The RFI is undertaken against the backdrop of SARS’ current accommodation footprint and workplace

modernisation objectives. SARS is therefore exploring alternative commercial real estate solutions that may reduce

the current accommodation footprint where appropriate, align with SARS workplace norms and standards, improve

client circulation and service delivery, provide flexibility for future operational requirements, and support

sustainability and operational efficiency.

14.1 Should a respondent have rational reasons to believe that the RFI process is unfair or irregular,

including concerns that the technical specifications are not open, or are written for a particular

respondent, brand or product, the respondent is urged to notify the Procurement Department within

ten (10) days after publication of the RFI and provide details of its complaint for SARS’ consideration.

14.2 Any suspicious activity, including requests, approaches or calls asking for upfront payment to secure

an award, appointment or advantage in any procurement process, or claims that the outcome of an

options or development capability aligned to the locations and requirements set out in this document. Respondents

12.2 Information Submission

15.3 Confidentiality

15.3.1 Except as may be required by operation of law, by a court, or by a regulatory authority having appropriate

jurisdiction, information contained in a respondent’s RFI response or information submission may not be

disclosed by any respondent, other than to a person officially involved with SARS’ review of the RFI response

or information submission.

15.3.2 Throughout this RFI process and thereafter, the respondents must secure SARS’ written approval prior to the

release of any information that pertains to (i) the potential work or activities to which this RFI relates; or (ii) the

process which follows this RFI. Failure to adhere to this requirement may result in disqualification from the RFI

process and such legal action as SARS may deem suitable.

15.4 Preparation costs

15.4.1 The respondent will bear all costs incurred in preparing, submitting and presenting any response or information

submission to this RFI, and all other costs incurred throughout the RFI process. No statement in this RFI will be

construed as placing SARS, its employees or agents under any obligation whatsoever, including in respect of

costs, expenses or losses incurred by the respondent in preparing or submitting its RFI response.

15.5 Precedence

15.5.1 The terms and conditions of this document will prevail over any information provided during any briefing session

or communication, whether oral or written, unless such information is official written communication, as set out

in the Communication section of this document, and expressly states that it amends this document.

15.6 RFI not an offer

15.6.1 This RFI does not constitute an offer to do business with SARS but merely serves to facilitate a requirements-

based decision process.

15.6.2 Nothing in this RFI or any other communication made between SARS (including its officers, directors,

employees, advisers and representatives) is a representation that SARS will offer, award or enter into an

agreement with the Respondent.

15.7 Validity of information

15.7.1 SARS has made reasonable efforts to ensure the accuracy of information in compiling this RFI. However, neither

SARS, nor its employees, officers, advisers or agents will be liable (directly or otherwise) to the Respondent or

any third party for any inaccuracy or omission of any information in the RFI or in respect of any other additional

information SARS may provide to the Respondent as part of the RFI process.

15.7.2 The respondent is deemed to have examined this RFI and any other information supplied by SARS to the

respondent and to have satisfied itself as to the correctness and sufficiency of such information before

submitting its RFI response.

15.7.3 SARS retains ownership of all intellectual property rights in the documents that form part of this RFI. The

respondent will retain the intellectual property rights in its RFI response or information submission, but grants

electronic, photocopying, recording or otherwise, in whole or in part, except for the purpose of preparing an RFI

response or information submission. This RFI and any other documents supplied by SARS remain proprietary

to SARS and must be promptly returned to SARS upon request, together with all copies, electronic versions,

excerpts, summaries or work derived from them.

15.8 Limitation of Liability
