Bids must be submitted in sealed envelopes clearly marked with the tender number and title, placed in the tender box at the Municipal Offices, 13 Kerk Street, Piketberg, no later than 12:00 on Tuesday, 15 September 2026. Bids addressed to a municipal official in a personal capacity will be disqualified. Bids sent by fax or email will not be accepted; proof of dispatch is not proof of receipt. The bidder is responsible for ensuring courier companies place bids in the tender box. Bids must be valid and binding for 120 days after closing. Bids may only be submitted on the official bid documentation provided by the Municipality, with all figures and signatures in original format. Bids evaluated under the Council's Supply Chain Management Policy using the 80/20 preference point system: 80 points for price, 10 points for specific participation goals, and 10 points for B-BBEE. The bid price must be VAT inclusive. Bidders must complete the Preference Point Claim form in full to claim preference points. Bidders who do not submit a B-BBEE certificate or sworn affidavit will score 0 points for B-BBEE but will not be non-responsive. Attendance at the compulsory clarification meeting is required; bidders who do not attend or arrive late will be disqualified.

Scope: supply, servicing, delivery and installation of fire extinguishers for Bergrivier Municipality from date of appointment until 30 June 2029, as set out in the specifications. Goods must conform to the standards in the bidding documents and specifications. The supplier warrants goods are new, unused, of the most recent or current models, and free from defects for 12 months after delivery and acceptance, or 18 months after shipment, whichever ends earlier. The supplier must repair or replace defective goods at no cost to the purchaser. The supplier's premises must be open for inspection by the purchaser at all reasonable hours. Non-compliant goods may be rejected and replaced at the supplier's cost.

Variation orders up to 15% of the original contract value may be instructed. For measurable quantities, the contractor may be approached to reduce unit prices, provided there is no escalation in price.

Goods must conform to the standards in the bidding documents and specifications. The supplier's premises must be open for inspection by the purchaser at all reasonable hours. Pre-bidding testing is at the bidder's cost. If inspections show goods comply, the purchaser bears the cost; if not, the supplier bears the cost. Non-compliant goods may be rejected and must be replaced at the supplier's cost. The supplier must permit the purchaser to audit records relating to contract performance.

Prices must be quoted in South African currency and inclusive of VAT. For contracts exceeding R1 million, bidders must be registered for VAT. Bergrivier Municipality's VAT registration number is 4000 846 172. Payment will be made in Rand, no later than 30 days after submission of a valid invoice with delivery note. Prices quoted may not vary except for authorized adjustments. No contract will be concluded with a bidder whose tax matters are not in order or whose municipal accounts are in arrears.

Bidders must complete the OHSA (Occupational Health and Safety) form and submit a valid Letter of Good Standing from the Compensation Commissioner. The Form of Indemnity must also be completed and signed.

General Conditions of Contract (GCC) apply. The supplier must not assign obligations without written consent. Subcontracts must be notified in writing. Delays may incur penalties calculated at the current prime interest rate per day of delay on the delayed portion. The purchaser may terminate for default, including corrupt or fraudulent practices, and may restrict the supplier from doing business with the public sector for up to 10 years. Force majeure relieves liability. Disputes are first resolved by mutual consultation, then mediation, then South African courts. The contract is governed by South African law and written in English. The supplier's aggregate liability is limited to the total contract price, except for penalties and repair/replacement of defective goods. The supplier must indemnify the purchaser against third-party patent, trademark or design infringement claims. Intellectual property developed for the municipality vests in the municipality.
