Contractual Terms

ATNS reserves the right to reject, withdraw, or cancel any or all proposals, to negotiate with bidders, and to accept the bid most advantageous to the company.

Non-compliance with bid submission conditions, instructions, or evaluation criteria will result in rejection.
ATNS may enter into negotiations with one or more bidders regarding contract terms, including price. Negotiations do not constitute an award.
A contract is concluded only when reduced to writing and signed by both parties.
ATNS may award one or more contracts for different functions.
Rejection reasons include proven corrupt or fraudulent acts, abuse of the SCM system, proven fraud, or failure to perform on previous contracts.
General Conditions of Contract must be accepted.
Additional information may be requested from bidders during evaluation, with replies due within 7 working days. Failure to comply may lead to disqualification.

Copyright of all documentation belongs to the client. The successful bidder may not disclose information without written approval.
If a contractor cannot deliver within the specified period or price, ATNS must be notified immediately. ATNS reserves the right to implement remedies.
The bidder warrants its ability to conclude the agreement to ATNS's satisfaction.
Waiver of any breach does not prejudice remedies for continuing or other breaches.
On termination, the bidder must hand over all documentation and deliverables to ATNS without the right of retention.
