Bids must be deposited in the tender box at the New Town Hall, Kumkani Mhlontlo Local Municipality, 96 LG Mabindla Street, Qumbu, 5180, by no later than the closing date and time. Faxed, electronic, telegraphic, telefax, e-mail and late tenders will not be considered. Bids must be submitted on the official forms and not re-typed. Bids must remain valid for 90 days. The municipality reserves the right to withdraw, re-advertise, reject or accept any tender in whole or in part, and is not bound to accept the lowest or any tender.

Evaluation is in two stages:

• Stage 1: Functionality (out of 100 points). Only bidders scoring 70% or more proceed to Stage 2.
• Stage 2: Price and MHLM Specific Goals using the 80/20 preference system (80 points price, 20 points specific goals).

Functionality criteria (Stage 1):

• Availability of funds (30 points): business bank statement confirming funds of at least 30% of the quoted value (10 points if agreement with supplier, 0 if no proof).
• Ability to deliver (30 points): own transport with proof of vehicle ownership, preferably a bakkie or truck (10 points); leasing of transport with signed lease agreement (10 points); no transport (0 points).
• Methodology (40 points): delivery plan with time frames (20 points); project manager CV with qualifications (10 points); personnel CVs with qualifications (10 points).

Specific goals (20 points) and required proof:

• HDI equity ownership (10 points): proof via ID copy (race or nationality).
• Youth enterprise 18-35 years (2 points): proof via ID copy and CSD (age).
• Women equity ownership (2 points): proof via ID copy, CK and CSD (gender/sex).
• Disability equity ownership (2 points): proof via medical certificate and CSD.
• Military veterans (2 points): proof via ID copy, CSD and confirmation letter from the Office of Military Veterans.
• Rural enterprise (2 points): proof via proof of residence from traditional leader or ward councillor, and CSD.

Failure to submit proof for claimed specific goals means those points are not awarded.

Supply and delivery of 27 wheelchairs over 9 months, at 9 wheelchairs per quarter.

Specification:

• 9 x lightweight, foldable power wheelchairs with polymer lion battery and magnesium alloy rim.
• Must be drivable by power or usable as a manual wheelchair (electric motorised wheelchair).
• Must be equivalent to Wheelchair 88.
• Colour: black.

Methodology is a functionality criterion worth 40 points:

• Delivery plan with time frames: 20 points.
• Project manager CV with qualifications: 10 points.
• Personnel CVs with qualifications: 10 points.

Bidders must also demonstrate ability to deliver (30 points) through own transport (proof of vehicle ownership, preferably a bakkie or truck) or leased transport (signed lease agreement).

Pricing is evaluated under the 80/20 preference point system (80 points price, 20 points specific goals). Bidders must submit a quotation on company letterhead or with a business stamp. The MBD 6.2 local content declaration requires calculation of local content as a percentage of the bid price excluding VAT, using the formula in SATS 1286, with imported content converted to Rand using SARB exchange rates published one week before closing.

Bidders must provide a business bank statement confirming availability of funds of at least 30% of the quoted value (this is a functionality criterion).

Pricing: The 80/20 preference point system applies (80 points price, 20 points specific goals).

Bids must remain valid for 90 days.

CSD registration: CSD report or CSD number required.

Tax compliance: SARS status pin required; original and valid tax clearance certificate (MBD 2) attached.

B-BBEE: certified B-BBEE certificate issued by a SANAS-accredited verification agency, an IRBA-approved registered auditor, or a sworn affidavit; B-BBEE status level verification certificate (MBD 6.1) submitted.

Local content: MBD 6.2 (Declaration for Local Production and Content) must be completed and signed by the CFO or other legally responsible person; failure to submit or to meet the stipulated minimum threshold disqualifies the bid.

Municipal rates: proof of municipal rates not older than one month, or lease agreement.

State employment: no bids from persons in the service of the state (as defined in MSCM regulations).

Restricted suppliers: bidder or directors must not be listed on the National Treasury's Database of Restricted Suppliers.

Past SCM practices: MBD 8 declaration required; bid may be rejected for abuse of SCM systems, fraud, corruption, or failure to comply with public sector contracts in the past five years.

No specific occupational health and safety requirements are stated beyond the POPIA security measures for protecting personal information, which require appropriate technical and organisational measures to prevent loss, damage, unauthorised destruction, unlawful access or processing.

The contract will be subject to the Kumkani Mhlontlo Local Municipality Supply Chain Policy Management and the General Conditions of Contract (GCC). The successful bidder will be required to sign a written Contract Form (MBD 7). Bids must remain valid for 90 days. The municipality is not bound to accept the lowest or any tender and may accept any tender in whole or in part.

POPIA obligations: The service provider acts as an operator for the municipality and must process personal information only on behalf of and in compliance with the municipality's instructions, for purposes connected with the services, and keep it confidential. The service provider must secure the integrity of personal information with appropriate technical and organisational measures, identify and safeguard against risks, and notify the municipality of risks. It must comply with the municipality's information security practices and provide a written explanation within 5 business days of a request. It must ensure employee reliability, limit access, deal with inquiries, and cooperate with audits. It must notify the municipality within 1 business day of a breach, within 3 business days of access requests or complaints, and promptly of legally binding disclosure requests. On termination or request, it must return or destroy personal information and provide a certificate of destruction. It warrants compliance with all regulatory and statutory requirements including POPIA, indemnifies the municipality against claims from breach of information protection obligations, and acknowledges the municipality retains all right, title and interest in the personal information.
