Returnable documents (all mandatory unless marked optional):

• SBD 1 (Procurement Invitation), fully completed and signed, including SBD 4, SBD 6.1 and the signed Bid Submission Certificate form.

• Proof of registration on the Central Supplier Database (CSD).

Disqualification risks:

Evaluation stages:

• Stage 1: Compliance with submission requirements (returnable documents).
• Stage 2: Evaluation against technical specifications, including quality (Stage 2A), possible due diligence interviews (Stage 2B), and reference checks (Stage 2C).
• Stage 3: Price/Preference evaluation – lowest priced bid receives maximum points (80), others ranked relative to it; preference points from SBD 6.1 are added.
• Stage 4: Tax compliance check (resident and foreign bidders).
• Stage 5: Award to bidder with highest combined score, subject to administrative documentation.

Preference point system: 80/20 (80 points price, 20 points specific goals).

The SAEON requires the supply and delivery of 5 x AxyTrek Marine bio-loggers for African penguin tags.

Price quoted must be in South African Rands and fully inclusive of all costs, including delivery to the specified delivery point, VAT, income tax, UIF contributions and skills development levies.

The price schedule remains firm for the duration of the contract; no changes or additional ad hoc costs are accepted unless authorised in the Special Conditions of Contract.

The contract ceiling price includes firm and estimated quantities; actual orders are placed via written purchase orders.

The NRF may conduct fair pricing tests; if pricing is outside the fair price range, the NRF may negotiate price only with the winning bidder or the next ranked bidder.

No bid security, bonds, guarantees or retention are specified.

Tax compliance:

• Bidders must be tax compliant and submit a SARS tax compliance status (TCS) PIN or a printed TCS certificate.
• Where no TCS is available, a CSD number must be provided.
• For consortia/joint ventures/sub-contractors, each party must submit a separate TCS certificate/PIN/CSD number.

Central Supplier Database (CSD):

• Bidders must be registered on the CSD and include their Master Registration Number (Supplier Number) in the bid.

B-bbee:

• A valid B-BBEE certificate or sworn affidavit (for EMEs and QSEs) must be submitted to qualify for preference points.
• B-BBEE status level contributes to specific goals points (see evaluation criteria).

General:

• Bids from persons in the service of the state, or companies with directors who are in the service of the state, will not be considered.
• Bidders must not be listed on the Register for Tender Defaulters or the List of Restricted Suppliers.
• Foreign suppliers must complete the tax questionnaire in SBD 1.

Occupational Health and Safety when working on NRF sites:

• All personnel must obtain safety induction.
• Comply with the Occupational Health and Safety Act and all site safety instructions.
• PPE (closed safety shoes, hard hats, height safety equipment, high visibility vests) must be worn at all times on site.
• Provide a valid Letter of Good Standing under the COID Act and keep it valid during contract execution.
• Furnish registration number with the Compensation Commissioner.
• Enter into a Section 37.2 agreement (OHS Act) as drafted by the NRF.
• Maintain a health and safety plan at the work site.
• Each team member (including sub-contracted personnel) must submit a signed indemnity form before entering the site.

The contract is subject to the National Treasury's General Conditions of Contract (GCC) and the Special Conditions of Contract (SCC) appended; SCC prevails over GCC in case of conflict.

Service provider obligations:

• Exercise reasonable skill, care and diligence.
• Deliver services during normal working hours (Monday to Friday, 08h30-17h00, excluding public holidays) unless otherwise agreed.
• Not prejudice NRF operations.
• Submit required information and reports to the NRF-nominated person.
• Comply with all applicable legislation.
• Communicate and deliver services only to the NRF and its end users.

Communication:

• All communication in writing (mail, delivery, or email), stating the contract number and purchase order number where applicable.

Performance levels:

• The NRF measures performance against set levels; failure has material adverse impact and damages are not precisely determinable.
• Excused only for NRF-caused delays or force majeure.
• On failure, the bidder must investigate root causes, correct promptly, advise NRF of remedial status, and take preventative measures.
• Performance level for supply and delivery of penguin tags: completeness of delivery checked against the purchase order; no completion certificate or invoice approved/paid if delivery is not satisfactory.

Fronting:

• The NRF may investigate fronting; the bidder must prove no fronting within 7 days of notification, failing which the bid/contract is invalidated and the bidder may be restricted from public sector business for up to 10 years.

Cancellation:

• The NRF may cancel the quotation prior to award if procurement is no longer required, no acceptable bids are received, a material irregularity occurs, or funds are insufficient or prices are not market-related.

Special Conditions of Contract:

1. Service Provider Obligations – exercise reasonable skill, care and diligence; deliver during normal working hours (Mon-Fri, 08h30-17h00) unless otherwise agreed; not prejudice NRF operations; submit required information and reports; comply with applicable legislation.
2. Communication – in writing via mail, delivery, or email, stating contract and purchase order numbers.
3. Occupational Health and Safety when working on NRF sites – obtain safety induction, comply with OHS Act, wear PPE (closed safety shoes, hard hats, height safety equipment, high visibility vests), provide Letter of Good Standing under COID Act, enter into Section 37.2 agreement, maintain health and safety plan, submit signed indemnity forms.
