• Delivery: All costs must be included in the bid price for delivery to the prescribed destination.

• Goods must conform to standards specified in bidding documents.
• Confidentiality: Do not disclose contract details without purchaser's written consent.
• Inspection: Purchaser may inspect supplier's records and have them audited.
• Testing and Inspection: Pre-bid testing at bidder's cost; purchaser may inspect premises and supplies during/after production.
• Non-compliance: If supplies fail inspection, costs borne by supplier; goods may be rejected and replaced at supplier's expense.
• The purchaser reserves the right to cancel the contract for breaches.

• Submit firm prices only; non-firm prices (including those subject to exchange rate variations) will not be considered.
• Use the official SBD 3.1 Pricing Schedule form; do not retype.
• Prices must be exclusive of VAT; indicate subtotal, 15% VAT, and grand total.
• For each item, specify unit price, quantity, and total price excluding VAT.
• Include all delivery costs in the bid price.
• Provide additional details: required delivery date, brand/model, country of origin, compliance with specifications, any deviations, delivery period (firm/not firm), and delivery basis.
• The offer must be valid for 90 days from the closing date.

• Central Supplier Database (CSD): Mandatory registration at closing time; failure results in disqualification. Submit CSD number and ensure information is correct and up to date.
• Tax Compliance: Submit your SARS Tax Compliance Status PIN or a printed TCS certificate. If no PIN but registered on CSD, provide CSD number. For consortia/joint ventures, each party must submit separate TCS/CSD details.
• B-BBEE: Submit a B-BBEE Status Level Verification Certificate or sworn affidavit (for EMEs & QSEs) to qualify for preference points.
• Entity Status: Complete the 'Authority to Sign a Bid' form indicating enterprise type (close corporation, sole proprietor, partnership, etc.) and provide proof of authority.
• Foreign Suppliers: If applicable, answer the foreign supplier questionnaire; registration for tax compliance may not be required if no presence/income/tax liability in RSA.
• Exclusion: Persons in the service of the state, or companies/directors/members in such service, are not eligible.

• Warranty: Goods must be new, unused, and defect-free; warranty valid for 12 months after delivery or 18 months after shipment, whichever is earlier.
• Payment: Payments made within 30 days of invoice submission, in Rand unless specified otherwise.
• Prices: Fixed as per bid; no variations except authorized adjustments.
• Contract Amendments: Only via written amendment signed by both parties.
• Assignment and Subcontracting: Requires purchaser's prior written consent; notify purchaser of subcontracts.
• Delays: Notify purchaser promptly; extensions may be granted with or without penalties.
• Penalties: Deductions for delays based on prime interest rate; termination possible for default.
• Termination: For failure to deliver, perform, or corrupt practices; may include restrictions from public sector business for up to 10 years.
• Force Majeure: Not liable for delays due to unforeseen events; notify purchaser.
• Dispute Resolution: Attempt amicable resolution, then mediation, then South African courts.
• Governing Law: South African law, English language.
• Taxes: Supplier responsible for all taxes and duties; tax clearance certificate required.
• Restrictive Practices: Collusive bidding prohibited; may be reported to Competition Commission.

• Phase 1: Compliance Screening

• Complete and sign compulsory SBD forms: Authority to Sign Tender, CSD Registration, SBD 1 (Parts A & B), SBD 3, SBD 4, SBD 6.1, and General Conditions of Contract.
• Be fully registered on CSD at closing time.
• Ensure no listing on the Register of Tender Defaulters or restriction from government business.
• Avoid document forgery; offenders may be reported to SAPS and barred for up to 10 years.

• Phase 2: Price and Preference

• 80/20 preference point system: 80 points for price, 20 points for specific goals.
• Points allocated based on ownership percentages (black people, black women, black youth) and geographical location (KwaZulu-Natal), verified via CSD report.

• Award: Ezemvelo KZN Wildlife may appoint multiple bidders, not appoint anyone, or negotiate prices with technically compliant bids.
