ESKOM requires a service provider to maintain the glassware washer machine at its petroleum sciences laboratories, supplying consumables and spares as and when needed over five years. The contractor takes on employer duties under the occupational health and safety act 85 of 1993 and must work to eskom's she specifications for the service. The most consequential item for bidders is the section 37(2) agreement, which must be signed by a manager with authority to bind the contractor and witnessed by both parties.
Key Requirements
Section 37(2) agreement: the contractor's responsible manager must sign acceptance of employer duties under the Occupational Health and Safety Act 85 of 1993 and compliance with the SHE specifications for the service.
Authority to sign: the signatory must warrant in the agreement that he or she has the authority to bind the contractor, so a board resolution or delegated authority should be in place.
Witnesses: both the contractor and Eskom must have witnesses sign the agreement.
SHE compliance: all work performed and all machinery or plant used must meet the Act, and the contractor and its employees must adhere to it.
Contract term: five years on an as-and-when required basis, covering service, maintenance, consumables and spares for the glassware washer machine.
Closing: bids close on 20 November 2026 at 08:00; late or incomplete returnables risk disqualification.
