Definitions BILLS OF QUANTITIES: System / Method of measurement

CONTRACT SUM is the total offered price inclusive of VAT as stated and agreed to in

INTEREST: The interest rates applicable on this contract, whether specifically

another and for the purpose of interpretation, the priority of the documents shall be in

accordance with the following sequence:

(a) the Form of Offer and Acceptance;

(b) the Schedule of Deviations;

(c) this Contract Data;

(d) the standard JBCC building agreement as general conditions of contract;

(e) the Drawings;

(f) the Specifications;

If an ambiguity or discrepancy is found in the documents, the Principal Agent shall

issue any necessary clarification or instruction.

[11.5] Amend 11.5.1 and 11.5.2 to read as follows:

The Employer shall not provide a payment guarantee.

11.0 Securities

[11.1.1] The contractor is to provide either a variable construction security as per clause

11.1.1 or a fixed construction security as per clause 11.1.2.

[11.2.1] The variable construction guarantee to be provided shall not contain an expiry date.

[11.1.3] New Clause 11.1.3 –

The fixed construction guarantee shall be accompanied by a 5% retention, to be

released once the project has reached Practical Completion.

[11.8] The variable construction guarantee shall be returned within fourteen (14) calendar

days of the issue of the Works Completion to the Contractor.

[11.10] Amend the clause:

Waiver of the contractor’s lien or right on continuing possession is required from the

Contractor without the Employer providing a payment guarantee.

Execution

12.0 Obligations of

the Parties

[12.1.2] Add: The Employer shall provide a construction permit issued by Department of

Labour before site possession can be given to the Contractor.

[12.1.4] The following restrictions to the Contractor apply to the site:

The Contractor will be restricted to work only within the area demarcated for the

specific works

[12.1.5] Add: Possession of site shall be twenty-one (21) calendar days after acceptance

subject to the conditions of clause 12.1.2 being satisfied, Principal Agent and

Employer agreement and complying with terms of 12.2.22.

The period for the commencement of the works after the Contractor is given

possession of the site is seven (7) working days subject to the conditions of clauses

12.1.2 and 12.1.15 being satisfied.

[12.1.11] Amend to read as follows: The type and extent of work to be undertaken by direct

contractors: As per the scope of works.

[12.1.14] Add new clause: A detailed programme for the works will be provided to the Principal

Agent in “Microsoft Projects (Latest version)” clearly indicating the critical path

activities and all dependencies within fourteen (14) working days after the issue of the

Form of Offer and Acceptance. A detailed cash flow must also accompany this

construction programme.

[12.2.2] Amend to read: Contractor to submit to principal agent all required documents as for

sub-clauses 12.2.2 and 12.2.2 within fourteen (14) working days, except for

securities.

[12.4] Add new clause:

The Contractor shall remain responsible for contract work insurance where the works

is for alterations or renovations to an existing building(s).

17.0 Contract

INSTRUCTIONS Add new clause:

17.6 The Principal Agent shall obtain the Employer’s approval before issuing an instruction

to execute a Variation.

17.7 Add new clause:

No expenditure shall be incurred under a Contingency Allowance without the written

approval of the Employer.

19.0 Practical

Completion

[19.1.3] The date for practical completion is twelve (12) calendar months from the date of the

site handover/possession which shall include the December builder’s holidays.

[19.5] Delete the words “subject to the contractor’s lien or right of continuing possession of

the works where this has not been waived”

20.0 Completion

[20.1] Sectional completion will not be applicable.

20.2 The principal agent shall issue:

21.0

Defects

Liability

[21.1] Amend the clause: The defect liability period shall commence on the date of the

works completion and end twelve (12) calendar months from such date.

The defects liability period for electrical works shall commence on the date of works

completion and end twelve (12) calendar months from such date.

23.0 Revision of

THE DATE Amend to read: The Contractor shall allow twenty (20) working days per year (12

[23.1.1] months) for the adverse effect of weather conditions and shall not be entitled to a

revision of the date for Practical Completion for delays suffered by adverse weather

conditions

24.0 PENALTY Add: In addition to penalties for late or non-completion, the employer shall be entitled

to impose a penalty on the contractor for each calendar day for non-compliance with

the Occupational Health and Safety Act No. (as amended), or any

regulations made thereunder, where such non-compliance has been duly recorded by

the principal agent or health and safety agent and remains unremedied within the

prescribed time. The rate of such penalty shall be as stated below. The imposition of

such penalty shall not limit the employer’s rights to other remedies, including

suspension or termination under the provisions of this agreement

Penalty for late or non-completion shall be R28 140.00 per Calander day.

Penalty for non-compliance of the Occupational Health and Safety Act No.

as determined by the Principal Agent shall be R42 210.00 per Calander day.

25.0 Payment

[25.2] Add: The interim payment certificate is to be issued by the 20th day of each month or

otherwise agreed by the parties which is to be provided in the Post Tender section under

clause 41.6

[26.1] Amend to read: The principal agent shall in line with the Contract Price Adjustment

Provisions determine the value of adjustments to the contract value in cooperation with
