Bids must be submitted on the official tender document issued by Stellenbosch Municipality, in a sealed envelope clearly marked with the tender number and description, deposited in the Tender box at the Town House Complex, Plein Street, Stellenbosch, before the closing time. The Tender box is accessible 24 hours a day. Late, electronic, telephonic or faxed tenders will not be considered. Tenders not accompanied by a complete tender document will not be considered. The preferential points system is 80/20. Price: 80 points. B-BBEE status level of contribution: 10 points. Locality: 10 points. Total: 100 points. The 80/20 system applies to requirements with a Rand value up to R50 000 000. Bidders must be registered on the CSD and have a compliant tax status. B-BBEE points require a SANAS-accredited verification certificate or original sworn affidavit (for EMEs/QSEs). Locality points are based on the business address, lease agreement or sworn affidavit, and municipal accounts will be verified. Attendance at the compulsory virtual clarification meeting is mandatory.

Goods must conform to the standards mentioned in the bidding documents and specifications. The successful bidder will be required to sign a written contract form (MBD7).

No specific methodology is required beyond the general conditions. Variation orders up to 15% of the original contract value may be instructed; for measurable quantities, the contractor may be asked to reduce unit prices without escalation.

Pre-bidding testing is for the bidder's account. If goods fail inspection or tests, the supplier bears the cost and must replace them; rejected goods are held at the supplier's cost and risk.

Foreign suppliers are responsible for all taxes and levies outside the purchaser's country; local suppliers for all taxes until delivery. No contract with bidders whose tax matters are not in order or whose municipal accounts are in arrears.

The tender is a rates-based tender; total bid price inclusive of VAT. Payment will be made in Rand, no later than 30 days after submission of a valid invoice accompanied by a delivery note. No contract will be concluded with a bidder whose tax matters are not in order or whose municipal rates and services charges are in arrears. Bidders indebted to the municipality must sign an agreement for deduction of a percentage or fixed amount from payments until the debt is settled. All municipal account numbers in the Stellenbosch area for which the enterprise or its proprietors/directors are responsible must be declared.

B-BBEE status level verification certificate (SANAS accredited) or original sworn affidavit (for EMEs/QSEs) required for preference points. Municipal accounts of all directors/members/partners must be up to date (verified for locality points). OHSA compliance with a valid Letter of Good Standing from the Compensation Commissioner. No award to persons in the service of the state. Foreign suppliers must complete the pre-award questionnaire in Part B:3.

The contract is subject to the General Conditions of Contract (GCC) and special conditions. The supplier warrants goods are new, unused, of the most recent or current models, and free from defects for 12 months after delivery/acceptance or 18 months after shipment, whichever is earlier. Payment will be made within 30 days of a valid invoice. Prices may not vary from those quoted. Variation orders up to 15% of the original contract value may be instructed. The supplier may not assign obligations without prior written consent. Subcontracts must be notified in writing. Delays may incur penalties calculated at the current prime interest rate per day of delay. The purchaser may terminate for default, including corrupt or fraudulent practices, and may impose a restriction on doing business with the public sector for up to 10 years.
