Functionality scoring by category: Category A (roads) — experience of bidder, qualification of site agent (10 points), plant (30 points); Category B (bridges and causeways) — experience, qualification of site agent (10 points), construction method statement (15 points); Category C (community facilities) — experience, qualification of site agent, construction method statement (15 points). The 80/20 preferential procurement system applies, with specific goals determined per project at appointment stage. Bidders must not have municipal arrears exceeding 3 months or unsatisfactory performance on previous contracts in the last 5 years.

Scope: three-year panel for construction services under CIDB CE/GB categories, including new construction and rehabilitation of gravel roads, blacktop roads, bridges and causeways, sport facilities, and community halls. Projects located across the 28 wards of uMlalazi Municipality. Service provider obligations: provide quality services per specifications, maintain good standing with SARS, CSD, and COIDA, adhere to OHSA health and safety requirements, be available 24 hours/weekends for emergencies, attend contract administration meetings, and invite municipal officials for inspections. Minimum resources: Contract Manager (NQF Level 4 with relevant experience), Site Agent (relevant National Diploma with experience), Foreman (secondary education with relevant experience), Health and Safety Officer (health and safety qualification). Skills transfer is required during project execution; failure to transfer skills constitutes breach of contract. A construction method statement (max 6 pages) covering approach, activities, construction administration, quality management, and health and safety is required.

Method statement: submit a construction method statement (max 6 pages) with headings including approach method, activities in construction sequence, construction administration, quality management, and health and safety (if applicable).

Experience and qualifications: bidders must submit previous experience references and performance report forms, and proof of plant and equipment (if applicable). Key personnel presented during bidding must remain unchanged for the contract duration without the municipality's written approval. Minimum staff: Contract Manager (NQF Level 4 with relevant experience), Site Agent (relevant National Diploma with experience), Foreman (secondary education with relevant experience), Health and Safety Officer (health and safety qualification). Using unqualified personnel may lead to contract termination.

Quality requirements: maintain quality presented during bidding for the contract duration. Inspections and testing may cover service provider's premises, quality of materials, workmanship, and project milestones. Performance monitored regularly; progress reports required with invoices. Municipality may introduce additional performance measures. All formal approvals must be in hardcopy; ad-hoc communication may be by email or fax.

Pricing: re-measurement contract — scheduled quantities are estimates, actual work measured for payment. Price must be unconditional. Submit prices per tender document requirements. Municipality may negotiate a reasonable price with the lowest acceptable bid. Payment via electronic transfer upon delivery, subject to valid tax invoice and supporting documents. Progress claims must include signed monthly reports, travel log books, job cards, or municipal time sheets. Valid tax invoices submitted on the last day of each month; payment within 30 days. Penalties may be deducted for late performance.

For tenders above R10 million: audited annual financial statements and MBD 5 declaration. Joint ventures must provide Joint Venture Agreement and Power of Attorney. Registration on the Council's Database is mandatory for the successful bidder.

Health and safety: service provider must adhere to all health and safety requirements under OHSA. A Health and Safety Officer with a health and safety qualification is required. An agreement in terms of Section 37(2) of the Occupational Health and Safety Act is required for contract purposes. The construction method statement must include health and safety (if applicable).

Contract duration: maximum 3 years (36 months) from appointment. A Service Level Agreement may be signed; project-specific contracts will be signed with the municipality. The contract includes termination for default, settlement, and dispute resolution. The bid document terms form part of the contract. The service provider must indemnify the municipality against third-party claims of patent, trademark, or industrial design infringement. Goods/services must be insured. Performance security of 10% of contract value must be furnished within 30 days of award notification. Warranty: goods new, free from defects for a specified period. Inspections and tests may be conducted. No assignment of obligations without prior written consent. Maintain good standing with SARS, CSD, and COIDA. Adhere to OHSA health and safety requirements. Be available 24 hours/weekends for emergencies. Attend contract administration meetings and submit progress reports. Municipality may introduce additional performance measures.
