Evaluation is price and preference using the 80/20 preference points system.

Mandatory requirements (non-compliance makes the tender non-responsive):

Price points (maximum 80):

• Calculated per PPPFA Regulation 4.1 using the 80/20 formula.

Preference points (maximum 20) for specific goals:

• Ownership Goal – Race (Black), weighting 50%: 0% = 0 points; >0% and <51% = 8; >51% and <100% = 15; 100% = 20.
• Ownership Goal – Gender (Female), weighting 50%: same points scale.
• RDP Goal – promotion of South African owned enterprises, weighting 50%: Not in South Africa = 0; South Africa = 5; KZN = 10; eThekwini Municipality (ETM) = 20.

Proof of preference claims via CIPC registration, CSD report, B-BBEE certificate, consolidated B-BBEE certificate (for JV/consortium/trust), or JV/consortium/trust agreement.

Supply, delivery and offloading of MPVC pipes for a period of 36 months.

Delivery point: 17 Electron Road, Springfield, or as advised by the end user.

Delivery times: no deliveries before 09h00 or after 15h00 unless by special arrangement.

Manufacturer requirements:

• Name of manufacturer and brand of each item must be stated on the schedule of rates.
• Bidders who are not manufacturers, accredited distributors, or agents must provide a valid agreement or joint venture agreement with the manufacturer, covering the contract period.
• A letter of intent from the manufacturer/wholesaler must be submitted with the tender, confirming supply and agreement to abide by contract conditions.

Samples:

• Samples may be requested during evaluation; must be delivered within 4 working days of request, at bidder's cost.
• Samples to be delivered to eThekwini Water and Sanitation Pinetown Depot, 14 Scott Road, Pinetown.

Site visit:

• Inspection of the manufacturer's premises will be conducted prior to award to confirm existence, capability, machinery and warehousing.

All items must comply with the relevant SANS/SABS standards: pipes and fittings per SANS/SABS 966.2.2006, bends per SANS/SABS 1123.

Bidders must submit product brochures, proof of SANS compliance, and SABS certificates for each item.

Samples may be requested during evaluation and must be delivered within 4 working days to the Pinetown Depot; samples are checked against specification clauses.

Pricing must be in South African Rand, with VAT shown separately. Unit prices hold for the contract period, subject to variation criteria. Firm prices may be submitted for each 12-month period. Estimated quantities are for information only; the supplier is bound to supply whatever quantities the Municipality requires. Delivery costs are included in the unit price.

Pricing:

• All prices in South African Rand, exclusive and inclusive of VAT stated separately.
• Unit prices to hold for the full contract period, subject to specified variation criteria.
• Firm prices may be submitted for each 12-month period.
• Estimated quantities are provided for information; the supplier is bound to supply whatever quantities the Municipality requires.

Payment:

• Payment only to the supplier; factoring arrangements not accepted.

Objection fee:

• Non-refundable administration fee of R6,131.00 (including VAT) for lodging an objection, payable to eThekwini Municipality FNB account 631 6574 6331, reference the contract number.

CSD registration:

• Must be registered on the National Treasury Central Supplier Database (CSD) at time of closing; provide CSD number (MAAA).
• For joint ventures, each party must be registered.

Tax compliance:

• Valid Tax Compliance Status PIN or Tax Clearance Certificate required.

Municipal fees:

• Declaration of Municipal Fees required; municipal fees must be fully paid or debt agreements concluded.

State service:

• No tender will be considered from persons in the service of the state (per Regulation 44 of Municipal SCM Regulations).

B-bbee:

• Preference points claimed via MBD 6.1; proof via CIPC, CSD report, B-BBEE certificate, or consolidated certificate for JV/consortium/trust.

Experience:

• Minimum 3 years' company experience in supplying and delivering MPVC pipes.

Bidders must submit a declaration accepting the obligations of the Occupational Health and Safety Act and relevant regulations.

The contract is governed by the General Conditions of Contract (NT Circular 52, July 2010), Special Conditions of Contract, the Occupational Health and Safety Act, and the eThekwini Code of Conduct.

The Municipality is not bound to accept the lowest or any tender, and may accept the whole or part of a tender, placing orders without minimum quantities.

Payment is made only to the supplier; factoring is not accepted.

The Municipality may cancel the tender process at any time without liability.

Appeals against decisions may be lodged within 14 days of notification, per Regulation 49 of the Municipal SCM Regulations, with a non-refundable fee of R6,131.00.

Tender validity: 120 days from opening, plus an additional 12 months unless bidder advises otherwise in writing.
