TRANSNET requires a service provider to develop comprehensive category and sourcing strategies for its supply chain management function, supply resourcing capacity to implement those strategies, and deliver training that supports the rollout of its new procurement operating model, as a once-off assignment. Subcontracting: Transnet's approval is required before subcontracting or replacing a subcontractor; no more than 25% of contract value may go to an enterprise with a lower B-BBEE status level unless it is an Exempted Micro Enterprise with the capability to perform, and undeclared subcontracting can attract a penalty of up to 10% of contract value.
Penalties: service level non-compliance penalties apply where the delay is not Transnet's fault, and failing to meet subcontracting commitments triggers a penalty of 100% of the undelivered subcontracting value plus a further 10%, certified 90 business days before contract expiry and payable within 10 business days of a valid tax invoice.
Payment and standing: payment falls due 30 calendar days after Transnet receives a valid, undisputed tax invoice with a month-end statement and supporting documents, late payment of undisputed amounts attracts interest at Standard Bank's prime rate, tax compliance across income tax, VAT and PAYE must be maintained for the term, and no award is made to bidders or their members, directors, partners or trustees on National Treasury's Register of Tender Defaulters or List of Restricted Service Providers.
