The contract is an NEC3 Engineering and Construction Contract, April 2013, Main Option B (Priced contract with Bill of Quantities). Bidders must be capable of performing under this contract. The contractor must be an employer in its own right under the Occupational Health and Safety Act and must be in good standing with the Compensation Fund or a licensed insurer. If a joint venture or consortium, members are jointly and severally liable. The contractor must not be in business rescue proceedings. Contractor to confirm measurements for perfect fit. Provide a 10-year guarantee on workmanship and product. All products must be SABS approved. Adhere to OEM guidelines. Bidders must provide CVs for key people as per the tender schedule, including name, job, responsibility, qualifications, and experience. The contractor must notify the Project Manager and Employer of the key person with authority to bind the contractor within one week of the contract date.

Pricing: All prices shown excluding VAT unless instructed otherwise. Prices are fixed and firm, no CPI escalation. Prices must include customs and duties for overseas items. Permit costs paid upfront by successful bidder, reimbursed by ACSA against proof of payment, no mark-up on permits. Changes in staff during contract period are at contractor's cost. Evaluation follows a staged process. Stage 1 checks responsiveness; Stage 2 verifies mandatory criteria, including a CIDB contractor grading of 1ME or higher and a fully completed and signed Form of Offer and Acceptance (C1.1). Stage 4 assesses functionality against criteria in an attached evaluation document; a minimum of 50 out of 100 points is required to proceed. Stage 5 applies the 80/20 preference point system for bids up to R50 million: 80 points for price, 20 for specific goals. Specific goals include B-BBEE status levels (Level 1 = 5 points, down to Level 8 = 0.1), black youth majority-owned (5), black women majority-owned (5), and company majority owned by people with disabilities (5). Scope: replacement of roller shutter doors at King Phalo Airport, Eastern Cape, over a 24-month period. The detailed scope is in Part C3 (Service Information / Scope of Work) and site information in Part C4. A site inspection is offered to understand the airport and requirements. Bidders must hold a CIDB contractor grading of 1ME or higher. The contract is fixed-price for the full duration; no price adjustments apply. Insurance requirements are set out in Appendix 2, and the successful bidder must complete safety and environmental documentation (Appendix 3).

Pricing must be submitted on the provided pricing schedules (C2.2). Rates and prices are fixed for the contract duration and must include all duties and taxes except VAT, which is shown separately. The contract is not subject to price adjustments. Tender offers must remain valid for 12 weeks (84 days) after closing. If requested, bidders must submit securities, bonds, guarantees and insurance certificates before contract formation.

CIDB contractor grading of 1ME or higher is mandatory.

Tax compliance: submit a SARS Tax Compliance Status PIN or a printed TCS certificate; if not available, provide a CSD number. Each party in a consortium, joint venture or subcontracting arrangement must submit its own.

The primary eligibility requirement is the financial and administrative capability to comply with the comprehensive insurance obligations, including the ability to pay high deductibles and secure the required supplementary insurance policies from approved insurers.

The document is an insurance clause annexure for airside construction contracts. It applies where the awarded contract value does not exceed R150 million, the construction period does not exceed 36 months, and the defects liability period does not exceed 24 months. The employer (ACSA) arranges Principal Controlled Insurance (PCI) in joint names of employer, contractor, and subcontractors, covering contract works, public liability, removal of lateral support, SASRIA, aviation liability, and design & construct professional indemnity. The contractor must familiarise itself with these policies and comply with all terms, limits, exclusions, and deductibles. The contractor is liable for deductibles: R150,000 (R250,000 for testing/commissioning) for contract works, R75,000 for public liability property damage, R75,000 for removal of lateral support, R25,000 for SASRIA theft, R300,000 for aviation liability, and R5,000,000 (contracts under R50m) or R10,000,000 (contracts over R50m) for design & construct professional indemnity. The contractor must also maintain its own insurances: construction plant and equipment, employer's liability (minimum R20,000,000), motor vehicle liability (minimum R5,000,000), buy-down cover for employer's deductibles if unacceptable, marine cargo insurance if applicable, and excess public/aviation/professional indemnity cover. Policies must be with insurers approved by the employer and produced within 28 days of contract commencement.

The contractor must not include premium charges for employer-arranged insurance in its pricing, except for supplementary insurance it deems necessary. Any additional insurance purchased by the contractor is at its own cost. The contractor must be able to pay the deductibles as specified. If the contractor fails to maintain required insurances, the employer may effect them and deduct premiums from monies due to the contractor.

The contractor must comply with all terms and conditions of employer-arranged policies and be deemed fully aware of all conditions, limits, exclusions, and deductibles. The contractor must ensure subcontractors are aware of and comply with these insurance clauses. The contractor must notify the employer immediately of any cancellation or restrictive modification to its insurance and advise remedial action.
