Submit a sealed hard copy of the tender document, addressed to the City Manager and marked with Tender Number 35332-1J, to the Tender Box at 166 KE Masinga Road (Old Fort Rd), Durban. An identical electronic copy must be submitted via the eThekwini Municipality JDE System (ESP Module). Hard copy submission is mandatory for validity; electronic submission alone is insufficient. Supply and delivery of original spare parts and provision of repair services for MAN buses over a 36-month period. Only Original Equipment Manufacturers (OEMs) or dealers accredited by the respective OEM may submit tenders. Accreditation letters/certificates must be valid for the contract duration. Bidders must state the names of manufacturers of goods/equipment offered. Non-manufacturers, accredited distributors, or agents must provide a valid agreement/Joint Venture Agreement with the manufacturer, covering the contract period. Samples of the full range of products may be required for inspection prior to the closing date. Delivery must include unit prices covering delivery to the specified point, with risk remaining with the supplier until delivery is complete. Bidders must state delivery periods after receipt of official orders.

Only Original Equipment Manufacturers (OEMs) or dealers accredited by the respective OEM may submit tenders. Accreditation letters/certificates must be valid for the contract duration. Bidders must demonstrate capability to undertake the work, including past experience in supplying original spare parts and repair services for MAN buses. Key personnel qualifications and experience may be required.

Bidders must state where samples of the full range of products can be inspected or submit samples for inspection prior to the closing date. Manufacturers of goods/equipment must be named in the tender. Non-manufacturers must provide a valid agreement with the manufacturer, covering the contract period. Delivery must include unit prices covering delivery to the specified point, with risk remaining with the supplier until delivery. Bidders must state delivery periods after receipt of official orders.

Prices must be quoted in ZAR, net after deductions, with VAT-exclusive and VAT-inclusive prices stated separately. Unit prices must cover delivery to the specified point. Estimated quantities are provided in Section 8 (Bill of Quantities/Schedule of Rates) for information only; actual quantities may vary. Pricing must adhere to the Official Tender Form; deviations will disqualify the tender.

Prices must be quoted in South African Rand (ZAR), net after deductions for brokerage or discounts. Unit prices must be quoted for each item and remain fixed for the contract duration, subject to specified variation criteria. VAT-exclusive and VAT-inclusive prices must be stated separately on the Official Tender Form. Pricing structure must adhere to the Official Tender Form; deviations will disqualify the tender. For imported goods, forward exchange cover must be arranged within seven days of the purchase order to fix the exchange rate. Bank charges for forward exchange cover are for the Municipality’s account. Payment will be made only to the supplier; factoring arrangements are not accepted. Estimated quantities are provided in Section 8 (Bill of Quantities/Schedule of Rates) for information only; the supplier must meet actual quantities required.

Registration on the National Treasury Central Supplier Database (CSD) is mandatory. CSD Supplier Number (starting with 'MAAA') must be provided. Tenderers must submit a Tax Compliance Status PIN (TCS PIN) or original Tax Clearance Certificate. SARS TCS PIN can be verified by third parties for real-time compliance. Declaration of Municipal Fees must confirm that fees are fully paid or that an acknowledgment of debt agreement exists, including relevant account numbers. Declaration with respect to the Occupational Health and Safety Act is required, confirming compliance and undertaking to provide a Health and Safety Plan if awarded. Required Municipal Bidding Documents (MBDs): MBD 4 (Declaration of Interest), MBD 5 (Declaration for Procurement Above R10 Million, if applicable), MBD 6.1 (Preference Points Claim), MBD 8 (Declaration of Bidder’s Past SCM Practices), MBD 9 (Certificate of Independent Bid Determination). Joint Ventures must submit a Joint Venture Agreement and B-BBEE Certificate. Bidders must not be in the service of the state (Regulation 44 of LG: Municipal SCM Regulations).

Bidders must comply with the Occupational Health and Safety Act and relevant regulations. A signed Declaration with respect to the OHS Act is required, confirming competence and resources to safely execute the work. If awarded, bidders must provide a documented Health and Safety Plan, subject to Municipality approval. Costs for all health and safety measures must be included in tendered rates. Bidders are liable for penalties for non-compliance.

Contract duration is 36 months. The Municipality reserves the right to accept the whole or any part of a tender, place orders, and is not bound to accept the lowest tender. Successful tenderers must sign a written Contract Form (MBD 7). The Municipality may negotiate final terms with preferred bidders under Regulation 24 of the MFMA, provided it does not disadvantage other bidders or increase the price. Contracts may be terminated if Regulation 44 (SCM Regulations) is breached. Payment is made only to the supplier; factoring is not accepted. The Municipality may cancel the tender at any time without liability.

The 80/20 or 90/10 preference point system applies, determined by the value of responsive tenders. Financial scoring uses the formula: NFO = W (1 - (Pt - Pmin) / (Pmax - Pmin)). Preference points (10 or 20) are awarded for Specific Goals, including subcontracting 30% of work to 51% black-owned SMMEs (Goal Weighting: 100%). Total Evaluation Points (TEV) = NFO + NP. Only technically compliant tenders are evaluated for price and preference.
