Sealed quotations endorsed on the envelope "QUOTATION No. Q12//27" must be placed in the Tender Box at Msunduzi Municipality's Central Stores, 2 Abattoir Road (off Kershaw Street), Pietermaritzburg, 3201, not later than 12h00 on Friday, 11 September 2026. Only quotations placed in the Tender Box will be accepted. Bids must be submitted on the official forms provided, not re-typed. Tenders submitted by telegram, telex or facsimile will not be considered. The document must be completed in handwriting or typed and originally signed by pen; all corrections must be countersigned and no correction fluid used. All required data sheets and forms must be completed and submitted in full, including: Declaration of Interest (MBD 4), Authority to Sign Document, Pricing Schedule (MBD 3.1/3.2/3.3 as applicable), Declaration of Bidder's Past Supply Chain Management Practices (MBD 8), Certificate of Independent Bid Determination (MBD 9), and any other applicable forms. Documents requiring commissioning must be stamped and signed by a Commissioner of Oaths. Failure to complete and submit the required documentation in its entirety may result in disqualification. Specific goals: Black Owned Enterprise (at least 51% black ownership and/or management control) – 7 points, verified via CSD or CIPC; Business Enterprises owned by Youth (at least 51% youth ownership and/or management control) – 7 points, verified via CSD or CIPC; Location of Business Enterprise within Msunduzi Municipality's jurisdiction – 6 points, verified via Utility Bill or Lease Agreement. Tenderers claiming preference points must complete Annexure C in full and submit proof for each specific goal claimed; failure results in no preference points being awarded. The Council does not bind itself to accept the lowest or any tender and may accept the whole or any part.

Compliance required with: Section 24 of the Constitution (environmental rights), Occupational Health and Safety Act, Labour Relations Act, Income Tax Act, Council Supply Chain Management Policy, SANS 10400, Compensation of Occupational Injuries and Diseases Act, and GCC 2015. Penalties: R500 per calendar day for failing to meet implementation plan time frames; consecutive failure to meet responsive time may lead to termination of contract. Price is firm for the contract period with no escalation.

Tenderers should propose a detailed implementation plan for completion of works, including background of the contractor, experience and capacity, overall management, approach and understanding of project requirements, implementation plan to achieve objectives within the required time frame, and phasing of tasks, deliverables and reports. CVs for all proposed professional personnel must be included.

Tenderers must submit a Statement of Previous Experience (Data Sheet 3) detailing similar works completed, including employer details, contact persons, nature of works, and value and duration. They must also provide a Schedule of Resources (Data Sheet 4) detailing management, office, supervisory resources, training programmes, facilities, workforce, and plant and equipment. CVs for all proposed professional personnel must include biographic data, educational qualifications and experience.

Compliance with South African National Standards (SANS 10400) is required. Inspection of contractor's premises: not applicable.

Pricing schedule: Asphalt S10, quantity 120 tons. Unit cost and total cost to be provided. VAT at 15% must be included in the price regardless of VAT vendor status; the price is deemed VAT inclusive. Payment will be made by the Chief Financial Officer within 30 days on receipt of a certificate of payment issued by the Engineer, by cheque drawn on the Council's bankers in Pietermaritzburg. No cash payments. Where the value of works exceeds R3 000.00 excluding VAT, the Tenderer must quote the Council's VAT Registration No. (460 010 783 5) on all tax invoices. Tenderers must have a bank account in the legal name of the Tenderer as per the Tax Clearance Certificate. Insurances: not applicable. Guarantee/warranty/defects liability period: not applicable.

CSD registration: mandatory; provide CSD Supplier Number and Unique Registration Reference Number. Tax compliance: valid Tax Clearance Certificate and Tax Compliance Status Verification Pin (or CSD number) must be submitted; if TCS expires before award, the Council may request a further certificate with 7 working days' notice. B-BBEE: a B-BBEE status level verification certificate or sworn affidavit (for EMEs & QSEs) must be submitted to qualify for preference points. CIPC registration certificate required (Annexure F). Declaration of Interest (MBD 4): discloses any connection to persons in service of the state; no bids from persons in service of the state. Declaration of Bidder's Past Supply Chain Management Practices (MBD 8): declares no abuse of SCM system, no fraud/corruption convictions in past five years, no listing on Register for Tender Defaulters, no municipal arrears over three months, no terminated contracts for non-performance. Certificate of Independent Bid Determination (MBD 9): certifies no collusive bidding. Declaration of Municipal Fees: municipal fees (electricity, water, rates) must be fully paid up or arrangements concluded. Authority to Sign Document: certified copy of resolution or articles of association required. Foreign suppliers must complete the pre-award questionnaire in Part B:3.

Compliance with the Occupational Health and Safety (OHS) Act and the Compensation of Occupational Injuries and Diseases Act is required. Annexure B relates to the OHS Act.

Compliance with Section 24 of the Constitution of the Republic of South Africa Act, 1996, relating to environmental rights, is required.

Contract governed by GCC 2015 and Msunduzi Municipality's standard conditions. Payment within 30 days on certificate of payment issued by the Engineer. Penalty of R500 per calendar day for late delivery. Price firm for contract period, no escalation. The Council may accept the whole or any part of the tender. If the Tenderer fails to enter a contract when called upon, the Council may refuse further tenders from that tenderer. Insurances, if required, must be submitted within 14 days of provisional acceptance and kept in force for the contract duration. The tender, provisional letter of acceptance and final letter of acceptance constitute a binding agreement. Alternative proposals or qualifications must be listed in Annexure A.

Tenderers must be registered on the Central Supplier Database (CSD) and provide their CSD Supplier Number and Unique Registration Reference Number. A valid Tax Clearance Certificate and Tax Compliance Status Verification Pin must be submitted. Tenderers must have a bank account in the legal name of the tenderer as per the Tax Clearance Certificate. Tenderers must comply with the General Conditions of Contract (GCC 2015) and Msunduzi Municipality's standard conditions.
