Submission channel: bids must be submitted online through the National Treasury eTender Portal (https://www.etenders.gov.za/login/Login) using the correct CSD number. Faxed bids are not accepted.

Returnable forms: all must be completed, signed and submitted with the bid:

• SBD 1 (Invitation to Bid): bidder and contact details, signed as the offer cover page.
• SBD 4 (Declaration of Interest): discloses whether any director or shareholder is employed by the state or connected to anyone at the procuring institution. False declarations disqualify the bid.
• Personal Information Processing Form: consents to the department processing the bidder's personal information under POPIA.
• Proof of authority to sign (e.g. company resolution).
• Annexure C (Mandatory Administrative Compliance Form): names, qualifications, registrations and accreditation of proposed team members.

Disqualification risks:

• Any returnable form left unsigned or omitted.
• Bids submitted on re-typed forms rather than the official GPG forms.
• Bids received after the closing time, regardless of reason.
• Bidders listed on the Register for Tender Defaulters or the List of Restricted Suppliers are automatically disqualified.

Bids must remain valid for 120 days after closing.

Mandatory documents for Stage 1A Administrative Compliance:

• SBD 1 (Invitation to Bid) completed and signed.
• SBD 4 (Declaration of Interest) completed and signed.
• Annexure C (Mandatory Administrative Compliance Form) completed and attached.

Certification of copies must comply with the Justices of the Peace and Commissioners of Oaths Act. Copies of certified true copies will not be accepted.

Evaluation is in two stages:

Stage 1A – Administrative Compliance: bidders must submit all compulsory documents, including the required team of four (4) Audit Managers and eight (8) Auditors. Failure to meet any administrative requirement eliminates the bid from further evaluation.

Stage 1B – Functionality (Technical) Evaluation: scored out of 100 points. Bidders must achieve a minimum threshold of 70 points to proceed. Criteria include:

• Audit Managers' years of experience in public sector SCM audit, internal audit, governance and risk management audit.
• Auditors' years of experience in the same fields.
• Reference letters for projects undertaken in the past 10 years, with contactable references.

Points are then awarded in accordance with the Preferential Procurement Policy Framework Act (PPPFA).

Bidders must also complete a Job Creation Analysis form, which may be audited during the contract.

Scope: the panel will provide probity audit services to Gauteng Provincial Government departments and entities for procurement of infrastructure, goods and services. The panel runs for 36 months.

Purpose: probity auditors must quality assure the open tender process from specification to evaluation, and observe adjudication in public. They must report any act or omission affecting the integrity of the process and have full and free access to all aspects of the process.

Deliverables:

• Specification stage: review bid specification committee structure and governance, review specifications/terms of reference for compliance and bias, review evaluation criteria and methods, review the advert and tender documents before publication, and attend briefing sessions.
• Evaluation stage: attend and observe bid closure/opening, physically observe bid file collection and return daily, confirm bid evaluation committee composition, confirm the BEC applied the advertised terms of reference without adding criteria, confirm bidders were correctly eliminated or advanced, verify scores, attend site visits where applicable, and observe adjudication in public.

Reports:

• Probity Audit Specification Report: within 5 working days after approval of the terms of reference by the BSC chairperson.
• Probity Audit Evaluation Report: within 5 working days after completion of the bid evaluation process, subject to receipt of all supporting documents; must be accompanied by an audit file.
• Final Probity Audit Report: within 5 days after review and verification of the BSC/BEC final sign-off, and within 5 days after observing adjudication in public.
• Project Close Out report is prepared by the institution's SCM.

Compliance areas to be addressed: regulatory compliance, administrative compliance, compliance with procurement processes, internal controls, and governance arrangements.

Evaluation methodology: bids are evaluated in two stages. Stage 1A is administrative compliance; Stage 1B is functionality (desktop evaluation) with a minimum threshold of 70 points. Bidders failing Stage 1 are automatically eliminated. Points are awarded under the PPPFA.

Team composition: four (4) Audit Managers and eight (8) Auditors.

Audit Managers:

• NQF Level 8 or Level 7 in Accounting/Auditing.
• Proof of registration with a recognised professional body.
• Proof of accreditation: SAICA CA(SA), ACCA, IIA(SA) and CIA certification.
• Minimum 3 years' experience in managerial services, public sector SCM audit, internal audit, governance and risk management audit.

Auditors:

• NQF Level 8 or Level 7 in Accounting/Auditing.
• Proof of registration with a recognised professional body.
• Minimum 3 years' working experience in public sector SCM audit, internal audit, governance and risk management audit.

All qualifications must be SAQA accredited; foreign qualifications require SAQA accreditation confirmation.

Submission requirements:

• Detailed CVs for each proposed resource, stating role and years of experience.
• Copies of qualifications.
• Valid membership confirmation letters or certificates of good standing from professional bodies, valid on the closing date.
• Professional membership and accreditation must remain valid for the entire 3-year contract.
• Replacement personnel must meet the same requirements.

Functionality scoring (Stage 1B) includes:

• Managerial experience (15 points): 5+ years managing probity/audit/assurance engagements for government institutions (15); 3-5 years (10); less than 3 years (0).
• Public sector SCM audit experience (15 points): 10+ years (15); 5-10 years (10); 3-5 years (5); less than 3 years (0).
• Internal audit, governance and risk management audit experience (15 points): 10+ years (15); 5-10 years (10); 3-5 years (5); less than 3 years (0).
• Public sector SCM audit experience (20 points): 10+ years (20); 5-10 years (15); 3-5 years (10); less than 3 years (0).
• Internal audit, governance and risk management audit experience (20 points): 10+ years (20); 5-10 years (15); 3-5 years (10); less than 3 years (0).

Team experience scores are averaged across the number of team members.

The probity audit process must provide quality assurance of the process implemented from specification to final evaluation report, covering regulatory compliance, administrative compliance, compliance with procurement processes, internal controls, and governance arrangements.

All proposed personnel must be adequately skilled and experienced in auditing supply chain management, internal audit, governance and risk management.

Reports must be produced within the specified timeframes and must detail how the process was implemented, audit findings and recommendations.

The standard SBD 3.1/3.2/3.3 pricing schedule forms are not applicable to this panel tender.

Fees are payable in South African rands on presentation of the probity report confirming successful completion of each phase or milestone. Fees are limited to the Auditor General of South Africa's consultancy rates published annually.

Work is allocated via Request for Quotation (RFQ) with project-based costing.

Payment: the successful bidder must register for GPT Electronic Invoice Submission and Tracking on award. Payment to suppliers is regulated within 30 days of invoice receipt under PFMA section 38(1)(f) and Treasury Regulation 8.2.3.

Mandatory registrations:

• South African company registered with the Companies and Intellectual Property Commission (CIPC).
• Registered on the Central Supplier Database (CSD).
• Tax compliance: provide a SARS Tax Compliance Status (TCS) PIN or CSD number. In consortia, joint ventures or subcontracting, each party must submit a separate TCS PIN/CSD number.

B-BBEE: preference points will be claimed under the PPPFA. Bidders must submit the relevant B-BBEE affidavit or certificate (SBD 6.1).

Returnable compliance forms:

• SBD 4 (Declaration of Interest): discloses state employment or connections.
• SBD 9 (Certificate of Independent Bid Determination): certifies no collusion or price disclosure.
• CSD compliance report.
• CIPC certificate.
• SARS tax status information.

Other requirements:

• Bidders must not be persons in the service of the state, nor have directors or members who are.
• Bidders must not be listed on the Register for Tender Defaulters or the List of Restricted Suppliers.
• All proposed personnel must have SAQA-accredited qualifications; foreign qualifications require SAQA accreditation confirmation.
• Professional membership and accreditation for all key resources must remain valid for the entire 3-year contract duration.

The Gauteng Provincial Government supports the Proudly South African Campaign and prefers to procure local products of high quality, produced through sound labour relations and in an environment where high environmental standards are maintained.

General conditions of contract are attached in Section 1 and cannot be amended.

Special conditions:

• Resources: additional personnel must meet the same qualifications, professional accreditation and experience requirements as outlined in the terms of reference and must be approved by the institutions. Requirements for additional resources are embedded in the Service Level Agreement (SLA).
• Trainees: bidders are encouraged to include qualified trainees, but they must be supervised throughout by experienced staff meeting the requirements.
• Unqualified staff: allocating unqualified staff may be considered a material breach and could lead to cancellation of the contract.
• Immigration Act: bidders must comply with the Immigration Act when employing resources.
• Confidentiality and data protection: all information obtained during the audit is confidential and may not be disclosed without written consent. Compliance with POPIA is required.
• Transfer of skills: the service provider must conduct a skills transfer workshop once a year throughout the 3-year contract period for supply chain practitioners, bid committee members and the Head of Procurement.
• Conflict of interest: bidders must disclose all potential threats to independence and provide written assurance of no conflict of interest. If a conflict arises, the service provider will be removed from that project and the institution may appoint another audit firm.
• Payment: successful bidders must register for GPT Electronic Invoice Submission and Tracking on award.

All services shall be rendered by South African companies registered with CIPC and on the CSD.
