Bidders must complete the Schedule of Plant and Equipment, Schedule of Subcontractors, and Schedules of Work Experience (current and completed contracts) as part of the tender.

If inspections/tests show non-compliance, the cost is borne by the supplier and the goods/services may be rejected.

Rejected goods must be removed and replaced at the supplier's cost.

Pricing must be quoted in South African currency and inclusive of VAT.

No contract will be concluded with a bidder whose tax matters are not in order, or whose municipal rates and services charges are in arrears.

If a bidder is indebted to the municipality, an agreement may be required for deductions from payments until the debt is settled.

Bidders must declare all municipal account numbers in the Stellenbosch area for which they or their directors are responsible.

CSD registration: mandatory for all bidders.

Tax compliance: bidders must submit a SARS TCS PIN or CSD number; no award will be made to non-compliant bidders.

B-BBEE: a B-BBEE status level verification certificate (SANAS-accredited) or sworn affidavit (for EMEs and QSEs) must be submitted to qualify for preference points. A sworn affidavit must be an original.

Warranty: goods/services must be free from defects; warranty valid for 12 months after delivery/acceptance or 18 months after shipment, whichever is earlier.

Payment: within 30 days of invoice submission; in Rand.

Prices: must not vary from the bid price unless authorised.

Variation orders: changes up to 15% of the original contract value may be instructed.

Assignment: not permitted without prior written consent.

Subcontracts: all subcontracts must be notified in writing.

Delays: penalties may be imposed at the prime interest rate per day of delay.

Termination for default: the municipality may terminate for failure to perform or for corrupt/fraudulent practices, and may restrict the supplier from doing business with the public sector for up to 10 years.
