C.3.13.1 Tenderer offers will only be accepted if:

(d) The Employer accepts no responsibility or liability arising from any reliance on or use

of the electronic version provided in terms of this clause. The Employer further does not

guarantee that the electronic version corresponds with the issued Tender documents in

all respects. Tenderer are alerted to the fact that electronic versions of the Tender

documents may not reflect any notices or addenda that amend the Tender document.

(e) Any non-compliance with these provisions, including effecting any unauthorized

alterations to the tender document as contemplated in F.2.11, shall render the Tender

invalid. The Employer reserves the right to take any action against such tenderer

allowed in law including, in circumstances where the tenderer had already been

awarded, the right to cancel the contract.

(f) In requesting the electronic version of the Tender document or parts thereof, the

tenderer is deemed to have read, understood and accepted all of the above

Special conditions: The employer reserves the right to limit the number of districts awarded to a single tenderer based on resource capacity. A two-stage system will not be followed. No alternative tenders are allowed. Tenders must be submitted in non-erasable ink, signed by an authorized person, and joint ventures must provide a joint venture agreement. Tender validity period is 12 weeks. Tenders will not be opened in public. Tenderers must attend the compulsory briefing meeting. The employer may negotiate with the preferred tenderer under certain conditions. The employer may reject tenders from persons in the service of the state or those who have abused the supply chain management system.

Eligibility criteria: Tenderers must be registered with CIDB or capable of being so, with a contractor grading designation equal to or higher than Class EB, Grade 7. Joint ventures are eligible if every member is registered with CIDB, the lead partner has a grading of Class EB Grade 6, the combined grading meets the required level, and the JV is registered on the Central Supplier Database. Tenderers must have access to a suitably qualified and experienced Electrical Maintenance manager and supervisor with experience in low voltage installation and maintenance. The manager will be the single point of accountability for contract works. The supervisor will handle maintenance, inspection, and issuing of COCs. Tenderers must be registered on the Central Supplier Database and submit proof of registration. They must also be tax compliant, not listed on the Register of Tender Defaulters, and complete the Compulsory Enterprise Questionnaire.
