Professional labour and industrial relations consultancy services for 36 months

The South African National Accreditation System (SANAS) seeks to appoint a suitably qualified

and experienced Industrial Relations Consultancy to provide professional labour relations

advisory and support services on a retainer basis for a period of thirty-six (36) months. The

consultancy will provide comprehensive labour relations support for an organisation with a

headcount of not more than 90 employees.

For pricing purposes, prospective service providers should note the following: 1 Service

• SANAS has an employee headcount of not more than 90 employees. provider
• Based on historical trends, SANAS attends to an average of fewer than ten (10) formal

labour relations matters per annum. The actual number of matters may vary from year to

year.

• The current service provider is appointed on a monthly retainer of approximately R4,800 to

R5,000. This information is provided for pricing guidance only and does not constitute the

available budget for this procurement.

The appointed service provider shall provide the following services on a retainer basis:

1. Representation at the CCMA, Bargaining Councils and Labour Court, ensuring the fair and

efficient handling of labour disputes.

2. Disciplinary support, including chairing disciplinary, grievance, incapacity and appeal

hearings, and providing guidance on the enforcement of workplace rules.

3. Participation and consultation in trade union engagements and collective bargaining

processes, including representation at the CCMA where required.

4. Labour Relations advisory services, providing assistance, guidance, advice and consulting

support on all Labour Relations matters.

5. Specialised Labour Law support, with access to experienced practitioners who can provide

immediate advice on labour law matters, including retrenchments, strikes, industrial action and

trade union negotiations.

6. Compliance and documentation, including assistance with employment contracts, policies,

procedures, notices and other employment-related legal documentation to ensure compliance

with applicable labour legislation.

7. Training and capacity building to assist management and employees in understanding

labour legislation, legal requirements and best labour relations practices.

8. Labour Relations risk management, providing proactive advice and recommendations to

assist SANAS in managing labour risks and maintaining sound employee relations

Stage 2: Price and SANAS specific goals:

Preferential procurement reform:

The Preferential Procurement Regulations, 2022 pertaining to the Preferential Procurement Policy Framework Act,

Act No . SANAS Preferential Procurement (PP) requirements as per the SANAS Supply Chain

Management Policy, states that SANAS shall deal with suppliers in accordance with the SANAS specific goals. The

application of the specific goals will be as per the applicable pricing formula, the 80/20 system.

SANAS specific goals are in support of the following:

• Previously disadvantaged groups by allocating points for black owned businesses.

Black owned businesses are defined as per the Broad-Based Black Economic

Empowerment Act as Amended by Act No which states that

“Black People” is a generic term which means Africans, Coloureds and Indians who are
