from closing. Eskom may require the successful tenderer to provide cataloguing information and label materials per Eskom specifications.

Payment terms: under R50 million, payment within 30 days of undisputed invoices; over R50 million, within 60 days. Eskom may negotiate with preferred bidders if prices are not market-related.

Main contractors are discouraged from subcontracting with subsidiaries (may be seen as fronting); if they do, it must be declared.

For contracts with CIDB Contract Skills Development Goals (CSDG), the recommended supplier must submit the required documentation after award as per the CIDB Standard for Indirect Targeting for Enterprise Development.

Eligibility and general requirements:

• Must not be under any restriction to do business with Eskom or State-Owned Companies; not on National Treasury restriction list or Tender Defaulters list; not restricted by Eskom.
• Must not be a national of a sanctioned country (applies to subcontractors/suppliers too).
• Must not submit more than one tender; JV/consortium members must be jointly and severally liable for contract execution.
• Must not have a conflict of interest; tenders must be signed by authorised persons; must not subcontract 100% of the scope.
• Basic compliance requires meeting eligibility criteria, submitting a complete tender (commercial, financial, technical), and submitting mandatory commercial returnables by closing.
• CIDB grading 6SF or higher required (as per tender data).
• CSDG applicable at 0.25% for SF class of works.
• Mandatory contractual requirements: CSD registration; additional may include SHEQ, financial viability, B-BBEE, etc.

Prices are evaluated inclusive of VAT, corrected for arithmetical errors, excluding contingencies, adjusted for variations/deviation, and compared on Net Present Value basis.
