The tender is for the supply, delivery and installation of a 20m solar highmast floodlight, including concrete casting, formwork, earthworks, assembling, bolts, plates, plugs, wiring and all associated works. A CIDB contractor with grading 2EP is required.

B-BBEE: To claim the 3 points for B-BBEE status level contribution, the bidder must be a QSE or EME with B-BBEE status level 1 or 2. Proof must be submitted with the tender.

The SBD 6.1 form includes a declaration that the information provided is true and correct, and that preference points claimed are in accordance with the general conditions. Evaluation is conducted in four phases:

Phase 1 – Mandatory Requirements: attendance of compulsory briefing, CIDB registration (2EP or higher), submission of SBD 1, SBD 3.1, SBD 4, and a valid COIDA certificate. Failure disqualifies.

Phase 2 – Administrative Compliance: SBD 6.1, CSD registration, tax compliance (verified via CSD/SARS), CIPC registration, B-BBEE certificate/affidavit, local content threshold (100%), Annexure C, LC Declaration, Annexures 1 and 2.

Phase 3 – Technical Evaluation: compliance with specification Table 3. Non-compliance disqualifies.

Phase 4 – Preference Points: 80/20 system – maximum 80 points for price, 20 points for specific goals.

Scope: Supply, delivery and installation of 2 x 20m solar high-mast floodlights for the Mzimvubu Water Project access road near Maclear, Eastern Cape.

Each high mast must illuminate a radius of 100m (coverage up to 100m x 100m square area).

Work includes: site establishment, setting out, OHS & environmental compliance, surface preparation, trench trimming, removal of surplus materials, reinforced concrete foundations (including formwork, base plates, bolts, cable sleeves), backfilling, testing and certification (concrete cube results, foundation inspection), complete solar power system (panels, mounting structure, batteries, cabling), complete floodlighting system (6 to 8 LED lights, 80W to 150W, brackets, cabling, junction boxes, earthing, lightning protection), and complete erection, installation, testing and commissioning.

Department provides crane, TLB and excavator only. Any other special equipment must be included in the installation rate.

Concrete samples will be taken by the department's lab for strength testing.

Defective products replaced at supplier's expense.

Delivery and installation to commence not later than 14 days after receipt of official DWS order.

Delivery hours: 06:30 to 15:15, Monday to Thursday; not on Fridays after 14:00, weekends, public holidays, or the last Thursday and Friday of the month.

DWS will decline non-compliant products; declined items must be collected within 48 hours.

Ownership and risk pass to the department at point of delivery upon signed acceptance.

Bidders must acquaint themselves with road conditions and distances to the site.

Technical evaluation requires marking compliance for each specification item; marking both columns is non-compliance and disqualifies. Testing and certification required, including concrete cube results and foundation inspection. Supplier responsible for testing and commissioning for 7 days. Complete erection, installation, testing and commissioning including craneage, alignment, aiming, electrical testing, certification, as-built drawings and O&M manuals per manufacturer's design. Mast manufactured to ISO 9001:2008, hot dip galvanized to SANS 121/1461, Grade S 355 steel to SANS 657/1&3.

SBD 3.1 Pricing Schedule (firm prices) must be completed in full. Items: 1. Site establishment (sum, qty 1); 2. OHS & environmental compliance (sum, qty 1); 3. 20m solar high-mast structure complete including galvanized mast – 3.1 surface preparation/trench trimming/removal of surplus (sum, qty 2), 3.2 reinforced concrete foundation (sum, qty 2), 3.3 backfilling and compaction (sum, qty 2), 3.4 testing and certification including concrete cube results (set, qty 2); 4. Complete solar power system (set, qty 2); 5. Complete floodlighting system (set, qty 2); 6. Complete erection, installation, testing and commissioning (sum, qty 2); 7. Supply and delivery of maintenance kit (sum, qty 2). Sub-total excl. VAT, 15% VAT, total incl. VAT. Delivery period and installation period must be firm. Delivery basis: Mzimvubu Water Project - Access Road, Eastern Cape. Delivery after receipt of order: 14 days. All delivery costs included. Failure to complete the schedule renders the bid non-responsive.

Pricing format: firm prices, all-inclusive (VAT, delivery, and all costs) in South African Rand. Complete SBD 3.1 Pricing Schedule in full; failure invalidates the bid.

Offer validity: 120 days from closing date.

Payment: by electronic fund transfer, per completed installation on site, monthly on receipt of specified tax invoices, within 30 days of receipt and approval of original invoice. No cash, cheque, or upfront payments. No payment for standing time.

Delivery period: firm, 14 days after receipt of order.

Quantities in SBD 3.1 may change; department may purchase one item, some items, or none.

Bid price subject only to statutory changes (VAT, customs/excise levies with written proof).

All delivery costs must be included in the bid price.

No bid security or guarantee is specified.

CIDB grading: minimum 2EP (proof of registration must be submitted with the bid).

CSD registration: mandatory, verified via National Treasury's Central Supplier Database.

Tax compliance: valid SARS Tax Compliance Status (TCS) PIN or printed TCS certificate; CSD number acceptable if no TCS. Each party in a consortium/JV/subcontract must submit separate TCS/CSD.

CIPC registration: company must be actively registered (verified via CSD/CIPC).

B-BBEE: certified copy of B-BBEE Status Level Verification Certificate or sworn affidavit (for EMEs/QSEs) must be submitted to claim preference points. Construction Sector Code applies.

Local content: minimum threshold 100% for cement, galvanized material, steel and bolts. Only locally produced/manufactured products considered. Annexure C and LC Declaration must be completed. A letter from the local manufacturer confirming local production and content is required. Exemption from the dtic required for imported items.

COIDA: valid certificate required.

No bids from persons in the service of the state, or companies/close corporations with directors/members in the service of the state.

Foreign suppliers: must answer questionnaire; if not resident in RSA, no TCS PIN required.

Bidders must adhere to the department's Safety and Environmental policies. OHS & Environmental compliance is a priced item in the schedule. A valid COIDA certificate is a mandatory requirement.

General Conditions of Contract (National Treasury 2010) form part of the contract. The department is not obliged to accept the lowest or any bid. Bidders must comply with all bid documents; no alterations to the Invitation to Bid or Schedule of Quantities. Failure to comply with Annexure 7 conditions may invalidate the bid. The successful bidder must sign the contract form (SBD 7) in ink; failure may invalidate the bid. Payment by electronic fund transfer. Bid price must be firm.

Appointment of a contractor, CIDB 2EP, for supply, delivery and installation of 20m solar high-mast floodlights. Any special equipment must be included in the installation rate. Material delivered to the department; supply, delivery and installation to commence not later than 14 days after receipt of official DWS order. Bidder must nominate a contact person for delivery scheduling.

Bidder must be a CIDB contractor with grading 2EP or higher. Bid must be signed on SBD 1 with all blanks completed. For companies, a board resolution authorising the signatory must be submitted. For joint ventures, the JV agreement and authorisation certificates from each party are required. The successful bidder must sign SBD 7.

Evaluation in four phases: mandatory requirements, administrative compliance, technical evaluation, preference points. 80/20 system. CIDB grading 2EP is required. A valid tax clearance certificate from SARS is a precondition for contract award. Performance security (bank guarantee, irrevocable letter of credit, or cashier's/certified cheque) must be furnished within 30 days of contract award. B-BBEE compliance and NIP Programme participation apply. No corrupt or fraudulent practices permitted. CSD registration is a standard precondition. The supplier must not have been restricted from doing business with the public sector.

The contract is governed by the General Conditions of Contract (GCC) July 2010. Special Conditions of Contract (SCC) supplement the GCC and prevail in case of conflict. The supplier must not disclose contract documents or information without prior written consent. The supplier must indemnify the purchaser against third-party claims of patent, trademark, or industrial design infringement. Performance security must be furnished within 30 days of contract award, in the form of a bank guarantee, irrevocable letter of credit, or cashier's/certified cheque. The security is returned within 30 days after completion of performance obligations. Goods must conform to standards in the bidding documents. The supplier warrants goods are new, unused, and free from defects for 12 months after delivery or 18 months after shipment, whichever ends earlier. Payment is made within 30 days after invoice submission, in Rand. Prices cannot vary from the bid unless authorized. Contract amendments require written agreement. Assignment requires prior written consent. Subcontracts must be notified in writing. Delays may incur penalties calculated at the prime interest rate per day of delay. The purchaser may terminate for default, including corrupt or fraudulent practices, and may restrict the supplier from doing business with the public sector for up to 10 years. Force majeure relieves liability for delays. Disputes are resolved through mutual consultation, then mediation, then South African courts. The contract is in English and interpreted under South African law. Taxes and duties are the supplier's responsibility. No contract is concluded with a bidder whose tax matters are not in order; a tax clearance certificate from SARS is required. The NIP Programme applies to contracts subject to NIP obligations. Collusive bidding is prohibited and may lead to invalidation of bids, termination, restriction, or damages.
