Goods supplied must conform to the standards in the bidding documents and specifications. The supplier must permit inspection of records and audits. Pre-bidding testing is for the bidder's account. Inspections, tests and analyses may be carried out; costs are borne by the purchaser if goods comply, otherwise by the supplier. Rejected goods must be replaced at the supplier's cost.

All prices must be quoted in South African currency and be inclusive of VAT. Where the contract value exceeds R1,000,000, the bidder must be registered for VAT. Payment will be made in Rand, no later than 30 days after submission of a valid invoice. Prices charged must not vary from those quoted in the bid. No contract will be concluded with a bidder whose tax matters are not in order or whose municipal accounts are in arrears.

The contract is subject to the General Conditions of Contract (GCC). Key provisions: goods must be new, unused, of the most recent models, and free from defects; warranty valid for 12 months after delivery and acceptance, or 18 months after shipment, whichever ends earlier. Payment within 30 days of invoice. Prices fixed. Variation orders limited to 15% of contract value. Assignment requires prior written consent. Subcontracts must be notified in writing. Delays may incur penalties calculated at the current prime interest rate per day of delay. Termination for default possible, with restriction from doing business with the public sector up to 10 years. Force majeure may relieve liability. Disputes to be resolved amicably, then through formal procedures.

The successful bidder will be required to fill in and sign a written contract form (MBD7). The award of the tender is subject to the signing of a Service Level Agreement (SLA) between the successful bidder and Stellenbosch Municipality.
