Bids must be submitted in a sealed envelope clearly marked with the bid number, full project description, and closing date, placed in the tender box at Mbombela Civic Centre, 1 Nel Street, Mbombela, 1200, before 11:00 on the closing date. Bids received by telegram, fax, or e-mail will not be considered. Late bids will not be accepted. The bid document must be completed in non-erasable black ink, fully priced, extended, totalled, and signed by an authorised signatory. Proof of posting is not accepted as proof of delivery. Tenders will be opened in public immediately after the closing date and time. The MBD 1 form is the Form of Offer and must be fully completed and signed; failure to do so renders the bid non-responsive. Bidders must not alter any part of the bid document except where permitted in writing. Corrections must be initialled and dated. Use of correction fluid, pencil, or erasable ink is prohibited. Where the bidder is a juristic person and the signatory is not the sole director, member, or proprietor, proof of authority (e.g., directors' resolution, power of attorney) must be submitted. The following compulsory documents must be attached: valid Tax Compliance Status (TCS) PIN, proof of company registration, certified copies of directors' identity documents, full CSD registration report not older than 30 days from closing date (summary reports not accepted), current municipal rates and taxes statements for the business and all active directors (or tribal authority proof of residence, or lease agreements with lessor's rates statements), certified copy of B-BBEE certificate or sworn affidavit (for EMEs/QSEs), and company registration certificate. Certified copies of the Business Director(s)’ identity documents. A full Central Supplier Database (CSD) registration report not older than 30 days from the closing date. Summary reports will not be accepted. The bidder must submit a valid and current municipal rates and taxes statement for the business premises issued by the relevant local authority. Where the business operates in an area under the jurisdiction of a recognised traditional authority, the bidder may submit proof of residence issued by the relevant tribal authority. Where the business premises are leased, the bidder must submit a valid lease agreement together with the lessor's current municipal rates and taxes statement for the leased premises. The physical business address reflected on the Central Supplier Database (CSD) must correspond with the address reflected on the company's registration documents. The Municipality reserves the right to verify the municipal rates and taxes information against the details reflected on the CSD and the company's registration documents. It remains the responsibility of the bidder to ensure that the company's municipal rates and taxes account is fully paid and not in arrears. The bidder must submit valid and current municipal rates and taxes statements for each active director, including directors of consortium or joint venture partners, for the residential addresses reflected on the company's CIPC registration documents. Where a director resides in an area under the jurisdiction of a recognised traditional authority, proof of residence issued by the relevant tribal authority may be submitted. Where a director occupies leased residential premises, the bidder must submit a valid lease agreement together with the lessor's current municipal rates and taxes statement for the leased property. The residential address reflected on the municipal rates and taxes statement, proof of residence, or lease agreement must correspond with the residential address of the respective director as recorded on the company's CIPC registration documents. The Municipality reserves the right to verify the municipal rates and taxes compliance of each director using the director's identity number and the residential address reflected on the CIPC registration documents. It remains the responsibility of the bidder to ensure that the municipal rates and taxes obligations of all active directors, consortium or joint venture partners, and, where applicable, the lessor, are fully settled and not in arrears. For all key personnel whose CV is submitted, certified copies of qualifications and certified copies of identity documents must be submitted with the bid (if applicable). Certified copies must not be older than three (3) months to be considered valid. Copies of certified copies will not be accepted; only certified copies of original documents shall be recognised. Failure to comply with the above requirements will result in immediate disqualification.

Evaluation uses the 80/20 preference point system: 80 points for price and 20 points for specific goals, in accordance with the Preferential Procurement Regulations, 2022. Bidders must be registered on the Central Supplier Database (CSD) and submit a full CSD report not older than 30 days from closing date. Items: 1 x 6-drop interlocking paving static machine (380V); 1 x 4-drop M140 hollow block static machine (380V); 160 x 50kg bags of 42.5R strength-class cement, compliant with SANS 50197-1 and suitable for concrete block and interlocking paving manufacture, or equivalent; transport cost. Delivery point: Mbombela, White River – Msholozi. Delivery must be completed within 15 days following award of contract.

Bidders must submit a company profile, which is a professional introduction of the business covering purpose, vision, trustworthiness, products and services, and experience. For all key personnel whose CVs are submitted, certified copies of qualifications and identity documents must be provided. Certified copies must not be older than three months. Functionality evaluation may be applied for complex projects, assessing bidders' capabilities including track record, experience on similar projects, human resources and their individual experience, financial capabilities, and relevant technology. Functionality is not compulsory for all projects but may be used for complex ones. Criteria will vary per project.

Pricing must be submitted on the provided pricing schedule (MBD 3.1 – Firm Prices). Only firm prices will be accepted. Prices must be inclusive of VAT, with VAT shown as a separate lump sum. The total bid price must be reflected on MBD 1. All delivery costs must be included in the bid price. The offer must remain valid for 30 days from the closing date. Separate pricing schedules must be submitted for different delivery points if applicable.

Prices must be quoted in South African Rand (ZAR) and are firm and fixed for the duration of the contract. Only firm prices will be accepted; non-firm prices (including those subject to exchange rate variations) will not be considered. All prices must be inclusive of VAT, which must be reflected as a separate lump sum in the tender summary. The total bid price must be reflected on MBD 1. To claim preference points, bidders must submit a certified copy of a valid B-BBEE certificate or a sworn affidavit (for EMEs and QSEs). EMEs may submit a sworn affidavit confirming annual total revenue and level of black ownership. Bidders other than EMEs and QSEs must submit a certified copy of a valid B-BBEE status level verification certificate issued by a registered auditor approved by IRBA or a verification agency accredited by SANAS. Trusts, consortia, or joint ventures may qualify for points as an unincorporated entity if they submit a consolidated B-BBEE scorecard prepared for each separate bid. There is no consolidated affidavit for B-BBEE status level; only consolidated certificates will be considered for JVs/consortia and large companies with annual turnover exceeding R50 million (including VAT). Non-adherence will result in no allocation of B-BBEE points.

Bidders are expected to attach COIDA certificates in line with their specialised area aligned to the type/nature of business, in accordance with the Compensation for Occupational Injuries and Diseases Act 130 of 1993.

The successful bidder must deliver the equipment and material within 15 days following award of contract. Late delivery is strictly prohibited unless prior written approval is granted by the Project Manager under exceptional circumstances. Failure to deliver in accordance with specifications and timelines may constitute breach of contract and may result in penalty charges of 3% of the total contract price per week or part thereof, or termination of the contract. The City may terminate the contract summarily if the bidder fails to perform. The bidder will be liable for any additional costs incurred by the Municipality due to re-advertising or awarding to a less favourable bidder. Neither party may cede, assign, or transfer any rights or obligations without prior written consent of the Council, except to a registered financial institution with approval. The tender remains valid for 30 days from the closing date.

The tender must be completed on the attached tender form, which shall not be detached from this document. The completed submission must be fully priced, extended, and totalled, completed in all respects, and duly signed. It shall be sealed in an envelope and submitted in accordance with the instructions provided in the Invitation to Tender. Proof of posting will not be accepted as proof of delivery. The City reserves the right not to accept the lowest-priced bid or any bid, and may cancel or withdraw the tender at any stage. Any corrections must be initialled and dated. Use of correction fluid, pencil, or erasable ink is prohibited. All bid documents must be fully completed and signed by a person duly authorised to bind the bidder. Where the bidder is a juristic person and the signatory is not the sole director, member, or proprietor, proof of authority must be submitted. Failure to submit proof of authority renders the bid non-responsive. A bid shall be rejected where any municipal rates and taxes or municipal service charges owed by the bidder (including its business entity or directors) are in arrears for more than three months. Failure to submit valid and up-to-date proof of municipal rates and taxes will also render the bid non-responsive. The City reserves the right to verify all information submitted. False, misleading, or fraudulent information may lead to rejection, cancellation of contract, recovery of damages, and legal action. Bids shall be rejected where the bidder or any of its directors, members, trustees, or partners appears on the National Treasury Register for Tender Defaulters or is listed on the National Treasury Database of Restricted Suppliers. Bids may also be rejected where the bidder has committed fraud, corruption, fronting, collusion, or other improper conduct. The MBD 1 form shall be regarded as the Form of Offer and must be fully completed and duly signed. Tenders shall only be considered if the tender document is fully and correctly completed, with all required information inserted in black ink and duly signed. The Municipality may verify rates and taxes information against CSD and registration documents. It is the bidder's responsibility to ensure rates and taxes are fully paid and not in arrears. Director(s) municipal compliance: bidder must submit valid and current municipal rates and taxes statements for each active director, including consortium or JV partners, for residential addresses on CIPC registration documents. Where a director resides under a traditional authority, proof of residence may be submitted. Where a director leases residential premises, lease agreement with lessor's rates statement must be submitted. The residential address on the rates statement, proof of residence, or lease agreement must correspond with the director's address on CIPC documents. The Municipality may verify compliance using the director's ID number and address. It is the bidder's responsibility to ensure all directors' rates and taxes obligations are settled. All prices and rates quoted shall be inclusive of VAT. VAT shall be reflected as a separate lump sum in the tender summary, and the total amount inclusive of VAT shall be carried forward to the Form of Tender. In the event that the successful bidder fails to perform, the City may terminate the contract summarily, and the bidder shall be liable for any additional costs incurred by the Municipality. Should any amendments to the tender documents be deemed necessary, they will be communicated through Notices to Bidders, which shall form an integral part of the tender documents. Where applicable, bidders shall complete, sign, and date the Notices to Bidders and submit them with their tender. The tender shall remain valid for 30 days from the closing date. All prices quoted shall be inclusive of delivery, VAT, and all disbursements and associated costs. All prices must be quoted in ZAR and shall be firm and fixed for the duration of the contract. Neither the Council nor the successful bidder shall cede, assign, transfer, or otherwise dispose of any rights, obligations, benefits, interests, or any part of the contract to a third party without prior written consent of the Council. Any cession or assignment shall only be permitted in favour of a duly registered financial institution and subject to prior written approval.
