Bidders must be tax compliant (submit a TCC or SARS PIN / CSD number). Bids from persons in the service of the state, or companies/close corporations with directors/members in the service of the state, will not be considered. Bidders must complete and submit SBD 4 (Bidder's Disclosure) — any person listed on the Register for Tender Defaulters or the List of Restricted Suppliers is automatically disqualified. Bidders must submit a latest full CSD report. The 80/20 preference point system applies, with 20 points available for specific goals (B-BBEE) — failure to submit proof will result in no preference points being awarded.

The department requires a service provider to research and develop the 'Inclusive Cities' chapter for the State of the Cities Report (SOCR). The work forms part of a collaborative programme under the Memorandum of Understanding between the South African Cities Network (SACN) and the Department of Land Reform and Rural Development (DLRRD).

Scope:

• Conduct a 25-year assessment of inclusive cities, with emphasis on the last five years (2021-2026).
• Analyse key trends to determine whether South African cities have become more inclusive structurally, spatially, socially and economically since the advent of democracy.
• Assess how these trends are likely to influence the future of South African cities.
• Assess progress in spatial transformation across the eight metropolitan municipalities.
• The chapter must align with the SOCR VI theme 'Transformed Future-Focused City'.
• Draw on data from the SOCR Dashboard.

Policy context to be considered:

• Spatial Planning and Land Use Management Act (SPLUMA), 2013.
• National Spatial Development Framework (NSDF).
• Integrated Urban Development Framework (IUDF).
• Built Environment Performance Plans (BEPPs).
• City-level instruments such as Spatial Development Frameworks, Municipal Planning By-laws, Land Use Schemes and precinct plans.

Duration: The work must be completed over four (04) months.

5. Use of contract documents and information; inspection

Tax Compliance:

• Bidders must be tax compliant and submit a valid Tax Compliance Status (TCS) PIN or certificate from SARS.
• Where no TCS PIN is available, a CSD number must be provided.
• For consortia, joint ventures or subcontractors, each party must submit a separate TCS certificate/PIN/CSD number.

Central Supplier Database (CSD):

• Bidders must be registered on the CSD and submit the latest full CSD report.

Preference Points:

• Bidders must complete SBD 6.1 to claim preference points for specific goals.

General:

• Bids will not be considered from persons in the service of the state, companies with directors who are persons in the service of the state, or close corporations with members who are persons in the service of the state.
• The successful bidder will be required to sign a written contract form (SBD 7).
• Bid validity period: 120 days.

The General Conditions of Contract (GCC) will form part of the contract and may not be amended. Special Conditions of Contract (SCC), if any, will supplement the GCC; in case of conflict, the SCC prevails.

Key GCC provisions:

• Performance security: within 30 days of notification of award, the successful bidder must furnish performance security in the amount specified in the SCC, in the form of a bank guarantee, irrevocable letter of credit, or cashier's/certified cheque.
• Payment: the purchaser will pay within 30 days of submission of a valid invoice; payment in Rand unless otherwise stated.
• Prices: prices quoted in the bid may not be varied except as authorised in the SCC.
• Contract amendments: no variation without written amendment signed by both parties.
• Assignment: the supplier may not assign obligations without prior written consent.
• Subcontracts: the supplier must notify the purchaser in writing of all subcontracts.
• Delays: the supplier is liable for penalties for late delivery, calculated at the prime interest rate per day of delay.
• Termination for default: the purchaser may terminate for non-delivery, breach, or corrupt/fraudulent practices, and may restrict the supplier from doing business with the public sector for up to 10 years.
• Force majeure: the supplier is not liable for delays caused by force majeure events, provided prompt written notice is given.
• Settlement of disputes: parties will attempt amicable resolution; if not resolved within 30 days, mediation may be initiated, and failing that, the matter may be settled in a South African court.
• Governing law: the contract is governed by South African law.
• Taxes and duties: the supplier is responsible for all taxes and duties; no contract will be concluded with a bidder whose tax matters are not in order.
• Prohibition of restrictive practices: collusive bidding is prohibited under the Competition Act; offenders may be reported to the Competition Commission and face invalidation of bids or termination of contract.

4. Points awarded for specific goals

4.1. In terms of Regulation 4(2); 5(2); 6(2) and 7(2) of the Preferential Procurement

Regulations, preference points must be awarded for specific goals stated in the tender.

For the purposes of this tender the tenderer will be allocated points based on the goals

stated in the table in paragraph 2.12 above as may be supported by proof/

documentation stated in the conditions of this tender.

4.2. In cases where organs of state intend to use Regulation 3(2) of the Regulations, which

states that, if it is unclear whether the 80/20 or 90/10 preference point system applies,

an organ of state must, in the tender documents, stipulate in the case of—

(a) an invitation for tender for income-generating contracts, that either the 80/20 or

90/10 preference point system will apply and that the highest acceptable tender

will be used to determine the applicable preference point system; or

(b) any other invitation for tender, that either the 80/20 or 90/10 preference point

system will apply and that the lowest acceptable tender will be used to

determine the applicable preference point system,

then the organ of state must indicate the points allocated for specific goals for both the

90/10 and 80/20 preference point system.

4.3 A consortium or joint venture may, based on the percentage of the contract value

managed or executed by their members, be entitled to claim points in respect of

specific contract participation goals.

4.4 A tenderer will not be awarded points for HDI if it is indicated in the tender documents

that such a tenderer intends sub-contracting more than 25% of the value of the contract

to any other enterprise that does not qualify for the same number or more points for

equity ownership.

4.5 A tenderer awarded a contract as a result of preference for contracting with, or

providing equity ownership to a HDI, may not subcontract more than 25% of the value

of the contract to a tenderer who is not a HDI or does not qualify for the same number

or more preference for equity ownership.
