Evaluation stages

• Stage one: mandatory compliance — CSD registration, tax compliance, and completed and signed returnable forms.
• Stage two: functionality, scored out of 100. Minimum qualifying score: 70/100. Bids scoring below 70 are not evaluated further.
• Stage three: price and specific goals, using the 80/20 preference point system under the PPPFA Regulations, 2022.

Functionality criteria (100 points)

• Company profile and experience: 30 points, scored at 6 points per reference letter with a maximum of five letters. Minimum ten years relevant OHS experience, supported by letters from credible, traceable clients.
• Project leader / lead CHSA: 25 points. Requires an Honours degree or NQF Level 8 equivalent in OHS, environmental health and safety or a related field, SACPCMP registration as a Construction Health and Safety Agent, and at least ten years relevant experience.
• Two key personnel: 30 points, 15 points each. Must be SACPCMP-registered CHSAs, CHSMs or CHSOs.
• Methodology and approach: 15 points — understanding of scope (2.5), CHSA approach (5), regulatory compliance management (5), and contractor monitoring, project support, mobilisation and reporting (2.5).

Preference points (20 points, 80/20 system)

• Price: 80 points, calculated as Ps = 80(1 − (Pt − Pmin)/Pmin).
• Specific goals: 20 points — black people ownership 6, women equity 3, youth equity 3, disability 2, promotion of small businesses 3, enterprises located within Limpopo 3.
• Verification: CSD and company registration certificate for ownership, women and youth equity; medical certificate or equivalent for disability; staff complement and annual turnover for small business promotion; proof of address for Limpopo location.
• Preference points are not claimed where the supporting proof is not submitted with the bid.
• MMSEZ may verify qualifications, registrations, project experience and reference letters, and may require substantiation of preference claims at any time.

Purpose

• MMSEZ intends to establish a panel of occupational health and safety (OHS) professional service providers for use on an as-and-when-required basis over 36 months.
• No minimum volume of work is guaranteed to any appointed panel member.
• Services cover MMSEZ infrastructure, industrial, logistics, utilities, energy, water, sanitation, roads, housing and associated development projects.

Scope of services

• OHS regulatory compliance, permits and authorisations: construction work permit applications, notifications of construction work, Department of Employment and Labour submissions and liaison, legal compliance assessments, legal registers, compliance monitoring against statutory and permit conditions, due diligence assessments, compliance audits and reporting, regulatory inspection support, statutory reports, and verification of contractor legal compliance and mandatory legal appointments.
• Construction Health and Safety Agent (CHSA) services through SACPCMP-registered agents across all project phases: initiation and feasibility, planning and concept development, design and engineering, procurement and tender evaluation, pre-construction, construction, commissioning and handover, operational readiness, maintenance and modification, and close-out.
• CHSA deliverables include construction health and safety specifications, design and constructability risk reviews, OHS review of tender documentation, evaluation of contractor OHS competency, review and acceptance of contractor health and safety plans, review of baseline and issue-based risk assessments, method statements and safe work procedures, site inspections and audits, monitoring of controls, participation in project and risk meetings, incident investigation, corrective action monitoring, commissioning and operational readiness verification, and close-out compliance reports.
• Construction risk management: baseline, design, construction, issue-based, task-based and emergency risk assessments, hazard identification studies, critical risk identification, risk register development and maintenance, construction methodology risk reviews, risk monitoring and reporting, review of contractor risk processes, and mitigation action plans.
• Monitoring, auditing and assurance: OHS compliance audits, site inspections, contractor compliance audits, project compliance monitoring, independent compliance assessments, health and safety performance assessments, corrective action tracking, monthly compliance monitoring reports, assurance reviews and contractor performance monitoring.
• Incident investigation: incident and property damage investigations, root cause analysis, investigation reporting, corrective action and lessons learnt reviews, regulatory reporting support, and verification of corrective and preventative actions.
• OHS management systems and compliance support: development and review of OHS management systems and construction SHE management plans, legal and compliance registers, review of contractor SHE systems, governance support, compliance monitoring programmes, procedures and standards, internal audits, management reviews, project-specific health and safety requirements and continuous improvement programmes.
• Specialist advisory: construction safety advisory, independent OHS reviews, due diligence assessments, project OHS advisory, regulatory liaison, expert technical reviews, safety governance and culture assessments, independent assurance, contractor management support, specialist health and safety studies, and support during regulatory inspections and investigations.

Reporting and review

• The panel reports to the Manager: Safety, Health and Environment at MMSEZ, with administrative coordination through the Infrastructure Development Division or another designated representative.
• Typical deliverables: CHSA reports, compliance monitoring reports, site inspection reports, audit reports, incident investigation reports, risk assessment reports, construction work permit applications, notifications of construction work, regulatory submissions, and monthly and close-out reports.
• All deliverables are subject to review and approval by MMSEZ and, where applicable, regulatory authorities; the panel must address comments, revisions and corrective actions to MMSEZ's satisfaction.

Duration

• 36 months, as-and-when-required.

Technical proposal

• Must detail the methodology and approach, resource allocation, mobilisation strategy, quality assurance measures and capacity to deliver on an as-and-when-required basis.
• Must include a comprehensive methodology and implementation plan.
• Must include an organogram showing available resources and reporting structures.
• Must include CVs of the proposed project leader and key personnel, with certified copies of their qualifications.
• Methodology is scored out of 15 points: understanding of scope (2.5), CHSA approach (5), regulatory compliance management (5), and contractor monitoring, project support, mobilisation and reporting (2.5).

Bidder experience

• Minimum ten years relevant experience in OHS professional services, CHSA services, construction work permit application, Construction Regulations compliance, compliance monitoring and OHS construction management.
• Experience must be on infrastructure, industrial, logistics, energy, municipal, mining or similar development projects, evidenced by reference letters from credible, traceable clients on client letterhead, signed and with contact details.
• The company profile must show projects undertaken and years of experience; scored at 6 points per reference letter, maximum five letters (30 points).

Project leader / lead CHSA (25 points)

• Honours degree or NQF Level 8 equivalent in occupational health and safety, environmental health and safety or a related field.
• SACPCMP registration as a Construction Health and Safety Agent.
• Minimum ten years relevant experience in construction health and safety management, compliance monitoring and construction project oversight.

Key personnel (30 points)

• Two key personnel members, 15 points each, must be SACPCMP-registered CHSAs, CHSMs or CHSOs.
• CVs, certified qualifications and valid SACPCMP registration certificates must be attached.

Minimum qualifications

• Relevant tertiary qualifications in OHS, construction management, risk and safety management or related disciplines.
• Demonstrated knowledge of the OHS Act, Construction Regulations and other applicable legislation.
• Experience in contractor management, construction monitoring, compliance auditing and project support.

Quality assurance

• The panel must provide OHS compliance audits, construction site inspections, contractor compliance audits, project compliance monitoring, independent compliance assessments, health and safety performance assessments, compliance verification reviews, corrective action tracking and verification, monthly compliance monitoring reports, assurance reviews and contractor performance monitoring.
• Deliverables, reports, assessments, audits, inspections and investigations are subject to review and approval by MMSEZ and, where applicable, regulatory authorities.
• The panel must address comments, revisions and corrective actions identified during review to MMSEZ's satisfaction.
• The technical proposal must set out quality assurance measures and the ability to deliver on an as-and-when-required basis.

Pricing schedule (SBD 3.3 — Professional Services)

• Bidders must state a ceiling price for the total estimated time to complete all phases, inclusive of all applicable taxes.
• Hourly and daily rates must be given for each person and position involved; certified invoices are rendered on this basis.
• Costs and man-days must be broken down per project phase.
• Travel expenses are recoverable at actual cost only, with proof attached to certified invoices; rate, quantity and amount must be specified.
• Other expenses (for example accommodation, telephone, reproduction) must be itemised by rate, quantity and amount, with proof attached to invoices.
• Bidders must state the period required to commence after bid acceptance and the estimated man-days for completion.
• Bidders must indicate whether rates are firm for the full contract period; if not, the adjustment basis (for example CPI) must be provided.
• Bidders must state the number of days the offer remains valid from the closing date.
• 'All applicable taxes' includes VAT, PAYE, income tax, UIF contributions and skills development levies.

Registration and tax

• Bidders must be registered on the Central Supplier Database (CSD) before submitting; a CSD number is required where no Tax Compliance Status is available.

• Consortia, joint ventures and subcontractors must each submit a separate TCS certificate, PIN or CSD number.
• Bidders, their directors or members must not be persons in the service of the state.

Professional registration

• SACPCMP registration is mandatory: Construction Health and Safety Agent (CHSA) for the project leader, and CHSA, CHSM or CHSO for key personnel.
• Failure to submit a valid SACPCMP professional registration results in automatic disqualification.
• Proof of paid-up membership of a relevant recognised South African professional body must be attached.

B-BBEE and preference points

• B-BBEE preference points are claimed on SBD 6.1 under the 80/20 system; a B-BBEE status level verification certificate or a sworn affidavit (for EMEs and QSEs) must be submitted to qualify for preference points.

OHS scope

• Services must comply with the Occupational Health and Safety Act, 1993, the Construction Regulations, 2014, and other applicable health and safety legislation, standards, permits and approvals.
• The panel supports MMSEZ in its client duties, including Regulation 5 (clients), Regulation 6 (designers) and Regulation 8 (construction health and safety agents).
• Other applicable frameworks include COIDA, the General Safety Regulations, Driven Machinery Regulations, Electrical Installation Regulations, Major Hazard Installation Regulations, Environmental Regulations for Workplaces, General Administrative Regulations, applicable SANS standards and ISO 45001.
• Services include construction work permit applications, notifications of construction work, legal compliance assessments and registers, due diligence assessments, compliance audits, regulatory inspection support, statutory reporting, and verification of contractor legal compliance and mandatory legal appointments.
• CHSA services are delivered by SACPCMP-registered agents across all project phases, from initiation and feasibility through construction, commissioning, operational readiness and close-out.
• Risk management covers baseline, design, construction, issue-based, task-based and emergency risk assessments, hazard identification studies, critical risk identification, risk registers and mitigation action plans.
• Incident investigation covers incident and property damage investigations, root cause analysis, reporting, corrective action and lessons learnt reviews, and verification of corrective and preventative actions.

Contract framework

• The General Conditions of Contract (July 2010) form part of the bid documents and may not be amended; Special Conditions of Contract, where applicable, supplement them and prevail on conflict.
• The successful bidder must complete and sign the written contract form (SBD 7) and a Service Level Agreement.
• Appointment is for 36 months on an as-and-when-required basis; no minimum volume of work is guaranteed.
• Where subcontracting or a joint venture is used, MMSEZ contracts with the principal bidder only.
• The GCC governs payment, prices, contract amendments, assignment, subcontracts, delays, penalties, termination for default or insolvency, force majeure, dispute settlement, limitation of liability, notices, taxes and duties, and prohibition of restrictive practices.
• MMSEZ may cancel or withdraw the bid where circumstances change, funds are unavailable, no acceptable bids are received, or a material irregularity arises in the process.

MMSEZ rights

• MMSEZ may appoint the bidder that proves fully capable and qualified to execute the work.
• MMSEZ may cancel or withdraw the bid where circumstances change, funds are unavailable, no acceptable bids are received, or a material irregularity arises.
• MMSEZ may call short-listed bidders to interviews before final selection.
• MMSEZ may conduct supplier due diligence before award or at any time during the contract, including surprise site visits.

Bidder obligations

• Bids must align with the detailed specification; failure to do so automatically disqualifies the bid.
• Bidders not registered on the CSD must register before submitting.
• Completion in pencil or erasable ink automatically disqualifies the bid.
• The successful bidder must sign a Service Level Agreement.
• The specification is a minimum; bidders must provide a complete, efficient and cost-effective solution.
