2 Problems
A channel of communication has been created in case users of the system experiences a problem
with the system. In a case users come across some difficulties in using Tender bulletin, eTendering
and OpenText systems they need to contact the buyer responsible for the published tender.
3 What’s New
A new functionality to “add closed tenders”. Closed tenders refers to the tenders which are not listed
on Tenderbulletin as normal tenders, but are tenders sent directly to the relevant and potential
suppliers who meet the selection and evaluation criteria to offer what the buyer needs. These
suppliers will be sent a link via email to bid privately.

The purpose of this Instruction is to prescribe the requirements for the application of
assignment and cession of contracts resulting from procurement to institutions to which
the Public Finance Management Act, 1999 (Act No. – “the PFMA”), applies.
2.1 The application of cession and assignment by institutions to which the PFMA applies has
been a source of a number of application and interpretation challenges. Chief among
these, is the apparent blurring of the line between assignment of a contract and cession
of a contract, many using them interchangeably. Furthermore, there has been policy
uncertainty as to the permissibility of both cession and assignment within the public
procurement regulatory framework.
2.2 Section 217 of the Constitution of the Republic of South Africa, 1996 (“the Constitution”)
requires that when an organ of state in the national, provincial or local sphere of
government, or any other institution identified in national legislation, contracts for goods
or services, it must do so in accordance with a system which is fair, transparent,
equitable, competitive and cost-effective. Section 76(4) of the PFMA authorises the
National Treasury to make regulations or issue instructions concerning matters
mentioned in that section.
2.3 The application of cession and assignment presents challenges in that it may, in certain
circumstances, be seen to contradict the constitutional requirements of fairness,
transparency and competitiveness in that a contract may be executed by a person that

Application of assignment and cession of contracts resulting from procurement
was not the appointed bidder in a competitive bidding process or a payment may be
made to a person who is not the contracted supplier/service provider.
2.4 This Instruction is intended to provide clarity on the application of cession and
assignment in contracts that result from procurement.
3.1 Assignment refers to the transfer of rights and obligations in a contract from an assigner
to an assignee. The effect of this is that the service provider appointed through a
competitive bidding process transfers the contract in its entirety that is, the obligation
(the responsibility of rendering the services) and the right (of receiving payment for
service rendered) to a third party that did not participate in the bidding process or a bidder
that participated in the bidding process but was not successful.
3.2 South African law of contract is based mainly on common law. However, the contracting
process for commercial contracts entered into by organs of state is subject to section
217 of the Constitution and other applicable legislation. The effect of the above is that
contracts that result from public procurement processes are required to comply with the
requirements of all Supply Chain Management (SCM) legislative prescripts and
consequently, assignment of contracts is not allowed as it will be contrary to principles
of section 217 of the Constitution particularly, fairness, transparency and
competitiveness.
3.3 Clause 19 of the General Conditions of Contract (GCC) makes provision for assignment
of contract. Clause 19 of the GCC provides that “a supplier (or service provider) shall not
assign, in whole or in part, its obligations to perform under the contract, except with the
purchaser’s prior written consent”. However, as stated above, transfer of rights and
obligation of the service provider with or without consent of an organ of state is
against the principles of section 217 of the Constitution and is therefore not
allowed. National Treasury is currently in the process of reviewing the GCC.
4.1 Cession refers to the transfer of only the rights a service provider has in terms of a
contract from it to a third party. In commercial contracts, the main right involved is the
right to be paid for services rendered. While the appointed bidder remains the service
of 4

provider that continues to render the services, the service provider may cede (transfer)
its right to be paid for the services it rendered in terms of the contract to a third party.
This means that the service provider renders the services to an organ of state, while the
organ of state pays for the services rendered to a third party instead, most commonly, a
financial institution.
4.2 Cession is permissible within the SCM legal prescripts. However, it is important that the
application of cession in public procurement is carefully regulated to limit possible
instances of abuse through fronting arrangements and similar processes. It is for this
reason that the application of cession be limited only to those cession agreements in
favour of registered Financial Services Providers (FSP) and state institutions established
for the express purpose of providing funding to businesses and entities (State Institution).
4.3 Therefore, cession shall only be applicable as follows:
4.3.1 Cession must only be applicable to the transfer of right to payment for services
rendered by a service provider to an FSP or State Institutions;
4.3.2 The written request for cession must be by the service provider and not a third
party; and
4.3.3 The written request by the service provider must be accompanied by the
cession agreement.
This Instruction applies to all departments, constitutional institutions and public entities
listed in Schedules 2 and 3 to the PFMA.
6.1 Accounting officers of departments and constitutional institutions must bring the
contents of this Instruction to the attention of all:
a) Chief Financial Officers and supply chain management officials of their respective
departments and constitutional institutions;
b) Accounting authorities of public entities reporting to their executive authorities.
6.2 Heads of provincial treasuries are requested to bring the contents of this Instruction to
the attention of all accounting officers, chief financial officers and supply chain
management officials in their respective provincial departments.

OTP (one time pin) will be sent to both their cell phone and email address.

2 Problems
A channel of communication has been created in case users of the system experiences a problem
with the system. In a case users come across some difficulties in using Tender bulletin, eTendering
and OpenText systems they need to contact the buyer responsible for the published tender.
3 What’s New
A new functionality to “add closed tenders”. Closed tenders refers to the tenders which are not listed
on Tenderbulletin as normal tenders, but are tenders sent directly to the relevant and potential
suppliers who meet the selection and evaluation criteria to offer what the buyer needs. These
suppliers will be sent a link via email to bid privately.

eTendering system is a web-based system that allows suppliers bidding for various tenders
advertised on Tender Bulletin system to “upload” their tender documents. Currently the tenderers or
suppliers submit tender documents at various Eskom tender offices. eTendering system replaces the
manual or physical submission of tender documents at various Eskom tender offices. eTendering
system in a nutshell is an electronic box where tender documents can be “dropped” or “uploaded”.
Suppliers will be required to register their details before they can be granted access to the
eTendering system. An OTP (one time pin) will be sent to both their cell phone and email address.

2 Problems
A channel of communication has been created in case users of the system experiences a problem
with the system. In a case users come across some difficulties in using Tender bulletin, eTendering
and OpenText systems they need to contact the buyer responsible for the published tender.
3 What’s New
A new functionality to “add closed tenders”. Closed tenders refers to the tenders which are not listed
on Tenderbulletin as normal tenders, but are tenders sent directly to the relevant and potential
suppliers who meet the selection and evaluation criteria to offer what the buyer needs. These
suppliers will be sent a link via email to bid privately.

The purpose of this Instruction is to prescribe the requirements for the application of
assignment and cession of contracts resulting from procurement to institutions to which
the Public Finance Management Act, 1999 (Act No. – “the PFMA”), applies.
2.1 The application of cession and assignment by institutions to which the PFMA applies has
been a source of a number of application and interpretation challenges. Chief among
these, is the apparent blurring of the line between assignment of a contract and cession
of a contract, many using them interchangeably. Furthermore, there has been policy
uncertainty as to the permissibility of both cession and assignment within the public
procurement regulatory framework.
2.2 Section 217 of the Constitution of the Republic of South Africa, 1996 (“the Constitution”)
requires that when an organ of state in the national, provincial or local sphere of
government, or any other institution identified in national legislation, contracts for goods
or services, it must do so in accordance with a system which is fair, transparent,
equitable, competitive and cost-effective. Section 76(4) of the PFMA authorises the
National Treasury to make regulations or issue instructions concerning matters
mentioned in that section.
2.3 The application of cession and assignment presents challenges in that it may, in certain
circumstances, be seen to contradict the constitutional requirements of fairness,
transparency and competitiveness in that a contract may be executed by a person that

was not the appointed bidder in a competitive bidding process or a payment may be
made to a person who is not the contracted supplier/service provider.
2.4 This Instruction is intended to provide clarity on the application of cession and
assignment in contracts that result from procurement.
3.1 Assignment refers to the transfer of rights and obligations in a contract from an assigner
to an assignee. The effect of this is that the service provider appointed through a
competitive bidding process transfers the contract in its entirety that is, the obligation
(the responsibility of rendering the services) and the right (of receiving payment for
service rendered) to a third party that did not participate in the bidding process or a bidder
that participated in the bidding process but was not successful.
3.2 South African law of contract is based mainly on common law. However, the contracting
process for commercial contracts entered into by organs of state is subject to section
217 of the Constitution and other applicable legislation. The effect of the above is that
contracts that result from public procurement processes are required to comply with the
requirements of all Supply Chain Management (SCM) legislative prescripts and
consequently, assignment of contracts is not allowed as it will be contrary to principles
of section 217 of the Constitution particularly, fairness, transparency and
competitiveness.
3.3 Clause 19 of the General Conditions of Contract (GCC) makes provision for assignment
of contract. Clause 19 of the GCC provides that “a supplier (or service provider) shall not
assign, in whole or in part, its obligations to perform under the contract, except with the
purchaser’s prior written consent”. However, as stated above, transfer of rights and
obligation of the service provider with or without consent of an organ of state is
against the principles of section 217 of the Constitution and is therefore not
allowed. National Treasury is currently in the process of reviewing the GCC.
4.1 Cession refers to the transfer of only the rights a service provider has in terms of a
contract from it to a third party. In commercial contracts, the main right involved is the
right to be paid for services rendered. While the appointed bidder remains the service

provider that continues to render the services, the service provider may cede (transfer)
its right to be paid for the services it rendered in terms of the contract to a third party.
This means that the service provider renders the services to an organ of state, while the
organ of state pays for the services rendered to a third party instead, most commonly, a
financial institution.
4.2 Cession is permissible within the SCM legal prescripts. However, it is important that the
application of cession in public procurement is carefully regulated to limit possible
instances of abuse through fronting arrangements and similar processes. It is for this
reason that the application of cession be limited only to those cession agreements in
favour of registered Financial Services Providers (FSP) and state institutions established
for the express purpose of providing funding to businesses and entities (State Institution).
4.3 Therefore, cession shall only be applicable as follows:
4.3.1 Cession must only be applicable to the transfer of right to payment for services
rendered by a service provider to an FSP or State Institutions;
4.3.2 The written request for cession must be by the service provider and not a third
party; and
4.3.3 The written request by the service provider must be accompanied by the
cession agreement.
This Instruction applies to all departments, constitutional institutions and public entities
listed in Schedules 2 and 3 to the PFMA.
6.1 Accounting officers of departments and constitutional institutions must bring the
contents of this Instruction to the attention of all:
a) Chief Financial Officers and supply chain management officials of their respective
departments and constitutional institutions;
b) Accounting authorities of public entities reporting to their executive authorities.
6.2 Heads of provincial treasuries are requested to bring the contents of this Instruction to
the attention of all accounting officers, chief financial officers and supply chain
management officials in their respective provincial departments.

Price Factors such as CPA, FOREX, commodity increases, discounts, NPV and forecasted rates of invoicing are taken into account when determining the tendered Price. Arithmetical 3.15 Check responsive tenders for arithmetical errors. If there is a discrepancy between errors an amount in figures and the amount in words, the amount in words shall prevail. Check the highest-ranked tender for the following errors or omissions

omissions in completing the pricing schedule or bill of quantities, or
arithmetical errors in line item totals that are the result of the incorrect multiplication of a unit rate and a quantity in a bill of quantities or schedule of prices; or

NTCSA will notify the tenderer of all arithmetical errors or omissions it has identified and will request the tenderer to either confirm the prices as tendered or to accept the corrected prices. Where there is a misplacement of the decimal point in the unit rate, the line-item total as quoted shall prevail, and the unit rate shall be corrected.
Where there is an error in the total of the prices that is the result either of other corrections required by the checking process or in the tenderer’s addition of prices, the total of the prices shall prevail, and the tenderer shall be asked to revise the selected item prices (and their rates if a bill of quantities applies) to result in the tendered total of the prices. NTCSA will reject the tender if the tenderer does not correct and/or does not accept the correction of errors as required above. Evaluation of 3.16 Score the Specific Goals with reference to the supporting documentation in the tender. Specific Goals If a tenderer fails to meet Specific Goals and/or to submit the required proof/supporting documentation by closing date and time of tender submission, the tenderer will not be disqualified if otherwise evaluated as acceptable in all other criteria; however, the tenderer will score zero points for Specific Goals within the 90/10 or 80/20 allocation of points. Ranking of 3.17 NTCSA will add the score for Pricing and Specific Goals together and rank the tenders tenderers from the highest to the lowest. Objective criteria 3.18 A contract may be awarded to a tenderer that did not score the highest points only in accordance with Section 2(1) (f) of the Preferential Procurement Policy Framework Act,

3.19 Ranking of tenders Tenderers will be ranked by applying the preferential point scoring for
the 80/20 system. NTCSA will add the score from Pricing and Specific
Goals together and rank the suppliers from the highest to the lowest.

Records of the ranking must be submitted to the relevant DAA for
verification. The ranking in points must be reflected in the Procurement
Submission Document submitted to the DAA in support of the

In the event that two or more tenderers have scored equal points, the
recommended tenderer is identified as the tenderer that scored the
higher points for Specific Goals.
If two or more tendered scored equal points, including equal points for
Specific Goals, the recommended tenderer is identified as the tenderer
that scored the highest score for functionality if was part of the
evaluation process.
In the event that two or more tenderers are equal in all respects, the
recommended tenderer must identified by the drawing of lots.
The process of drawing lots will be followed as prescribed in the latest
revision of the Procurement and Supply Chain Management Procedure.
Failure on the part of a supplier to submit “proof of B-BBEE status
level of contributor” for purposes of evaluation and scoring by the
tender closing will not result in disqualification (if tenderer is
otherwise deemed to be responsive/acceptable in all other
aspects). The tenderer will, however, be scored zero on B-BBEE
for purposes of PPPFA scoring and ranking.

2.2 Legal compliance
2.2.1 Section 37(2) (Legal) Agreement
A section 37(2) agreement must be signed between NTCSA and the principal contractor at
the time of awarding the contract. The principal contractor must ensure that a section 37(2)
agreement is compiled between the principal contractor and all their appointed contractors for
the contract.
The original copy of the section 37(2) agreement must be retained by the contractor and a
copy retained by the responsible manager.
A copy all the agreements must form part of the respective contractor’s OHS file.
2.2.2 Hazardous Work by Children (Child Labour)
The constitution of the Republic of South Africa, in the “Bill of Rights” is clear on the rights of
children, especially when it comes to:
i. are inappropriate for a person of that child’s age; or
ii. place at risk the child’s well-being, education, physical or mental health or spiritual, moral
or social development; and the Basic Conditions of Employment Act, Chapter six
Section 43 “Prohibition of employment of children”.
Before resorting to the use of child labour, due consideration must be given to the rights of the
child in terms of the constitution. Where work is being performed which is not prohibited in
terms of the constitution, then such work must be conducted in terms of the OHS Act
“Regulations on Hazardous Work by Children in South Africa” with emphasis on paragraph 2
Purpose and Interpretation. NTCSA does not condone the use of child labour and therefore
all effort must be exercised, and child labour should not be used.
2.2.3 OHS Act
The principal contractor and appointed contractors shall have an up-to-date copy of the OHS
Act and regulations which will be available to all employees.

2.2.4 Legislative Compliance
All contractors will comply with all the legislation pertaining to this contract being:

2.3 NTCSA requirements
All contractors shall, before commencement of the work ensure that all their employees are
familiar with the relevant NTCSA OHS documentation that is applicable to their services.
2.3.1 Appointment of a Contractor
The principal contractor will be appointed by NTCSA on the awarding of the contract and will
be responsible and accountable for all legislative and NTCSA requirements for the duration of
the contract.
2.3.2 Appointment of sub-contractors
The principal contractor may appoint contractors to assist in the contract. All appointments
shall be done in writing and will form part of the OHS plan that is required to be submitted to
NTCSA. Adequate training and instruction must be given to the appointees and the principal
contractor must ensure that all the appointed contractors understand their roles and
responsibilities.
Note: Copies of contractor appointments must be kept in the respective OHS file.
2.3.3 OHS Policy
A OHS policy is a statement of intent and a commitment by the organisation’s CE and senior
management in relation to the relevant OHS roles and responsibilities, the achievement of
their strategic objectives, values of integrity, customer satisfaction, excellence, and innovation.
The principal contractor and all appointed contractors, if already not in place, will be required
to compile an organisational OHS policy in line with their OHS responsibilities. The policy must
be signed by the organisation’s CE or the appointed assistant to the CE OHS Act Section
16(2). The policy must be displayed in a prominent place within the workplace. A copy of the
policy must be filed in all the contract OHS files and as an annexure the OHS Plan.
2.3.4 Coid
The principal contractor and all his/her appointed contractors shall be registered with an
appropriate employment compensation commissioner and have available a valid letter of good
standing (LoGS) from such commissioner. The obligation lies with the contractors to ensure
that the LoGS remains valid throughout the contract period. A copy of the LoGS must be filed
in the entire contract OHS files and as an annexure the OHS Plans.

appointment. The relevant statutory appointments shall be made in accordance with the

Fire Fighter and Evacuation warden, First Aider, 16(2) appointment.

2.7 Risk assessments
It is a legal requirement in terms of Section 8 (2)(d) of the OHS Act for an employer to carry
out risk assessments to establish what hazards to the health and safety or persons are
attached to any work which is performed, any article or substance which is, handled, stored,
transported. A risk assessment is defined as an identification of the hazards present in an
organisation and an estimate of the extent of the risks involved, considering whatever
precautions are already being taken. It is essentially a three-stage process:
Risk assessments are required to be maintained. This means that significant changes to a
process or activity, or any new process or activity should be subjected to a risk assessment
and that if new hazards come to light during the work process, then these should also be
subjected to risk assessments. Risk assessments for long term processes should be
periodically reviewed and updated. Method statements or written safe work procedures are
an effective method as information and record of the way jobs / tasks must be performed. Prior
to start of work, risk assessments on every job / task are ideal to allow managers and
employees to assess any inherent risks that could have been overlooked during the initial risk
assessment or any changes that might have occurred in a period of absence. In particular, if
a job / task is extended over a day or halted due to inclement weather.

2.8 Incident investigation
All incidents shall be investigated in terms of OHS Act General Administrative Regulations 8
and 9, using Eskom Procedure 32-95 as a reference, and where injuries as contemplated in
sections 24 and 25 have been sustained, be reported to the Department of Labour.

2.2 Legal compliance
2.2.1 Section 37(2) (Legal) Agreement
A section 37(2) agreement must be signed between NTCSA and the principal contractor at
the time of awarding the contract. The principal contractor must ensure that a section 37(2)
agreement is compiled between the principal contractor and all their appointed contractors for
the contract.
The original copy of the section 37(2) agreement must be retained by the contractor and a
copy retained by the responsible manager.
A copy all the agreements must form part of the respective contractor’s OHS file.
2.2.2 Hazardous Work by Children (Child Labour)
The constitution of the Republic of South Africa, in the “Bill of Rights” is clear on the rights of
children, especially when it comes to:
i. are inappropriate for a person of that child’s age; or
ii. place at risk the child’s well-being, education, physical or mental health or spiritual, moral
or social development; and the Basic Conditions of Employment Act, Chapter six
Section 43 “Prohibition of employment of children”.
Before resorting to the use of child labour, due consideration must be given to the rights of the
child in terms of the constitution. Where work is being performed which is not prohibited in
terms of the constitution, then such work must be conducted in terms of the OHS Act
“Regulations on Hazardous Work by Children in South Africa” with emphasis on paragraph 2
Purpose and Interpretation. NTCSA does not condone the use of child labour and therefore
all effort must be exercised, and child labour should not be used.
2.2.3 OHS Act
The principal contractor and appointed contractors shall have an up-to-date copy of the OHS
Act and regulations which will be available to all employees.

2.2.4 Legislative Compliance
All contractors will comply with all the legislation pertaining to this contract being:

2.3 NTCSA requirements
All contractors shall, before commencement of the work ensure that all their employees are
familiar with the relevant NTCSA OHS documentation that is applicable to their services.
2.3.1 Appointment of a Contractor
The principal contractor will be appointed by NTCSA on the awarding of the contract and will
be responsible and accountable for all legislative and NTCSA requirements for the duration of
the contract.
2.3.2 Appointment of sub-contractors
The principal contractor may appoint contractors to assist in the contract. All appointments
shall be done in writing and will form part of the OHS plan that is required to be submitted to
NTCSA. Adequate training and instruction must be given to the appointees and the principal
contractor must ensure that all the appointed contractors understand their roles and
responsibilities.
Note: Copies of contractor appointments must be kept in the respective OHS file.
2.3.3 OHS Policy
A OHS policy is a statement of intent and a commitment by the organisation’s CE and senior
management in relation to the relevant OHS roles and responsibilities, the achievement of
their strategic objectives, values of integrity, customer satisfaction, excellence, and innovation.
The principal contractor and all appointed contractors, if already not in place, will be required
to compile an organisational OHS policy in line with their OHS responsibilities. The policy must
be signed by the organisation’s CE or the appointed assistant to the CE OHS Act Section
16(2). The policy must be displayed in a prominent place within the workplace. A copy of the
policy must be filed in all the contract OHS files and as an annexure the OHS Plan.
2.3.4 Coid
The principal contractor and all his/her appointed contractors shall be registered with an
appropriate employment compensation commissioner and have available a valid letter of good
standing (LoGS) from such commissioner. The obligation lies with the contractors to ensure
that the LoGS remains valid throughout the contract period. A copy of the LoGS must be filed
in the entire contract OHS files and as an annexure the OHS Plans.

2.4 Occupational health, hygiene and rehabilitation,

Fire Fighter and Evacuation warden, First Aider, 16(2) appointment.

2.7 Risk assessments
It is a legal requirement in terms of Section 8 (2)(d) of the OHS Act for an employer to carry
out risk assessments to establish what hazards to the health and safety or persons are
attached to any work which is performed, any article or substance which is, handled, stored,
transported. A risk assessment is defined as an identification of the hazards present in an
organisation and an estimate of the extent of the risks involved, considering whatever
precautions are already being taken. It is essentially a three-stage process:
Risk assessments are required to be maintained. This means that significant changes to a
process or activity, or any new process or activity should be subjected to a risk assessment
and that if new hazards come to light during the work process, then these should also be
subjected to risk assessments. Risk assessments for long term processes should be
periodically reviewed and updated. Method statements or written safe work procedures are
an effective method as information and record of the way jobs / tasks must be performed. Prior
to start of work, risk assessments on every job / task are ideal to allow managers and
employees to assess any inherent risks that could have been overlooked during the initial risk
assessment or any changes that might have occurred in a period of absence. In particular, if
a job / task is extended over a day or halted due to inclement weather.

2.8 Incident investigation
All incidents shall be investigated in terms of OHS Act General Administrative Regulations 8
and 9, using Eskom Procedure 32-95 as a reference, and where injuries as contemplated in
sections 24 and 25 have been sustained, be reported to the Department of Labour.

This OHS specification is NTCSA’s minimum requirements which are required to be met for

2.2 Legal compliance
2.2.1 Section 37(2) (Legal) Agreement
A section 37(2) agreement must be signed between NTCSA and the principal contractor at
the time of awarding the contract. The principal contractor must ensure that a section 37(2)
agreement is compiled between the principal contractor and all their appointed contractors for
the contract.
The original copy of the section 37(2) agreement must be retained by the contractor and a
copy retained by the responsible manager.
A copy all the agreements must form part of the respective contractor’s OHS file.
2.2.2 Hazardous Work by Children (Child Labour)
The constitution of the Republic of South Africa, in the “Bill of Rights” is clear on the rights of
children, especially when it comes to:
i. are inappropriate for a person of that child’s age; or
ii. place at risk the child’s well-being, education, physical or mental health or spiritual, moral
or social development; and the Basic Conditions of Employment Act, Chapter six
Section 43 “Prohibition of employment of children”.
Before resorting to the use of child labour, due consideration must be given to the rights of the
child in terms of the constitution. Where work is being performed which is not prohibited in
terms of the constitution, then such work must be conducted in terms of the OHS Act
“Regulations on Hazardous Work by Children in South Africa” with emphasis on paragraph 2
Purpose and Interpretation. NTCSA does not condone the use of child labour and therefore
all effort must be exercised, and child labour should not be used.
2.2.3 OHS Act
The principal contractor and appointed contractors shall have an up-to-date copy of the OHS
Act and regulations which will be available to all employees.

2.2.4 Legislative Compliance
All contractors will comply with all the legislation pertaining to this contract being:

2.3 NTCSA requirements
All contractors shall, before commencement of the work ensure that all their employees are
familiar with the relevant NTCSA OHS documentation that is applicable to their services.
2.3.1 Appointment of a Contractor
The principal contractor will be appointed by NTCSA on the awarding of the contract and will
be responsible and accountable for all legislative and NTCSA requirements for the duration of
the contract.
2.3.2 Appointment of sub-contractors
The principal contractor may appoint contractors to assist in the contract. All appointments
shall be done in writing and will form part of the OHS plan that is required to be submitted to
NTCSA. Adequate training and instruction must be given to the appointees and the principal
contractor must ensure that all the appointed contractors understand their roles and
responsibilities.
Note: Copies of contractor appointments must be kept in the respective OHS file.
2.3.3 OHS Policy
A OHS policy is a statement of intent and a commitment by the organisation’s CE and senior
management in relation to the relevant OHS roles and responsibilities, the achievement of
their strategic objectives, values of integrity, customer satisfaction, excellence, and innovation.
The principal contractor and all appointed contractors, if already not in place, will be required
to compile an organisational OHS policy in line with their OHS responsibilities. The policy must
be signed by the organisation’s CE or the appointed assistant to the CE OHS Act Section
16(2). The policy must be displayed in a prominent place within the workplace. A copy of the
policy must be filed in all the contract OHS files and as an annexure the OHS Plan.
2.3.4 Coid
The principal contractor and all his/her appointed contractors shall be registered with an
appropriate employment compensation commissioner and have available a valid letter of good
standing (LoGS) from such commissioner. The obligation lies with the contractors to ensure
that the LoGS remains valid throughout the contract period. A copy of the LoGS must be filed
in the entire contract OHS files and as an annexure the OHS Plans.

2.4 Occupational health, hygiene and rehabilitation,

Fire Fighter and Evacuation warden, First Aider, 16(2) appointment.

2.7 Risk assessments
It is a legal requirement in terms of Section 8 (2)(d) of the OHS Act for an employer to carry
out risk assessments to establish what hazards to the health and safety or persons are
attached to any work which is performed, any article or substance which is, handled, stored,
transported. A risk assessment is defined as an identification of the hazards present in an
organisation and an estimate of the extent of the risks involved, considering whatever
precautions are already being taken. It is essentially a three-stage process:
Risk assessments are required to be maintained. This means that significant changes to a
process or activity, or any new process or activity should be subjected to a risk assessment
and that if new hazards come to light during the work process, then these should also be
subjected to risk assessments. Risk assessments for long term processes should be
periodically reviewed and updated. Method statements or written safe work procedures are
an effective method as information and record of the way jobs / tasks must be performed. Prior
to start of work, risk assessments on every job / task are ideal to allow managers and
employees to assess any inherent risks that could have been overlooked during the initial risk
assessment or any changes that might have occurred in a period of absence. In particular, if
a job / task is extended over a day or halted due to inclement weather.

2.8 Incident investigation
All incidents shall be investigated in terms of OHS Act General Administrative Regulations 8
and 9, using Eskom Procedure 32-95 as a reference, and where injuries as contemplated in
sections 24 and 25 have been sustained, be reported to the Department of Labour.

2.2 Legal compliance
2.2.1 Section 37(2) (Legal) Agreement
A section 37(2) agreement must be signed between NTCSA and the principal contractor at
the time of awarding the contract. The principal contractor must ensure that a section 37(2)
agreement is compiled between the principal contractor and all their appointed contractors for
the contract.
The original copy of the section 37(2) agreement must be retained by the contractor and a
copy retained by the responsible manager.
A copy all the agreements must form part of the respective contractor’s OHS file.
2.2.2 Hazardous Work by Children (Child Labour)
The constitution of the Republic of South Africa, in the “Bill of Rights” is clear on the rights of
children, especially when it comes to:
i. are inappropriate for a person of that child’s age; or
ii. place at risk the child’s well-being, education, physical or mental health or spiritual, moral
or social development; and the Basic Conditions of Employment Act, Chapter six
Section 43 “Prohibition of employment of children”.
Before resorting to the use of child labour, due consideration must be given to the rights of the
child in terms of the constitution. Where work is being performed which is not prohibited in
terms of the constitution, then such work must be conducted in terms of the OHS Act
“Regulations on Hazardous Work by Children in South Africa” with emphasis on paragraph 2
Purpose and Interpretation. NTCSA does not condone the use of child labour and therefore
all effort must be exercised, and child labour should not be used.
2.2.3 OHS Act

Act and regulations which will be available to all employees.

2.2.4 Legislative Compliance
All contractors will comply with all the legislation pertaining to this contract being:

2.3 NTCSA requirements
All contractors shall, before commencement of the work ensure that all their employees are
familiar with the relevant NTCSA OHS documentation that is applicable to their services.
2.3.1 Appointment of a Contractor
The principal contractor will be appointed by NTCSA on the awarding of the contract and will
be responsible and accountable for all legislative and NTCSA requirements for the duration of
the contract.
2.3.2 Appointment of sub-contractors
The principal contractor may appoint contractors to assist in the contract. All appointments
shall be done in writing and will form part of the OHS plan that is required to be submitted to
NTCSA. Adequate training and instruction must be given to the appointees and the principal
contractor must ensure that all the appointed contractors understand their roles and
responsibilities.
Note: Copies of contractor appointments must be kept in the respective OHS file.
2.3.3 OHS Policy
A OHS policy is a statement of intent and a commitment by the organisation’s CE and senior
management in relation to the relevant OHS roles and responsibilities, the achievement of
their strategic objectives, values of integrity, customer satisfaction, excellence, and innovation.
The principal contractor and all appointed contractors, if already not in place, will be required
to compile an organisational OHS policy in line with their OHS responsibilities. The policy must
be signed by the organisation’s CE or the appointed assistant to the CE OHS Act Section
16(2). The policy must be displayed in a prominent place within the workplace. A copy of the
policy must be filed in all the contract OHS files and as an annexure the OHS Plan.
2.3.4 Coid
The principal contractor and all his/her appointed contractors shall be registered with an
appropriate employment compensation commissioner and have available a valid letter of good
standing (LoGS) from such commissioner. The obligation lies with the contractors to ensure
that the LoGS remains valid throughout the contract period. A copy of the LoGS must be filed
in the entire contract OHS files and as an annexure the OHS Plans.

2.7 Risk assessments
It is a legal requirement in terms of Section 8 (2)(d) of the OHS Act for an employer to carry
out risk assessments to establish what hazards to the health and safety or persons are
attached to any work which is performed, any article or substance which is, handled, stored,
transported. A risk assessment is defined as an identification of the hazards present in an
organisation and an estimate of the extent of the risks involved, considering whatever
precautions are already being taken. It is essentially a three-stage process:
Risk assessments are required to be maintained. This means that significant changes to a
process or activity, or any new process or activity should be subjected to a risk assessment
and that if new hazards come to light during the work process, then these should also be
subjected to risk assessments. Risk assessments for long term processes should be
periodically reviewed and updated. Method statements or written safe work procedures are
an effective method as information and record of the way jobs / tasks must be performed. Prior
to start of work, risk assessments on every job / task are ideal to allow managers and
employees to assess any inherent risks that could have been overlooked during the initial risk
assessment or any changes that might have occurred in a period of absence. In particular, if
a job / task is extended over a day or halted due to inclement weather.

2.8 Incident investigation
All incidents shall be investigated in terms of OHS Act General Administrative Regulations 8
and 9, using Eskom Procedure 32-95 as a reference, and where injuries as contemplated in
sections 24 and 25 have been sustained, be reported to the Department of Labour.
