The south african national biodiversity institute (sanbi) seeks to appoint a managed service provider to manage its existing azure services for a three-year period. The most consequential requirement is full acceptance of sanbi's special conditions of contract, which include the right to negotiate with preferred bidders, the ability to accept part of a tender, and strict provisions against collusion, corruption and misrepresentation — a material misrepresentation in the tender can lead to termination of any resulting contract.
Bidders must accept that SANBI may award the tender to a bidder that did not score the highest total number of points, in line with section 2(1)(f) of the PPPFA.
Bidders must accept that SANBI may negotiate with preferred bidders without offering the same opportunity to others, and may accept part of a tender rather than the whole.
Bidders must permit SANBI to carry out site inspections, product evaluations or explanatory meetings to verify the nature and quality of the services offered.
Bidders must accept that SANBI may correct mistakes in the tender process, and may cancel or terminate the process at any stage, including after the closing date, presentations, evaluations or identification of a preferred bidder.
Bidders must declare that neither they nor any director, shareholder or senior management engage in collusive tendering, corruption, gift-giving to state officials, or other unlawful inducements; SANBI may disqualify any bidder found in breach.
Bidders must certify that no misrepresentations are made in the tender, as the tender terms will be incorporated into the contract and misrepresentations may lead to service termination.
Bidders must comment on the draft Service Level Indicators and/or Milestones using track changes or a clearly marked colour, explaining each comment or amendment.
All costs of preparing, submitting and presenting the tender are borne by the bidder; SANBI is not liable for these costs.
The successful bidder must ensure that any information acquired from SANBI is not used or disclosed without written consent.
