The successful bidder must sign a written contract form (MBD 7). The contract is subject to the Preferential Procurement Policy Framework Act, Preferential Procurement Regulations, General Conditions of Contract (GCC), and any special conditions. The Municipality may terminate the contract in whole or in part and impose penalties or restrictions for non-performance. If the successful bidder fails to deliver or cancels an order, the Municipality may award to the next highest-ranked responsive bidder, provided the price is within budget and all requirements are met. The Municipality reserves all rights and remedies under the quotation, contract, SCM Policy, and legislation.
