Specific goals: 10 points for historically disadvantaged persons (race, gender, disability), 10 points for locality (domiciled in Senqu Local Municipality), 5 points for Joe Gqabi District Municipality, 2 points for Eastern Cape, 0 points outside Eastern Cape. Total for price and specific goals must not exceed 100. Functionality criteria: maximum 100 points, minimum 70 points to qualify. Tender awarded to highest scoring tenderer. Bids must be responsive to all terms, conditions, and specifications without material deviation.

Supply and delivery of consumables for two years. Items include: coffee powder in 750g tin container; 100% coffee freeze dried instant medium roast in 200g refill; coffee creamer powder in 1kg box; 200x4g stick/tube packs; full cream long-life milk 6x500ml box. All unit prices must include delivery costs to Lady Grey Municipal Offices for the duration of two years. Prices per unit excluding VAT for Year 1 and Year 2.

The tenderer must possess the necessary professional and technical qualifications, competence, financial resources, equipment, managerial capability, reliability, experience, reputation, and personnel to perform the contract. The SM may consider the tenderer's existing contracts with the SM. The tenderer must have legal capacity, not be insolvent, in receivership, under business rescue, or subject to legal proceedings. The tenderer must be able to perform the contract free of conflicts of interest.

Samples may be requested for testing purposes; samples may not be returned in the same state or may not be returned at all. Unsuccessful bidders will be advised to collect samples. The SM may conduct inspections, tests, and analysis to verify compliance. The tenderer must demonstrate professional and technical competence, financial resources, equipment, managerial capability, reliability, experience, and personnel to perform the contract.

Prices per unit excluding VAT for Year 1 and Year 2. All unit prices must include delivery costs to Lady Grey Municipal Offices for the duration of two years.

Prices must be in Rand, include all duties, taxes (except VAT), and all expenses such as transport and accommodation. Fixed rates and prices for the contract duration, not subject to adjustment except as provided in the Conditions of Contract. Tenderers must price all items in the Price Schedule; nil rates are allowed but may be subject to clarification and risk analysis. If the transaction value inclusive of VAT exceeds R10 million, the tenderer must provide audited financial statements for the past 3 years, a certificate of no undisputed municipal arrears over 30 days, particulars of contracts with organs of state in the past five years, and a statement on any portion of goods/services sourced from outside South Africa.

Must be registered on the Central Supplier Database (CSD) and the municipal supplier database. Tax compliance with SARS must be verified via CSD or e-Filing; failure to provide proof of tax compliance may lead to rejection. Must comply with Preferential Procurement Regulations 2022, including prequalification criteria, functionality, eligibility, statutory, local content, and compulsory sub-contracting. Must not be restricted under the SCM policy, not guilty of contravening the Competition Act, and not involved with the bid specification committee. Must submit a completed Compulsory Enterprise Questionnaire, Certificate of Independent Bid Determination, and other required declarations. Must comply with the Occupational Health and Safety Act. Must not have municipal arrears greater than 90 days. Must not appear on the Register of Tender Defaulters or Database of Restricted Suppliers.

B-BBEE status level documentation required to qualify for preference points. Must submit B-BBEE certificate or sworn affidavit per Amended Codes of Good Practise (Generic Scorecard) SABS approved standard SANS 1286:2017 unless valid sector certificate. Consortiums/Joint Ventures must submit consolidated B-BBEE scorecard. Preference points claimed via Preference Points Claim Form (MBD 6.1).

Compliance with the Occupational Health and Safety Act is required. The tenderer must submit a Health and Safety Plan upon written request, demonstrating competencies and resources to deliver goods/services in accordance with the Act and Regulations.

The contract is a framework agreement for ad-hoc or repetitive supply on an 'as instructed' basis over two years, without guaranteed quantum. Works orders will be allocated per the Works Order Allocation Process; standby suppliers may be appointed if higher-ranked suppliers refuse or cannot perform. The SM may accept or reject any tender, cancel the tender process, or accept part of a tender. Objections/complaints must be lodged within 14 days per MFMA regulations; appeals under Section 62 of the Municipal Systems Act within 21 days to the Municipal Manager. Rights under PAJA and PAIA are preserved. Tender validity is 120 days, extendable by 3 months. Withdrawal of a tender may incur liability for additional expenses. The SM may terminate the contract and consider an alternative bidder. The successful tenderer must provide securities, bonds, guarantees, and proof of insurance within two weeks of receiving the signed agreement.

Local production and content: Tenderers must comply with designated sector requirements for local content. Only locally produced or manufactured goods meeting minimum threshold will be considered. If raw materials not available locally, written authorisation from Department of Trade and Industry required. Non-submission of Local Content Declaration/Annexure C or authorisation letter will result in disqualification. Tenderers must be registered on municipal supplier database and CSD. Tenderers must comply with Preferential Procurement Regulations 2022.
