This tender is a request for bid (open-tender) for professional services. The contract will be governed by the national treasury general conditions of contract (gcc, july 2010), which form part of the bid documents and may not be amended. Bidders must submit an original tax clearance certificate issued by SARS prior to award; NO contract will be concluded with a bidder whose tax matters are not in order. The contract must be written in english and interpreted in accordance with south african law. The supplier may not assign obligations without prior written consent and must notify the purchaser of all subcontracts. Disputes must first be resolved through mutual consultation, then mediation, and if unresolved, may be settled in a south african court. The supplier's aggregate liability is limited to the total contract price, except in cases of criminal negligence, willful misconduct, or patent infringement. The purchaser may restrict a defaulting supplier from doing business with the public sector for up to 10 years, and names may be endorsed on the register for tender defaulters.
Bidders must submit an original tax clearance certificate issued by the South African Revenue Services (SARS) prior to award; no contract will be concluded if tax matters are not in order.
