Bids must be submitted in sealed envelopes, clearly marked with the tender number and title, and placed in the tender box at the Municipal Offices, 13 Kerk Street, Piketberg, no later than 12:00 on Monday, 21 September 2026. Bids will be opened in public after closing. Bids addressed to any municipal official in a personal capacity will be disqualified. The bidder is responsible for ensuring courier companies place bids in the tender box; the Municipality is not liable for bids not placed. Late, incomplete, faxed, or emailed bids will not be accepted. Proof of dispatch is not proof of receipt. Bids may only be submitted on the Municipality's bid documentation, with all figures and signatures in original format. Bids deposited in the incorrect box will not be considered. Mailed, telegraphic, or faxed tenders will not be accepted. Bids must be valid and binding for 120 days after closing. Returnable forms (all must be completed, signed, and attached): Authority to Sign a Bid (with certified copy of resolution for companies/CCs), MBD 4 (Declaration of Interest), MBD 6.1 (Preference Points Claim), MBD 8 (Declaration of Past SCM Practices), MBD 9 (Certificate of Independent Bid Determination), MBD 10 (Certificate of Payment of Municipal Accounts, with ID numbers, residential addresses, and municipal account numbers of all members/partners/directors, plus copies of accounts), OHSA form with valid Letter of Good Standing from the Compensation Commissioner, Form of Indemnity, Pricing Schedule, Form of Offer, and Declaration by Tenderer. Joint ventures must submit the Certificate of Authority for Joint Ventures with a copy of the Joint Venture Agreement showing percentage contributions. Bidders must also submit a valid Tax Compliance Status (TCS) PIN and CSD registration number; failure to do so may invalidate the bid. An originally certified B-BBEE Certificate or Sworn Affidavit must be submitted; failure results in 0 points for B-BBEE but does not make the bid non-responsive. Bids are evaluated under the Council's Supply Chain Management Policy using the 80/20 preference point system. Preference points: 80 points for price, 10 points for specific participation goals, and 10 points for B-BBEE. The bid price must be VAT inclusive. The Preference Point Claim form (MBD 6.1) must be completed in full to claim preference points. Failure to submit a B-BBEE certificate or sworn affidavit results in 0 points for B-BBEE but does not render the bid non-responsive.

The scope is the clearing of sidewalks and open spaces for Bergrivier Municipality from date of appointment until 30 June 2029, as set out in the specifications. The tender includes schedules for plant and equipment, subcontractors, and work experience. No CIDB grading is required.

Variation orders: where the estimated value of changes does not exceed 15% of the original contract value, the contractor may be instructed to deliver the goods or render the services. For measurable quantities, the contractor may be approached to reduce unit prices, provided there is no price escalation.

Goods and services must conform to the standards in the bidding documents and specifications. The supplier's premises must be open for inspection by the purchaser's representative at all reasonable hours. If inspections or tests show non-compliance, the supplier bears the costs; non-compliant goods or services may be rejected. The supplier must replace rejected goods at its own cost and risk. The supplier must not disclose contract documents or information without prior written consent; documents remain the purchaser's property and must be returned on completion.

All prices must be quoted in South African currency and be inclusive of VAT. If the contract value exceeds R1,000,000.00, the bidder must be registered for VAT with SARS; the municipality will deem the price VAT inclusive even if not indicated. VAT must be shown clearly on each invoice. The Municipality's VAT registration number is 4000 846 172. Payment will be made within 30 days after submission of a valid invoice. No contract will be concluded with a bidder whose tax matters are not in order or whose municipal rates and services charges are in arrears. Bidders must declare all municipal account numbers in the Bergrivier area for which they or their proprietors/directors are responsible; if indebted, an agreement may be required for deductions from payments.

Bidders must be registered on National Treasury's Central Supplier Database (CSD). A valid Tax Compliance Status (TCS) PIN and CSD registration number must be submitted with the bid; failure may invalidate the bid. An originally certified B-BBEE Certificate or originally certified B-BBEE Sworn Affidavit must be submitted; failure results in 0 points for B-BBEE. Bidders must submit a valid Letter of Good Standing from the Compensation Commissioner (for OHSA). Bidders must complete MBD 10 (Certificate of Payment of Municipal Accounts) with ID numbers, residential addresses, and municipal account numbers of all members, partners, directors, etc., and attach copies of municipal accounts. No CIDB grading is required.

Bidders must complete and sign the OHSA (Occupational Health and Safety) form and submit a valid Letter of Good Standing from the Compensation Commissioner. The Form of Indemnity must also be completed and signed.

The contract is subject to the General Conditions of Contract (GCC) for government procurement. The successful bidder must sign a Service Level Agreement (SLA) with the Municipality. The supplier may not assign obligations without prior written consent. All subcontracts must be notified in writing. Delays in performance may incur penalties calculated at the current prime interest rate per day of delay. The purchaser may terminate for default, including failure to deliver, failure to perform obligations, or corrupt/fraudulent practices, and may restrict the supplier from doing business with the public sector for up to 10 years. Termination for insolvency is possible. Disputes are to be resolved by mutual consultation, then mediation, then South African courts. The contract is governed by South African law and written in English. The supplier must indemnify the purchaser against third-party patent, trademark, or design infringement claims. Intellectual property developed for the municipality vests in the municipality. The supplier must permit inspection and audit of records. Prices may not vary from those quoted, except for authorised adjustments. Variation orders up to 15% of the original contract value may be instructed. The supplier must notify the purchaser of delays and the purchaser may extend time with or without penalties. The purchaser may procure substitute goods/services at the supplier's expense if the supplier fails to deliver. The supplier is liable for taxes and duties until delivery. No contract will be concluded with a bidder whose tax matters are not in order or whose municipal accounts are in arrears.

Tenders must be valid and binding for 120 days after closing date. Late, incomplete, or quotations received by fax or email will not be accepted. Proof of dispatch is not proof of receipt. The Council is not obliged to accept the lowest or any quotation and reserves the right to accept any quotation or part thereof. If prices are cost-effective, the Council reserves the right to procure more items to take financial advantage.
