TRIM will consider all timely submissions received before making a decision.

• The invitation to comment does not create any obligation on TRIM to approve or reject the proposal in a particular manner, nor does it predetermine the outcome of the lease-extension decision.
• A final decision remains subject to TRIM's independent assessment, value-for-money considerations, and approval in accordance with delegated authority and section 51 of the PFMA.
• The invitation does not create any obligation on TRIM to conduct business with any party that submits comments, objections, or alternate proposals.

The proposal under consideration relates to:

• Repair of the damaged portion of the TRIM network on the Hammarsdale Branch line leading to the Hammarsdale siding.
• Provision of an option to renew the term of an existing siding lease contract by a further 10 years.
• Continuation of services under substantially similar operational arrangements to those currently in place.
• TRIM has not yet taken a decision on whether to approve or reject the proposal.

If an interested party chooses to submit an alternate proposal, they are required to submit an adequately detailed value proposition outlining their business case, including:

• Approach to partnering with the current leasee to establish investment and tenure required.
• Estimated capital spend.
• Period to complete repair works.
• The utilisation, enhancement, sustainability, protection and long-term development of the Hammarsdale Rail Terminal and associated rail infrastructure.
• Any additional information that may support TRIM's assessment of the value proposition.

No specific eligibility criteria (such as CSD registration, tax clearance, B-BBEE level, or CIDB grading) are stated in this notice.

• The invitation is open to interested and affected parties, including potential rail operators, service providers, and the public.
• Submissions must be timely and in writing; late submissions will not be considered.

The proposal is underpinned by a commercial proposition that includes commitments on infrastructure repairs in lieu of an option to renew an existing 5-year lease agreement by an additional 10 years.

• This notice-and-comment invitation is a market-testing exercise only and is non-binding.
