All Suppliers are encouraged to make their submission before the closing time. It is the bidders’ responsibility to obtain documents in time so as to ensure responses reach Joburg Market timeously. PLEASE ENSURE YOU SUBMIT 1 x ORIGINAL TENDER HARD DOCUMENT Any documents required that are not submitted in the tender box at the deadline will be considered late. The tenderer accepts that JOBURG MARKET will not take responsibility for the misplacement or premature opening of the tender if the outer package is not sealed and marked as stated. NB: Each bid must be submitted in a separate, sealed envelope on which the NAME AND ADDRESS OF THE BIDDER, THE BID NUMBER, DESCRIPTION OF BID AND THE CLOSING DATE must be clearly endorsed. It is the responsibility of the bidder to ensure that their /his / her bid document is submitted in a sealed envelope and placed in the Bid Box in good time so as not to miss the official deadline of 11:00 am on the closing date. Bid documents submitted via courier services will be acceptable provided that the bidder instructs such courier company or its representative to deposit the documents in the bid box. Documents should under no circumstances be handed to an employee of Joburg Market as it may not be held accountable in the event of any loss thereafter. Bid documents may not be submitted via the South African Post Office as only bid documents received in the Bid Box at the time of closing will be taken into account. Tenderers are to allow for sufficient time to access Joburg Market offices in Admin Building and deposit their bid document in the Joburg Market tender box situated at reception before tender closing time. Tenderers are to note that the Joburg Market offices are open 24hours, seven (7) days a week.

No persons in service of the state may bid. Bidders must have tax matters in order. Must not be in arrears for municipal rates/taxes for more than 90 days. Must submit audited financial statements if bid exceeds R10 million. Foreign suppliers must complete additional questionnaire. Bids from non-attendees of compulsory briefing will be disqualified.

• Scope: Provision of application maintenance for the SPS (System not further defined) for a period of 36 months.
• The successful bidder must sign a written contract form (MBD 7.2).
• The bidder must submit a fully completed bid document including all required MBD forms and supporting documents.

• Pricing schedule must be completed without unauthenticated alterations.
• Rules for alterations depend on the award strategy (per item/category or total bid offer).
• Unauthenticated alterations on unit rates or the total bid offer can lead to disqualification.
• Bidders may offer selective items from the Bill of Quantities; blank items are considered not offered.

• Pricing schedule must be completed and signed as per award strategy.
• Price includes all applicable taxes less unconditional discounts.
• Alterations to pricing must be authenticated to avoid disqualification.
• Joburg Market will perform a financial risk analysis assessing:

• Reasonableness of the financial offer and unit rates.
• Bidder's financial capacity using ratios: current ratio, solvency ratio, operating profit margin, cost coverage.

• Bidders must provide proof of good standing regarding municipal accounts: not in arrears for more than 90 days.
• Submit latest municipal account (not older than 90 days) or a valid lease agreement.

• Mandatory registration on the National Treasury Central Supplier Database (CSD).
• Submit Tax Compliance Status PIN or CSD number.
• Foreign suppliers must complete a pre-award questionnaire.
• Completed and signed MBD forms required: MBD 1, 4, 5, 6.1, 7.2, 8, 9.
• B-BBEE compliance: Submit valid B-BBEE Certificate or Sworn Affidavit.
• Submit ID copies and share certificates for shareholders/directors (certification not older than 3 months).
• Joint ventures require a signed JV agreement and consolidated B-BBEE certificate.
• Registration with CIDB where applicable.
• No bids accepted from persons in the service of the state.
• Declaration of Interest (MBD 4) must be completed.
• For procurement above R10 million, audited annual financial statements for the past three years may be required.

• Specific Goals for B-BBEE and local economic development are scored.
• Points are awarded for:

• Black ownership (51% or more).
• Women ownership (51% or more).
• Black Youth ownership.
• Black People with Disabilities ownership.
• Black Military Veterans ownership.
• Cooperatives owned by Black People.
• SMME status (EME or QSE).
• Location within City of Johannesburg or specific regions/townships.
• Community upliftment initiatives.
• Subcontracting to designated groups (up to 30%).

• Required proof includes B-BBEE certificate, CSD registration, ID copies, municipal accounts, and subcontracting agreements.

• The bidder's offer remains binding and open for acceptance during the validity period.
• If the bidder withdraws or fails to fulfil the contract, Joburg Market may recover additional costs incurred.
• Acceptance of the bid may be communicated via email, fax, or post.
• South African law governs the contract.
• The bidder accepts full responsibility for contract execution.
• The tender document and written acceptance constitute a binding contract until a formal contract is prepared.
• Contract duration is 36 months, commencing from the date in the letter of acceptance.
