The initial and final establishment items, all operational-overhead items and the 16-week site-maintenance item must be priced. Rates must cover all direct costs, overhead, profit, risks, liabilities and obligations.
Rates excluding VAT must be firm and binding for the full framework period. Electrical prices are also expressly firm and not subject to adjustment.

Submit rates excluding VAT. Each rate must include all labour, materials, equipment, design, professional fees, travel, meetings, documentation, overheads, profit, general risks, liabilities and contractual obligations associated with the described work.
Rates remain binding and are not subject to price adjustment for the full framework duration. Lump sums in the establishment and overhead section are also fixed during compensation-event assessment.
The employer may order only the quantities required for each works project and may order no work at all.
Price the initial establishment, de-establishment and restoration, and the ongoing operational and site-establishment costs measured over 16 weeks. An unpriced establishment or overhead item gives the bidder no right to recover the related costs.
Include performance-bond costs where applicable, insurance, UIF contributions, Occupational Health and Safety Act compliance, a community liaison officer, and labour and training obligations.

Provide the resources for a community liaison officer and comply with the labour and training requirements applicable to the works.
Erect approximately 80m of 1.8m-high site hoarding before work starts, with three gates, and maintain it clean, secure and free of unauthorised posters and graffiti. Remove and make good the hoarding at completion.
Install 10m of 3m-high dust screening and use controlled spraying or jetting to prevent dust nuisance during demolition and alteration work.
Keep excavation surfaces stable, provide the specified collapse-risk protection for sides deeper than 1.5m, and keep excavations free of water.
Use temporary shoring, strutting and needling where required to maintain stability. Protect retained work, openings, services and occupiers, and make good any accidental damage at the contractor's cost.
Do not disconnect electricity, air conditioning, telephone or other building services without prior notice to the architect. Specialist electrical and air-conditioning alterations must be performed by direct subcontractors under the main contractor's coordination.
Maintain safe public access to roads, footpaths and nearby buildings, minimise disruption and arrange all necessary protection and reinstatement at no additional cost.
The measured demolition rates contain no separate waste allowance. All demolished material becomes the contractor's property and must be removed from the site as it becomes available.
Cart 27m3 of surplus excavated material to a disposal site selected by the contractor.
Use controlled dust suppression during demolition and alterations, and provide temporary screens to limit dust movement.
Remove site establishment at the end of the works and restore the affected ground and surrounding surfaces to the employer's satisfaction.

The conditions are the NEC3 Option B contract, April 2013 edition. Bidders must obtain the conditions at their own cost.
The arrangement operates as a series of works projects instructed from time to time. The final price for each completed project will be calculated from actual quantities at the relevant tendered rates.
The employer may decline to order any work. The entire BOQ is provisional, will be remeasured during construction, and may change with site conditions, updated information and construction methods.
Pricing and risk allocation
Tendered rates must be full, VAT-exclusive and inclusive of all execution costs, general risks, liabilities, overheads and profit. They also cover any design, drawing or information work needed for the described scope.
Rates must remain fixed for the full framework period. Fixed lump sums in the establishment section cannot be adjusted when compensation events are assessed, although the employer may elect to use the section rates instead of Defined Cost for compensation-event calculations.
All establishment, overhead and incidental-cost items must be priced. Failure to price an item prevents recovery of the associated duties, services, facilities or obligations.
Blank, zero, dash, included and similar entries are nil rates. The employer may ask the bidder to explain nil rates and may review rates that appear excessively high or low. Excessive high rates may be negotiated.
Separate items may not be grouped under one lump-sum rate. Metric units apply.
The pricing basis is the Standard System of Measuring Building Work, sixth revised 1999 edition, and the 2008 Model Preambles for Trades. Items are measured net under the drawings, with no separate waste allowance.
Proprietary products specified by trade name may be substituted only with the employer's approval.
Site, access and insurance
Bidders are deemed to have accepted the ground, access and site-facility conditions following the advised site visit. Claims based on those conditions are not permitted.
Construction and temporary works must not improperly obstruct public roads, footpaths, nearby buildings or occupiers. The contractor indemnifies the employer against resulting claims, damage, costs and expenses, and must restore affected streets, paving, kerbs and other surfaces.
Demolition material becomes the contractor's property and must be removed promptly. Existing services may not be disconnected or disturbed without prior notice to the architect.
Guarantees and cost clarification
Waterproofing must carry a 10-year guarantee. All components must carry a 10-year workmanship and materials guarantee, measured from installation.
Powder coating requires a minimum 15-year manufacturer guarantee; coil-coated aluminium requires a 20-year manufacturer guarantee subject to its conditions.
The 17-month tender period should be reconciled with the 16-week measurement period used for the two ongoing-overhead items.
