MBD 3.3 requires a ceiling price, hourly and daily rates per person, cost per phase, man-days, and travel and other expenses at actual cost with proof.
Evaluation — 80/20 preference point system: 80 points for price, 20 points for specific goals at 5 points each (51% or more Black ownership, 51% or more women ownership, business located within the City of Johannesburg Metropolitan Municipality, and SMME status as EME or QSE). No minimum functionality or qualifying score applies; points not claimed with the required proof at submission are forfeited.
Preference evidence — valid B-BBEE certificate or sworn affidavit, CSD record, ID copy of the owner(s) and shareholder's certificate for ownership claims, and municipal accounts or a ward councillor letter confirming the business address for the Johannesburg location claim.
Returnable documents — signed pricing schedule and MBD 3.3, MBD 4, MBD 6.1, MBD 8 and MBD 9, Declaration on State of Municipal Accounts, CSD report not older than 3 months, and municipal accounts for the bidder and all directors not older than 3 months and not more than 90 days in arrears (or a valid lease agreement or sworn affidavit, with acknowledgement of debt if in arrears). A false declaration on any MBD form leads to automatic disqualification.
Conditions of award and cash flow — compliant tax status on the CSD, directors and principal members not in the service of the state, and the bidder and its directors not listed on the National Treasury's Restricted Suppliers database. No upfront payments are made, so the successful bidder must fund the work from its own cash flow, and no service may be rendered before an official purchase order has been issued and accepted.
