• The successful bidder will be required to fill in and sign a written contract form (SBD7).
• Attach proof of authority to sign the bid (e.g., resolution of directors).
• Failure to comply with any submission particulars may render the bid invalid.

• Bids must be delivered by the stipulated time to the correct address. Late bids will not be accepted.

Bidders must be tax compliant (provide SARS PIN or CSD number). Bidders must submit B-BBEE status level verification certificate or sworn affidavit to qualify for preference points. Foreign suppliers must answer the provided questionnaire regarding tax presence in South Africa. Persons in the service of the state or companies with directors in the service of the state are not eligible. Bidders must not be restricted from doing business with the public sector.

• The service required is the acquisition of office accommodation for Nkangala District and Emalahleni Local Office within the Mpumalanga region.
• The contract period is five (5) years.
• Goods supplied must conform to the standards mentioned in the bidding documents and specifications.
• The supplier must not disclose contract documents or information without the purchaser's prior written consent.
• The purchaser may inspect the supplier's records relating to performance.

• Only firm prices will be accepted. Non-firm prices (including prices subject to rates of exchange variations) will not be considered.
• The bid price must be all-inclusive, covering all applicable taxes (VAT, PAYE, income tax, UIF contributions, skills development levies).
• All delivery costs must be included in the bid price for delivery at the prescribed destination.
• The bid offer must be valid for 90 days from the closing date of the bid.
• In cases where different delivery points influence pricing, a separate pricing schedule must be submitted for each delivery point.

• Bidders must submit a valid B-BBEE Status Level Verification Certificate or Sworn Affidavit (for EMEs & QSEs) to qualify for preference points.
• Tax compliance: Bidders must submit their unique Personal Identification Number (PIN) issued by SARS or a printed Tax Compliance Status (TCS) certificate. Application for TCS PIN may be made via e-filing through the SARS website.
• Where no TCS PIN is available but the bidder is registered on the Central Supplier Database (CSD), a CSD number must be provided.
• For consortia/joint ventures/sub-contractors, each party must submit a separate TCS certificate/PIN/CSD number.
• No bids will be considered from persons in the service of the state, companies with directors in the service of the state, or close corporations with members in the service of the state.
• Foreign suppliers must complete a questionnaire regarding residency, branch, establishment, income, and tax liability in RSA. If answer is 'no' to all, registration for a TCS PIN is not required.
• The bid is subject to the General Conditions of Contract (GCC) and any Special Conditions of Contract.
• The National Industrial Participation Programme (NIPP) may apply.
• Collusive bidding or bid rigging is prohibited under the Competition Act.

• The contract is subject to the General Conditions of Contract (GCC) and any applicable Special Conditions of Contract (SCC). In case of conflict, SCC provisions prevail.
• The successful bidder must furnish a performance security within 30 days of contract award, as specified in SCC. It can be a bank guarantee, irrevocable letter of credit, or cashier's/certified cheque.
• Payment will be made in Rand, promptly but no later than 30 days after submission of an invoice, unless otherwise stipulated in SCC.
• Prices quoted in the bid cannot vary except as authorized in SCC or a bid validity extension.
• No contract amendments are allowed except by written agreement signed by both parties.
• The supplier cannot assign obligations without the purchaser's prior written consent.
• Subcontracts must be notified to the purchaser in writing.
• Delays in performance may result in penalties or termination. The supplier must promptly notify the purchaser of any delays.
• Penalties for late delivery or non-performance may be deducted from the contract price based on the current prime interest rate.
• The purchaser may terminate the contract for default, including failure to deliver, breach of obligations, or corrupt/fraudulent practices.
• Termination may result in restriction from doing business with the public sector for up to 10 years.
• Force majeure events may relieve the supplier from penalties or termination, provided timely notification is given.
• The contract may be terminated if the supplier becomes insolvent.
• Disputes should first be resolved amicably, then through mediation, and finally in a South African court of law.
• The supplier's liability is limited to the total contract price, except for criminal negligence, willful misconduct, or cost of repairing defective equipment.
• The contract is governed by South African law and written in English.
• Tax matters must be in order; a tax clearance certificate from SARS is required prior to award.
• The National Industrial Participation Programme (NIPP) applies if applicable.
• Collusive bidding (bid rigging) is prohibited and may lead to invalidation of bids, termination, restriction, or damages.
