• Scope: Investigate alleged conflict of interest and possible irregular expenditure condonement regarding relocation accommodation (January 2024 to November 2024).
• Objectives:
• Appoint service provider to investigate conflict of interest allegations.
• Conduct independent and impartial investigation.
• Determine if actual, perceived, or potential conflict of interest existed and its influence on decision-making.
• Establish facts through collection, analysis, and verification of evidence.
• Provide recommendations for corrective action, disciplinary measures, recovery of losses, and internal control improvements.
• Specific investigation tasks:
• Review all relevant documents/records.
• Establish if any MBTC staff connected to service providers used for relocation accommodation.
• Determine nature of conflict and whether declared.
• Investigate collusion between MBTC employees, travel agent, and accommodation providers.
• Quantify misuse of funds or losses.
• Identify internal control weaknesses.
• Assess compliance with procurement laws and policies.
• Identify unauthorized, irregular, wasteful, and fruitless expenditure.
• Perform determination test on irregular expenditure condonement per National Treasury instruction note.
• Disclose irregular expenditure per PFMA and GRAP.
• Review evidence of approval for accommodation extension.
• Investigate special telephonic request for specific unit.
• Provide recommendations to Council.
• Deliverables:
• Engagement plan and budget.
• Project plan with timelines and milestones.
• Investigation using lawful methods (including polygraph tests).
• Progress reports to Audit Committee Chairperson.
