Service providers must submit a comprehensive company profile stipulating competency in Labour Law and illustrating capability and understanding of the services required. Written and verifiable references on company letterhead where similar services (labour relations matters) were offered in the past 36 months. Reference letters must include signature, dates, contact name, contact number and email address.

Evaluation is in two stages:

Stage 1 — Administrative requirements (pass/fail):

• Completed and signed SBD 4.
• Completed and signed SBD 6.1.
• Valid B-BBEE certificate or sworn affidavit.
• Valid tax pin and CSD Report or Summary with compliant tax status.
• Bidders must respond to clarification requests within the stated time (48 working hours for SBD 4; 7 working days for tax pin/CSD) or be deemed non-responsive.

Stage 2 — Price and SANAS specific goals (100 points):

• Price: 80 points.
• SANAS specific goals: 20 points.
• The 80/20 preference point system applies under the Preferential Procurement Regulations, 2022.

Specific goals points (claimed via SBD 6.1):

• 100% Black Owned: 6 points
• 51%–99% Black Owned: 4 points
• 100% Black Women Owned: 6 points
• 51%–99% Black Women Owned: 4 points
• 5% Youth Owned: 2 points

SANAS seeks to appoint an Industrial Relations Consultancy to provide professional labour relations advisory and support services on a retainer basis for 12 months.

Organisation context:

• SANAS has a headcount of not more than 90 employees.
• Historically, SANAS attends to fewer than 10 formal labour relations matters per annum.
• Current service provider is on a monthly retainer of approximately R4,800–R5,000 (for pricing guidance only).

Services required on a retainer basis:

1. Representation at the CCMA, Bargaining Councils and Labour Court.
2. Disciplinary support, including chairing disciplinary, grievance, incapacity and appeal hearings.
3. Participation in trade union engagements and collective bargaining processes, including CCMA representation.
4. Labour relations advisory services on all labour relations matters.
5. Specialised labour law support, including advice on retrenchments, strikes, industrial action and trade union negotiations.
6. Compliance and documentation, including employment contracts, policies, procedures and notices.
7. Training and capacity building for management and employees on labour legislation and best practices.
8. Labour relations risk management, providing proactive advice to manage labour risks.

Mandatory requirements:

• Minimum 5 years' experience in conducting similar services.
• Bidder must be located in Gauteng (proof of address required).
• Three verifiable references on company letterhead for similar services offered in the past 36 months, including signature, dates, contact name, number and email.
• Company profile demonstrating competency in Labour Law.

• Pricing must be quoted in South African Rand.
• Monthly retainer fee must include all labour relations advisory services, telephonic and email support, routine consultations, and representation services.
• Pricing table requires: monthly retainer fee (inclusive of all services), VAT, total monthly retainer including VAT, and total for the year (x12).
• Rate per kilometre and VAT must be quoted for travel to SANAS offices or external venues.
• Payment will be made 30 days after delivery of services.
