TRANSNET requires the supply, installation, testing and commissioning of wheels press brake machines, together with the supporting tooling, for its wheels business in durban. The successful bidder must sign the TRANSNET supplier integrity pact and certify this in the rfx declaration form, after which the pact is automatically incorporated into the concluded contract. The pact binds suppliers to transnet's zero-gifts policy, independent bidding, conflict-of-interest disclosure and a declaration of NO serious legal transgressions in the past five years. The most consequential consideration is that a breach carries exclusion from TRANSNET and other organs of state for up to 10 years, contract cancellation without compensation and encashment of any guarantees or bonds.
Integrity Pact: bidders must read the pact, certify in the RFX Declaration Form that they have done so and agree to its content, and accept that it becomes part of the final contract.
Zero Gifts: no gift, gratuity, hospitality, bribe, kickback or benefit of any value may be offered to or accepted from Transnet employees at any stage of the bid or contract.
Independent bidding: no consultation, agreement or arrangement with competitors on prices, market allocation, pricing formulas, bid submission decisions or specifications; suspicious bids may be referred to the Competition Commission or the NPA.
Conflict of interest: any family, business or social relationship between the bidder's owners, members, directors, partners or shareholders and a Transnet employee or board member must be disclosed in the RFX declaration form or notified to Transnet immediately in writing.
Past transgressions: bidders declare that no serious breach of law (including corruption, fraud, theft, extortion or Competition Act contraventions) occurred in the last five years with any public or private entity; an incorrect statement can lead to rejection or removal from Transnet's supplier database.
Restricted suppliers: no award will be made to a bidder appearing on National Treasury's Register of Tender Defaulters or List of Restricted Suppliers, and no portion of the contract may be subcontracted to a restricted company.
Sanctions for breach: immediate exclusion from the bid, contract cancellation without compensation, recovery of sums paid, encashment of advance bank, performance or warranty guarantees, exclusion from future state business for up to 10 years, and a penalty of up to 10% of contract value for undeclared subcontracting.
